CONTINUATION OF n . Popp opened the meeting for further dis-
HEARING ON NEW cussion of the proposed zoning ordinance. The
ZONING ORDINANCE changes suggested by Comm. Hood were reviewed and
RES. 13-72: change's were agreed upon as follows:
1) Page .5, paragraphs 2-306.2 and 2"306.3 should
he changed to read as follows:

6) Page 79, paragraph 20-205'- Put a period
after the word"acce,ss" in the sixth line and
add the following sentence. "This alternative
does'hot apply to residential parking."
7) Page 114, paragraph 21-403.8 - first line
s'hould he changed to read "Buildings will be
of the type of construction as defined in the
Service Station Building Code and . . . . . ..
With regard to paragraph 6-4.05, it was felt the
ordinance should remain as written, but possibly a
permit device for small animals on less than 40,000
square feet could, be initiated.
,Mr. Don Waite from the audience was recognized by
the Chairman and, he stated , that he felt the 200
feet limitation in paragraph 21-402.4 was too
restrictive and . suggested thAt it could be 240 feet
to accommodate possible subdivision of a lot into
four parcels. Chairman Popp informed him that the
intent was to discourage this type of development.
Mr. 11aite.further questioned Section 27-100, EFFECT
OF DEN OF APPLICATION as he felt it'should allow

for denial without prejudice so applicant would not

After discussion it was decided to add the following
to the sixth line of this section after the word
"denied" - "or an application denied without
prejudice.
Mr. Waite felt this should also apply to a use per-

this change because the Use permit allows for
conditions of approval.
Comm. Waters made the motion th'at the proposed
zoning ordinance be accepted as amended and be
forwarded to the City Council for their action.

. OTHER 'BUSINESS:
Comm. Waters brought out the fact that previous
violations of use permits on Lakeville St. had not
been resolved and further action should be taken
on the matter. it Was agreed to place this matter
on the agenda for November 2.1, 1972,
