to be held _ Saturday, Map - _h 22, 1969, at: the University of
Ca'lfornia, Davis Extension, It will be a workshop involving
an analysis of downtown. prob.le;ms in a small community. The

changes -relative to mobilee homes, it is his recommendation that
the Commis.sic)n either forward no comment on these applications

Commissioner Styles, Land passed by a 4 to 1 vote. Chairman
Stanley voted "No" He. pointed out that the County allows
mcbile homes u_pon the granting of a conditional use permit
and the fact, that the City does not allow mobile homes on
single lots should have no bearing on the recommendation.

Mr.. Stanley was of t.h.e'e opinion. that a, "no comment ", state-
ment would b�e more in order.

on a pcxt.i:on of Assessor's Parcel No. 7- 401 -6,
gen.e;ral,ly located between U. S. 101, McDowell
Road and Corona Road,, In view of the fact that the
applicant has not furnished plans which in-
corpoate the necessary provisions for drainage
a.nd. fsta re street alignments, the staff recommended
tha.tt the matter be held over until March 18, 1969.
A moti.cn t continue the hearing on March 18, 1969
was introduced by Commissioner Battaglia, seconded
by Commissioner Stanley, and agreed to unanimously.
Mr, Robert Lagle, representing the applicant, was
pre &ent and agreed to the postponement.
TACO -BELL, The Commission. reviewed the site plans for the pro-
SITE DESIGN posed. Taco -Bell Restaurant to be located at 707
FILE 5,120 East. Washington. Street,, The staff report recom-
mended approval of the site design subject to
six conditions of approval. Mr. Marshall Garrett,
representing Taco -Bell, was present and voiced no
objections to the conditions imposed. A motion
approving the site plans with the conditions as
stated in the staff report was introduced by
Commissioner Koenitzer, seconded by Commissioner
Perry, and passed by all members present.

The Commission considered a variance application
filed by Thomas Gaffey to allow a reduction in
required rear yard setback from 10 feet to 0 feet
for the construction of a convenience market and
offices to be .located at 725 East Washington Street.
The initial plan submitted on January 21, 1969,
did not provide for adequate off - street parking.
On February 4, 1969 Mr. Gaffey presented a revised
site plan which indicated the building to be lo-
cated on the rear property line. The applicant was
advised to file a variance in order to build the
structure as shown.. A comprehensive staff report
was presented by Andy Anderson at this time.
Mr. Anderson stated that the Zoning Ordinance
requires 13 parking spaces for the convenience
market and 5 parking spaces for the rental unit,
which the applicant, says . will be an office, for
a total,of 18 required parking spaces. The submitted
plans show 19 parking spaces, one more than required.
However, the City Engineer has stated that the inter-
section of East Washington Street. and Payran Street
will be widened in the future to provide four moving
lanes of traffic and one left -turn lane at all
four branches of the subject intersection, and if
all the additional right -of -way necessary for
the future widening is taken from the northwest
side of East Washington Street and Payran Street
is widened evenly on each side, nine parking spaces
would be removed and the usability of the remaining
spaces would be severely impaired and unsafe..
Equal widening on, each side of East Washington
Street would reduce the usable parking by at least
6 spaces. Mr. Anderson goes on to say that the
applicant. owns the adjacent lot to the northwest
This lot, is in an R -1 -6,000 District but it, could
be used as a parking lot if a use permit is granted
for that purpose. The staff recommended approval
of the variance to allow a reduction in required rear
yard setback from 10 feet to 0 feet subject. to the
following conditions:
1. The applicant shall obtain a use permit to
construct a parking lot on the lot in his
ownership which is adjacent to the northwest
of the subject property.
2. A fire wall as required by the Uniform
Building Code shall be provided on all sides
of the'bui.lding which will be adjacent to
abutting property in the R -1 -6,000 District.
3. The proposed building shall be designed to
provide for convenient use of the adjacent
parking area by customers. Such, redesign
of the building shall provide sufficient
setback from East Washington Street and
Payran Street so as not to conflict with the
future street widening.

4. Adequate parking shall be provided for the
proposed convenience market and office.
Since the applicant has indicated an urgent need
for an early decision on the matter, the staff
further recommended that site design approval be
considered on the basis of the .intent shown on the
submitted plans subject to the following conditions:
1. Plans showing building location, parking
spaces and driveway layout and landscaping
be submitted to the Planning Commission
for final approval prior to the issuance
of a building permit.
2. A concrete wall, six feet high shall be
constructed along the rear and northwest
side property lines except that the walls
shall be three feet high in the front 20
feet facing Pay.ran Street.
3. The proposed development shall comply with
all. other requirements of the Zoning Ordin-
ance.
4. All construction shall comply with the re-
• quiremen -ts of the Uniform Building Code.
Mr. Tom Gaffey, addressing the Commission, at this
time stated that it appears that a pattern is
developing on Washington. Street whereby anyone who
is unfortunate enough to own property and wants
to develop his property will be pressured into
donating a certain amount of land to the City when
and if they decide on widening the street. Mr.
Gaffey stated that he didn't question the staff's
position because-he realized they are controlled
by a code but went. on to say that this particular
land use, that of a small convenience ma does
not.' require the high parking requirement as set .
forth. by the Petaluma Zoning Ordinance. Mr. Gaffey
then went on to quote from a survey taken in the
Bay Area and stated that some of these markets
are located in extremely restrictive areas. The
following parking is provided: In San Leandro,
6 stalls; Oakland, 5 parking stalls; and others
as follows: 8, 10, 7, 7, 5 6, 10, 13, 7, 10, 10,
etc. Mr. Gaffey stated that a flexible attitude
should be ta] "en toward the. e -parking requix° :Z-_!Frts
or t,e City will lose some pretty .nice businesses
from coming into Petaluma.
Mr. Hal Wood, Assistant City Engineer, stated
that in no case has the City Engineer or staff
recommended the donation of land on Washington
Street for street widening. They have only
quoted setbacks. When the street is widened
there will be acquisition of said Land.

Mr. Koenitzer stated i.f widening takes place, a
minimum of ' 8 parking spaces will be lost. Five are
required for the office, leaving only six for
the store. stating that this was on the low side
if takirng the averages quoted by Mr. Gaffey.
Mr. Herb West stated as follows: ".We are saying that
we -have adequate parking for the uses that we'
want for the property, we are trying to back it
up with the booklet showing a survey of what
like properties in the- B'ay Area are requiring

for parking ".
Commissioner Styles stated that the adjacent lot
has nothing do with the variance application.
The application should be considered without the
possibility of street widening because the City
is trying to develop parking spaces based on the
nonexistent plan lines for Washington Street.
The operator for the 7 -11 Market located on
Washington and Howard Streets stated that the
parking as shown on'the,proposed plan is ex-
ceptionally good for a 7 -11 Market.
After further discussion, Commissioner Styles
made a motion to approve the variance without
any conditioons. The motion was seconded by
Commissioner Koenitz:er,, and passed by all members
present. A motion approving site design review
was introduced by Commissioner Styles, seconded
by' comm ssioner Perry, and passed by all members
present subject to the "following conditions:
1. The proposed development shall comply with
all the requirements of the Zoning Ordin-
ance except for. the variance.granted to
allow a 0 foot rear yard setback.
2. Exterior walls located on property line
shall be of a minimum 2 -hour fire re-
sistive construction.
3. 3. Landscaping shall be provided as indicated
on Exhibit "A ".
GORDON SHORT Chairman Stanley opened the public hearing to
USE PERMIT consider the use permit application filed by
FILE U6 -69 Gordon Short to allow a home occupation to do
accounting, bookkeeping and income tax service
in an R- 1- 6,00 Zone located at 5 Faye Court.
The Staff recommended approval of the use permit
subject to several conditions. Mr. Short was
in the audience and voiced no opposition to the

conditions as stated by Mr. Anderson. There
were no objections voiced to the:granting of the
use permit. Resolution U6 -69, granting the use
permit with the. conditions as stated in the
Staff report, was introduced by Comm. Styles,
seconded by Comm. Perry, and passed unanimously.
FOOTHILL MANOR The Commission reviewed the revised tentative map
REVISED TENTATIVE filed by Condiotti Enterprises for a proposed
MAP subdivision to be located on Ely Boulevard South.
FILE 8 -69 Mr. McGivern, Planning Director, presented the
conditions of approval as discussed by the Sub-
division Committee. Mr. Condiotti voiced no
opposition to the conditions imposed. Res. #8 -69,
approving the tentative map of Foothill Manor
with the conditions ,as stated in the staff report
was introduced by Comm. Battaglia, seconded by
Comm. Styles, and passed unanimously.
STAFF REPORT At the recommendation of Mr. McGivern, a'study
session will be held by the Planning Commission
on Tuesday, March 11, 1969, at 7:30 p.m. to re-
view a service station ordinance for the City
of Petaluma.
ADJOURNMENT There being no further business to come before
the Commission the meeting was adjourned.
