O'Bri:en, requesting the Commi,,ss on, to schedule a public hearing for -the purpose of recommending the addition of drive -in restaurants to the list o,f Conditional Uses : for the C =N Zone. (Mr. O'Brien holds an option to purchase the property located on the southeast corner of East: Washington Street and Edith Street) Mr e O'Brien further proposes to ,request a rezoning of the parcel adjacent to the subject site X2.19 Edith Street) to C -N Zoning. Mr. O'Brien proposes to construct a drive -in restaurant on said' parcels of land, The Commission set, January 7, 1969 as the date to consider both petitions Park & Recreation "Commission A letter was recelved from the Park & Recreation Commission relative : to State Law AB 1150 which provides the vehicle by which muni...cipal, governments can establish an ordinance which . could require developers to allow for park and recreation areas within their subdivisions. Mr. McGivern also i- nformed the Commission that the Council has instructed the Planning Commission and Parks and Recreation Commission to study a, means of establishing some type of bedroom tax or dedication procedures of lands for park purposes and.prepare, a report for their consideration. Mr. Mcdive�rn presented the staff :report, zt°ating that the propo ed . addition is Aeeces^ ary to accommodate two additional pieces of faire and safety equipment together with addi tional office space to provide adequate fare. and safety protection for the :service area of the subject fire station. Chief. Benton addressed the Commission stating that the proposed addition would be a:d.e'quate to. serve the. City for 'another 10 to, 20 years otherwise it would' be ne`ces,s,ary to acquire a new site within the very near futurei Based on the fact' that the evidence submitted complies with the regulations :for granting a variance (as set forth in Section 1 ; 9, , -70,1 through 703) a motion ap proving the variance was, introduced by Comm, Koenit?er., seconded 'by Comm. Battaglia and passed unanimously by all members present . -3- P lanning j 'December Commission, 1 7, '19 6%8 SITE A motion, g- ran'.t_ing site design review for the proposed .DESIGN addition to the fire station, with the conditions as outlined in the staff report, was introduced by Comm. Koenitzer•, seconded by Comm. Styles and passed unanimously, SONOMA The Commission reviewed the tentative map filed by Sonoma VENTURES Ventures for a 12 ,lot subdivision to be located on the RES. 24 -68 easterly slide of Keokuk Street, between Cherry Street and Magnolia A Hal'Wood,. Assistant City Engineer, addressed the Commission, stating that the proposed extension of Liberty Street (which has been shown on the General Plan since 19:.62 and also on the select s ^treet system) would bisect the proposed subdivision and therefore recommended denial of the map until the Council makes a definite decision regarding the plan lines for the ex- tension of Liberty Street. Mr. Mc'Givern concurred with Mr. Wood indicating that it appears to be a Council decision. Mr.. Browne, design engineer `for Mitchell & H.eryford, engineers for the subdividers, addressed the Commission and was of the opinion that the land could still be subdivided with Liberty Street as'proposed -by the plan lines but it would cause, problems relative to providing access and utilities to the parcel. A, motion., recommending disapproval of the s.ubdivisi;on WITHOUT PREJUDICE, was in- troduced by Comm. Styles,, seconded by Comm. Koenitzer and was unanimously•dis;approved. CASA GRANDE The Commission reviewed the tentat.ve, map far. Casa Grande MANOR SUBD. Manor S:ubdiv%sion, to be located on South McDowell Boulevard, RESo 23 -68 filed by Con diot -ti Enterprises. Mr. McG vein stated that the subdivision committee had reviewed the map and had set - forth some' 1 -0 conditions of approval: Mr. Ron Simpkins, representing.MacKay & Somps, engineers for the subdivision, addressed the Commission and voiced no opposition to the conditions b ut did request modification to Items #2 and #9 which would allow for alterna =te methods of compliance if acceptable to'PUblic Works and Sonoma County Flood Control, Mr. Hal Wood., As,sistant.Engineer, voiced no opposition, to the request. Res. 23 -68,, approving;. the tentative map of .Casa Grande Manor Subdivision with the 10 conditions as outlined in the ,staff report (with the .modifications as requested by Ron 5impk_ins) was introduced by Co Styles, seconded by :Comm. Battaglia and passed 'by all mber �NVONDALE At the request of Herbert Passsar.ino, land surveyor for #4 the, subdivider, Mr. Marino Crnelia requested that action on the tentative map of Avondale Subduwis'ion No. 4 be postponed until the next regular meeting. Planhing Commis'S�izon December 17, 1 DAVID D. The Commission reviewed the proposed rezoning of 80 YOUND acres of land owned by David D. Young .from M-L (Limited REZONING Indus�trial) to an R-M-15,00 (Multi-Family Residential) 'FILE Z15-68 Zone or District. The rezoning, Was initiated by the Planning Commission at the direction of the City Council following their meeting on, December, 2, 1968. A compre- hensIve .,staff report was presented, including displays relative to the amount of land available for industrial land that could beprovided.wit-h the : necessary utilities. Mr. Clyde Nelson, attorney for Mr. Young, spoke on behalf of. the rezoning app.lica.tion. He reminded the Commission of the length of time this p.articiular parcel of' land has been under consideration by both the Planning Commission : and. the, 'C ity Council. Mr. Dick, Alves,, representing P.G. & E. addressed the Commission and wished to go on record of ..having advised the, Commission that the P.G. & E. service center locate.d adjacent to the area under con- sideration is an exksti use and regardless of the zoning impos they do have occasion to go into the service center at night under emergency conditions to procure material and illuminate the yard. Mr. Bill Brody, owner of approximately 35 acre's of land located directly across the street from 'the . area. under consider- ation for rezoning, ; stated he was in favor of the pro- posed "rezoning to R-M-150'0., Mr., Sam N1 representing Corona Feed: stated they, were not opposed to the rezoning but wanted to go on record of advising anyone concerned that the feed mill is an existing use' and they operate 24 hours a day. After due consideration of the rezoning proposal, a motion, approving the rezoning was � introduced by Com. Battaglia but 'failed for-a lack of a second to. the motion. Res. Z15-68, disapproving the rezoning, was introduced. by Comm. Styles and. seconded by Comm,. Koenitzer., The following vote was recorded: Ayes: Koenitzex, Style Noes: Battaglia, Stanley. Therefore, the rezoning was: automatically defeated due to a split vote rendered by the Planning commission. Attorney E0oua.rd_ Robert stated that David D. Young had 'the right to appeal the action of the Planning Commis,sion to the C'-.i ty Council. The Commission will consider, the above mentioned modi -fica- . tions at. a public hearing on Januar,y 7, 1969.,;, Comm. Styles also requested'Mr.'Robe`rt to prepare guidelines that. the.
