( Regular meeting of 'the Petaauma Planning Commission was held on December
�,3,, 1968 at 7 :`30. o'clock p.•m. in the Council Chambers., City Hall, Petaluma.

MINUTES The minutes for November 19th, 1968 were approved

CORRE'SP'ONDENCE
1. Fire Department
A request was read from the Fire Chief; that the Planning Com-
m ss.ion initiate a variance .app li:cation to aglow a 0 foot side-
yard setback for the proposed addition to the main fire station
located on Second & D streets. The variance will be conside -red
on December 17, 1968..
2. Taco Bell :Inqui -ry
A letter was read from Gary L. Grah-am,, Real Estate Representa-
tive for Taco Beill, requesting the Qbmmiss;ion. to make a deter-
mination as to the classification this type of food dispensing
operation would have (Drive - Restaurant�or restaurant). The
Commission directed the - Rlanning Director to inform Taco Bell
that tlibix operation would be considered a restaurant. The
motion was made by'Comm,. Koenitzer, seconded by Comm. Perry and
passed unanimously
3. Sonoma County Subdivision Amendments
The; Planning Director informed the •Commiss_i.on of new legis.l,a-
tion received from Sonoma County Plann ftg Department on December
2, 196.8,, relative to amendments to their subdivision ordinance.
In view of the fact that. the Commission did not have ample time
to study the new legis.lation they were not prepared to make
any definite. comments or ;r-.ecommendations at this time,.
The Commission further recommended that the County Planning
Department mai -1- co.p_es of the County agenda and any new, leg : sla_ -
tion''. or reports dir "ect_l' -y to the Commis's'ioners.
4. Sanderson Zoning.. Ref:erra -l:

approval. Mr. Larry Parks:;; on the: behalf of the
applicant, was present and requested a modification
to. Item No .. 3 which required that a decorative
screen fence, 6 feet high, be provided at the rear
of the site. In,view of the fact that a cement block
building faces the re;a=r'site, the Commission was in
agreement that an alternate method of 'screening would
be acceptable (the wall o.f the adjoining building as
mentiohed..above .shall be painted to . a height of 10
feet with climbing :ivy planted thereon)., A motion,

Chairman opened the public . hearing to, con-

-ation filed, by 'William Y.
Foster and 5, other owners to rezone 11
parcels of land from R-,14,006' (,,single family) to
R- 2 3.0Q0, (duplexes) Zone or Districts. The,
parcels comprise an area which,ks bounded by Cherry
Street on- the south, and west sides, magnolia Avenue
on the north, and by St,. Vincent's High School and
two ,slngle family "residences' on the east. The
staff recommended approval of a rezoning to R-2-3000
.on the 'basis of the -following considerations as
shown on Exhibit "A", part of the permanent file:
1. The area to be rezoned should be limited to
those properties which have frontage on
Magno-lia Avenue,
2. Vehicula.r access should be only by way of
Magnolia Ave.
3, Magnolia Avenue should 'be widened and improved
i n accordancewith requirements of the
City Engineer pr , io , r 'to, -final approval of the
development 'of the s'ubect properties fronting
on Magnolia Avenue
Mr,. Henry, Murphy, major stockholder in Cypress Hill
Memorial 'Park, addre the, commission and said that
b.asi..cally he had no objections to the rezoning but was
of the opinion that, it was premature (that many things
should b.e considered first-,), such as the widening of
Magnolia Avenue. Mti, Vidtor'De Carli voiced no op-
Position to the rezoning but did express concern of
the drainage problem. He stated that the development
,of the subdivisions in. the area - has caused much
.flooding of his pr"op'er-ty, -located on Petaluma Blvd.
North and Magnolia Avenue. Mr.. Fester informed
the, Comm issioft. that Sonoma County FloPdL Control has
: already,' acquired, easements. :and money budget, to relieve
the flooding problems. Mr. Foster stated that it
is anticipated that they will begin the first phase,
starting 'from the river and working - back to Petaluma
Blvd . Nor-tih early - next year'.
Referring to Mr Murphy'ls concern over improvements

CITY OF PETALUMA Chairman Stanley opened the public hearing to con -
'USE PERMIT = sider the use, permit,, application filed by the
,FILE U28 -68' De p artment of'Publ.ic Works' to locate a um p ing
station in an, R -2- 6,00-0 Zone on the southwest corner
of: the intersection of Misolon Drive and McNear Avenue;
and to permit said cons;tructlon on a substandard size
lot. David A. Toung, City Engineer, informed the
Commission that the p A uirig is necessary to to boost water
-from the aqueduct to'the new reservoir on Purrington
Road during the summer months Two ladies , ( Mrs,.
Gino Rosso ti and'Mrs,: Leroy Rossoti), asked several
questions of 'Mr.. Young.. Mr® Young assured the. ladies
that the City would landscape the area, screening the
facility from the view , o,f' adjacent properties. The
variance to allow a. site: oT approximately 3,25,0 square
feet inlstead of 12 '06, 5s,quare feet as required by the
Zoning Ordinance, was °requested because to purchase a
large± lot would impose a hardship on the taxpayers,.
A motion, approving the use 'permit., including
the variance, with the condi as stated in the
staff' report (rel:ative to submission of site design
.review) was introduced by :Comm- Perry, seconded by
Comm. Koenitze'r, and passed unanimously.
SANDERSON Chairman Stanley opened the public hearing to consider
REZONING the re-application filed by ,Aubrey and Roger Sander -
FILE Z14 -68 son to rezone A, -.P. Nos. 7- 411=7., = -9 and -11 from an
M -L (,Limited Industrial,) District to a C -H (.Highway
commercial) District. The parcels under consideration
are located on the southwest side.of McDowell Blvd.
and,Old Redwood H- ghway., Due to a reversion clause
in the Z`onring' Ordin-ance the, original zoning (granted
10/3/,66) had expired and the area therefore reverted
back t.o its original, zone:, M -".L (Limited Industrial..)
Mr Aubrey Sanderson was present. and said that plans
for. 'construction on the land had 'been delayed due
to the formation of,Assessment.District #9. No ob-
jections were voiced., Re's. Z14 -68, recommending the
zone change to the ;City Co- until., was introduced. by
Comm. Koen tzer, seconded by-Comm. Perry and passed
by all members present..
PRESTON The- Commission reviewed the variance application filed
VARIANCE by Merton Preston `to 'construct. a new commercial
FILE V21 -68 building at 326 Petaluma Blvd.. North_, with a 0 foot
side= ,yard setback on, each.. :side. in the staff' ,report,
it was noted that the topographic conditions on' the
site presented, a physical, 'hardship (due to 'a steep.'
bank at the rear, of the parcel) and only a, limited .
area of the lot can be built upon. The staff re,c:om-

DR* LEOKI The Commission reviewed the side .plans submitted
SITE DESIGN by Dick Lieb,.representing Dr. Leon , to construct
FILE 5.107 an addition to the rear ,of an existing medical
offi building located at 111 -6 "B" Street. The
staff` report i,ndicated that the landscaping as required
by the site design approval gran_ted.in January, 1964
for the'medical building was not in accordance
With the plans approved.. A motion, approving site
design, with the condition that landscap shall be
provided as requ by the site design approval
,granted in, January 'of 1964, with modifications to
accommodate ekkst•ing landscaping and the proposed
addition as shown on Exhibit A, that the addition
shall conform to the requirements of the Uniform Building
Code and Zoning Ordinance, was .introduced by Comm.
' Perry, . seconded by .Comm -. Koenitzer and passed by all
members present.
PENDING Comm Koen'tzer expresses a desire to make decisions
