The Commission reviewed the variance application filed,,-by Philip Joerger
to allow an ,85 foot s deyard. set back for aft existing` structure in the
subdivision of a minor lot split of A,P, #6®041-21 lo.cat
ed.at 24 Magnolia
Avenue, In his report;, Acting Planner Graham recommended denial of the
variance stating that no hardship exists since the interior property line
could-be shifted approximately,'S` feet to the eas;t and would still yield
the desired frontage and simultaneously conform to the requirements of
the Zoning rdinance,, He further- indicated that ranting of„ the ; variance
g g
would qet a precedent whereby d -, eve'lo.pem of standard. and substandard_ lots
could : request variances for setback requirement'"s simply because of utili-
zation of a four hour type construction [the existin- .structure (Ted ®s
Wheel Alignment) is of said type construction]
Mr, Joerger,Ted Kennedy and Norman Rollins, `realtor all,:,spoke in. be
half of the request stating that',re.quiring a 5 ft. , sideyard setback be
tween. his. bu ildi:ng and the new lot, line would only result. ,in a junkyard
since, it, ways mot wide enough for any practical purpose. Also, the ex-
isting structure - had been constructed of a four-hour f irewall type of
• construction with the intention of placing another building adjacent to:
it, Mr., Joerger stated that he -had been Verbally assured by the former
