APPROVAL OF MINUTES:
The minutes of October 17, 1972 . were
approved as mailed.
BUSINESS:
Mr. McGivern requested that a member be
selected to represent the Planning Commission
on the Subdivision Committee. Chairman Popp
appointed Comm, Schme1z to this position and
he accepted. A rotation of the Site Design
Review Committee was suggested and Chairman
Popp appointed Comm. Bond and Comm. Waters;
'both acce,pted.the positions.
CORRESPONDENCE:.

Mr. McGivern read a letter dated October 19,
19.72 from Jim & Leora Ayers, residents of
133 Sunny S1ope.Road protesting the proposed
development of 4:00 units at end of Sunny
Slope Road,: This Subdivision development
has not been before the Planning Commission
to date but will be in the future. Mr. Mc-
Givern informed the Planning Commission this
letter will be held in abeyance until a Public
Hearing is held on the Subdivision tentative
map.
A,memoranduin h_ad been received by the Planning
Department from the - Society for California
Archaeology expressing their concern about
the Environmental Impact Reports with regard
to archaeological resources. A list of
individuals and their. iiistitutioris who this
society feels are qu.alifed' to undertake
archaeological.impact studies was included.
A letter dated November 3, 1972 submitted by
Larry Paulucci, Ernest Howe, and Sorene
DeMarti'ni was read by Mr. McGivern in which
they requested that the developers of the
r proposed Jack-in-the-Box be required to
submit an:Environmental Impact Report. The
November 7,
applicant has complied :with the first
step in this procedure; by ; furnishing an
Environmental Assessment Statement which will
be brought, ,before the Plann °ing Commission
after evaluation by.the City staff.
A letter dated November 7, 1972 from Lounibos
& Lounibes - - was'; read by Mr. McGivern request -
in' a two week postponement of the,hearing
of the _ Petaluma Properties development to
submit all,requir.ed environmental reports,
Mr. McGivern informed the Planning Commission
that Mr. Robert, the City Attorney, was
present this evening to outline the program
and procedure regarding -the Environmental
Impact Reports- ,arid; a resolution would be
offered for'censiderat -ion: 'Chairman Popp
requested that this, matter be brought up
after the variance' and Petaluma,Properties
rezoning cases on the agenda.

Applican't's requested a variance to allow

increase in 'allowable lot coverage. from 35%
to ;42. 2 to perm. 1 patio roof to be in-
stalled at,1714 Caracas Court. Comm. Hood
spoke representing the Variance Review
Committee-and-indicated no objection could
be found and approval was recommended, provid-
ing there . were . no .obj ecti;ons, stated by. the
public attending this- meeting. Chairman
Popp asked the ;pub,li.c,present if there were
any objections to this variance and no
response was-given. Comm. , B °alshaw made the
motion the variance be approved as recommended
by Variance Committee and Comm. Waters
seconded the motion.. AYES 7 NOES 0

In accordance- with-request from Lounibos &
RE 0NINT Z18 -72:
Lounibes, Comm. Waters made 'the motion that
this Public Hearing be postponed for two
weeks. Comm. Hood seconded- motion.

Comm. Balshaw suggested that a Traffic Study
be - .revi:ewz d. by the City Engineering staff
prior to the continuation of the hearing.
INTERIM GUIDLINES
AND PROCEDURES FOR
PREPARATION -OF
ENVIRONMENTAL IMPACT
REPORT:
Mr. Robert ref°er.red the.resolut en pro-
posed for consideration this evening and
mentioned that it contained all the factors
recommended by the Attorney General. The
Planning Commission should basically be.the
final authority and the City Council the

appellate authority. At the request of
Comm. Daly, Mr. Robert explained the pro -
cedures and time frame involved and added
that it w his, opinion that the matter of
Environmental Impact Reports should be
treated conservatively and should be a
matter of record on each applicable file that
an environmental assessment had been made.
He also stated the City was not exempt re-
garding this matter.
A lengthly conversation ensued regarding
detailing or generalizing the resolution,
who.'the.approving authority would be, and which
department- wou -1d responsible for receiv-
ing, processing and evaluating these reports.
, Comm. Balshaw expressed his concern about
- detailing and remaining within the purview
of the " law. , Chairman Popp queried Mr. Robert
if he felt the contents of the resolution
complied with recent decisions as far as the
recent Supreme Court action (Mono County vs.
Friends of Mamoth.) and who would be favored
if an appeal "were made.. Mr. Robert felt it
would be impossible to predict, as it would
depend upon circumstances, and he felt good
reasoning and judgment were the ,best guide -
lines to follow. He reit6kated that the
guidelines utilized in preparing this reso-
lution were those set up. the.Attorney
General of the State of California. Various
changes to the :resolution were decided upon
by the Planning Commission. Comm. Waters
made the motion.that th&- .resolution be approved
as.modified and `the motion was seconded by
Comm, Schmelz.

OTHER BUSINESS: Comm. Balshaw made, the motion that a Public
Hearing be set to determine reclassification
of the EDP regarding property .in the So.
M'cD.owel.l .'Blvd- Caulfield Lane area that had
been discussed at the last Planning Commission
meeting. This-suggestion was resultant from
the recent opposition of the public to chang-
ing this area from 'a R -1 -6000 Residential
Dis�tri,ct to a C -N Commercial District. Mr.
Balshaw fe action was necessary to prevent
-the area being zoned -C -N by default in
January 197T. — Mr. McGivern interposed that
action on the proposed zoning ordinance could
resolve this problem by taking action to
make this a "S" study district with the end
result of bringing the EDP into concert with

with the City-Coupcil action and the desire
of the public to retain some type of resi-
dential z-oning..

Bob Koeni.tz.er -also queried the placement
of buildings .in. a flood plain area. Mr.
McGivern informed him that- no particular
areas are des•ignated,right now on the Master
Plan or EDP as a flood plain district.
These districas,will have to be determined
and a hearing held which would result in
future building impact.
Norman Rollins asked if the permitted prin-
cipal. uses located in Section 13 -200 were
typical or exclusive and was told they were
typical.. Comm. Balshaw queried whether
gasoline servi,ce stations should not be.a
conditional us.e in all,zones and,was told
that he wa °s•, and it, would be changed
to read only,as,..a conditional use in all
zones
Cha'i,rman..Pop,p closed the Public Hearing.
Mr. McGivern asked for any questions,.from
the Planning Commission with regard to the
changes submitted by the Zoning Committee.
Comm. Rood,wis'hed the term "Z.oning Adminis-
trator" clarified and was told that the

Comm. Balshaw referred to paragraphs 11 -204,
1 -208 and 13- 20,8.-and remarked that Shopping
.Centers should be a conditional use, not a
permitted principal use.- This item was
agreed upon to be changed.
No other quest -ions were raised by the
Planning Commission regarding' the . changes
submitted by 'the Zoning Committee..-,
Comm. waters' was excused at this time.

Chairman Popp. suggested that a motion be made
to continue the.hearing to the following
Tuesday, so that. the proposed zoning ordinance
wou7.d be ready for the next City Council meet-
ing.
Comm. Schmelz'made amotion that the closed
Public Hearing, should be,continued to the
next Tuesday, November. 14, 1972 and. - Comm.
Hood seconded the motion. AYES 5 NOES 0
