HomeMy WebLinkAboutResolution 2020-120 N.C.S. 07/20/2020Resolution No. 2020-120 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDED PROPOSITION IE SUB -GRANTEE AGREEMENT FOR THE PETALUMA FLOOD MANAGEMENT AND ENHANCEMENT PROJECT WITH THE SONOMA COUNTY WATER AGENCY EXTENDING PARTIAL FUNDING OF THE PETALUMA RIVER FLOOD MANAGEMENT DENMAN REACH PHASE 4 PROJECT WHEREAS, the City of Petaluma has adopted policies calling for the development of flood terraces and a riverfront trail system in the 1996 River Access and Enhancement Plan and the 2008 General Plan 2025; and WHEREAS, the Sonoma County Water Agency was awarded an initial grant from the State Department of Water Resources in the amount of $1,754,322 for land acquisition and flood control management in the Denman Reach area of the Petaluma River; and WHEREAS, the Sonoma County Water Agency (Agency) approved $750,000 in funding for the project; and WHEREAS, the Agency Zone 2A committee recommended to the Agency governing board additional funding in the amount of $131,600 for the Denman Reach Phase 4 Project; and WHEREAS, the Agency approved an agreement to provide $2,635,000 in funding to the City to execute the Denman Reach Phase 4 flood protection project to acquire a vacant 5.47 acre parcel on Industrial Avenue, create a flood detention basin, create additional river front trails, and remove a sediment plug in the Petaluma River at the Corona Road bridge; and WHEREAS, on January 7, 2019, the City Council adopted Resolution No. 2019-003 N.C.S. approving an Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the Denman Reach Phase 4 Project in accordance with the requirements of the California Environmental Quality Act; and WHEREAS, the City Council of the City of Petaluma approved the Agreement with the Agency by adoption of Resolution 2017-126 N.C.S. at the August 7, 2017 Council Meeting Authorizing the City Manager to Execute an Agreement for Partial Funding of the Project with the Sonoma County Water Agency in an amount of up to $2,635,000 subject to approval by the City Manager of the final agreement terms and confirmation by the City Attorney that the agreement terms appropriately address the needs of the project and the City's interests and approving an amendment to the Denman Reach Phase 4 C 163 01722 to adjust the budget during the next available quarterly budget adjustment cycle to reflect the revised project budget of $2,665,000, including $29,000 in "in-kind" project staff resources as presented; and NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Petaluma as follows: 1. The above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. Resolution No. 2020-120 N.C.S. Page 1 2. On January 7, 2019, the City Council adopted Resolution No. 2019-003 N.C.S. approving an Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the Denman Reach Phase 4 Project in accordance with the requirements of the California Environmental Quality Act. The City Manager is hereby authorized to execute on behalf of the City the First Amended Proposition IE Sub -Grantee Agreement for the Petaluma Flood Management and Enhancement Project with the Sonoma County Water Agency Extending Partial Funding of the Petaluma River Flood Management Denman Reach Phase 4 Project. Under the power and authority conferred upon this Council by the Charter of said City.
