STAFF: William C. McGivern, Director of Andy Anderson, Assistant Planning Hal Wood, Assistant City Engineer APPROVAL OF MINUTES - the minutes for the were approved as submitted. CORRESPONDENCE Sonoma County Referrals Planning Director meeting of March 18, 1969 The Commission reviewed Resolution #5489 of the Sonoma County Planning Commission relating to final classifica- tion of certain federally owned lands in the Petaluma marshes. The Commission unanimously recommended to go on record as supporting the retention of this parcel by some agency of either the federal or state government for wildlife or recreation purposes. Edward Frank Variance File #4721 The Commission reviewed the variance application filed by Edward Frank for front and rear yard reductions on Assessor's Parcel No. 19- 192 -20 located at the south end of Sunnyhill Drive, Petaluma;the.Planning Commission voiced no opposition to the requested variance. REVIEW OF CONDITIONS Building Inspector Olsen reviewed the conditions OF APPROVAL FOR USE of approval stated on the use permits granted to PERMITS ISSUED FOR the following businesses located on Lakeville BUSINESSES LOCATED Highway: Scrappy Jim, Al Stack, C & W Wreckers ON LAKEVILLE HWY and Barta Hide. Slides were shown of the .loca- tion of these businesses indicating'th at several conditions required in the use permits have not been fulfilled by the permittees. The owners of the businesses involved were present and agreed to make every effort to correct the violations. The Commission will review the use .permits again in 60 days to check for compliance with the conditions of approval stated on the use permits. ATLANTIC & PACIFIC UIDLING CORPORATION 'REZONINGS FILE Z4 -69 & Z5 -69 Chairman Stanley opened the public hearing to consider the rezoning applications filed by Atlantic & Pacific 'Building .Corpo.r to rezone approximately 4_.66 -4 acres from "A" (Agricultural) to R -M- 15.00 (Multiple.. The area under consideration is located in the general vicinity of the extension of Perry Lane at its intersection with Lakeville Highway. A comprehensive staff report on both rezoning requests was presented by Mr. McGivern. The report stated that the requests are compatible with the General Plan designations for the land use in this area. Mr. McGivern stated that the rezoning would upgrade the area and serve the people who will locate there by virtue of the planned overall development. The Planning Director further stated because of the importance of the connection of Baywood Drive with Lakeville Highway and its direct influence on this proposed commercial development and the further development in the general vicinity, it would appear that final approval of the requested rezonings by the City Council should be delayed until the final negotiations and arrangements for the location, alignment and construction of the intersection of Baywood Drive and Lakeville Highway have been completed. There were no objections voiced. After due consideration of the proposals of the applicant's development and the proposed rezonings, Res. Z4 -69 recommend - ing that the 4.664 acres be rezoned from "A (Agricultural) to R -M -1500 (Multiple Residential), was introduced by Comm. Styles, seconded by Comm.. Koenitzer, and passed unanimously by all members present. Res.25 -69 recommending that approximately 15.281 acres be rezoned from "A" (Agricultural) to C -H (Highway Commercial), was introduced by Comm. Styles, seconded by Comm. Koenitzer, and passed by all members present. MARTIN A. STINAR Chairman Stanley opened the public hearing to REZONING consider the rezoning application filed by FILE Z6 -69 Martin A. Stinar to rezone Assessor's Parcel Nos. 7- 022 -47; -29; -33; -37; -18; -19; -10, from R -M -1500 (Multi - Residential) to C -N (Neigh- borhood Commercial), and the Planning Commission further consider the expansion of the area to be rezoned to include Assessor's Parcel Nos. 7- 022 -44; -43; and -3.6. The area under consider- ation is located along the northeasterly side of East Washington Street P,ayran Street and Ellis Street. A comprehensive,staff report was presented. The report stated that East Washing- ton Street is one of the main entrances to the City and carries heavy traffic volumes. Development of uses permitted by commercial zoning would create a greater traffic hazard d`u"e to ingress and egress -3- .Planning Commission r April 8, 1969 i MARTIN A. Other points out- lined in,the staff presentation, indicated that any additional commercial activity in this area could have a detrimental influence on some of the other surrounding properties and develop - ments. Two schools, a park, other residential uses located nearby and the Freeway off -ramp could all be undesirably affected by the proposed commercial zoning.; Mr. Anderson, Assistant Planning Director, further stated that the staff has prepared a rough draft of an ordinance for a Professional - Administrative Office Zoning District which would offer a possibility for development of the subject properties to the highest and best use for the area. The size and area of the properties involved make them very difficult to develop for commercial use. The Assistant Planning Director further stated that the applicant,.Mr. Stinar, had indicated agree - ment to proposed P -A District and had indicated to the staff that he is willing to have this matter continued until a Professional- Administra- tive District can be considered but that he had not had the opportunity to contact the other applicants involved. The staff recommended that the rezoning to C -N District not be approved due to the facts presented in the report (made part .of the permanent file) and further recommended that the Planning Commission continue the hearing until such time as a Professional- Administrative Office District can be considered and applied to this area. Mr. Van Kirk, owner of the property on Payran Street adjacent to the Shell Oil Company, questioned what effect such a proposed zone would have on his lot. He was informed that his lot would retain'the C -N (Neighborhood Com- mercial) Zoning. Attorney David Traversi, repre- senting Mr. Stinar, addressed the Commission and said in his opinion., the proposed P -A Zone would be inappropriate along East Washington Street because of the amount of traffic generated on that street. He stated that professional offices prefer locations that would have easier ingress and egress. Each of the other property owners involved expressed their desire to have the C -N Zoning as requested. Mr. Paulucci, 198 Ellis Street, petitioned to have his lot included in the C -N Zone.(Mr. Paulucci was later informed that a separate application would have,to be filed for rezoning of his property.) Chairman Stanley opened the public hearing to USE PERMIT consider the use permit application filed by FILE U10 -69 & Heriris Supply, Inc. to permit an outdoor adver- VARIANCE tising structure in an M -L Zone located on the FILE V6 -69 southwest side of Wilson'Street, approximately 400 feet southeast of Dewey Street. The Commission also considered the variance application filed by the same applicant to permit said sign to be lo- cated less than 150'0 feet from another outdoor ad- vertising structure. A: favorable staff report was presented by the Assistant Planning Director listing conditions of: approval if the request were granted. Mr. Vic DeCarli was present and asked questions relative to location of the sign. There were no objections voiced. After due consideration the Public Hearing was closed and Res. U10, grant - ing the use permit With the conditions outlined in the Planner's report,. was introduced by Comm. Koenitzer, seconded by Comm.. Styles, and passed by all members present. Res. V6 -69, granting the variance with the conditions as stated in the Planner's report was introduced by Comm. Koenitzer, seconded by Comm. Styles, and passed by all members present. SONOMA VISTA Mr. McGivern informed the Commission that the SUBDIVISION review of the tentative map for Sonoma Vista TENTATIVE MAP Subdivision filed by Perma -Bilt Enterprises. FILE 9 -69 to be located in the area of Lakeville Highway, Casa Grande Road and South McDowell Blvd. would not be presented at this time. Mr. McGivern said that correspondence had been received this day (April 8, 1969) from the State Division of Highways voicing opposition to the street circu- lation, namely'S't..Francis Drive, intersecting with Lakeville Highway. Mr. Dale Hornber.ger of Perma -Bilt and Ron Simpkins, engineer, stated that they had met with some members of the City staff on Friday; April 4, 1969, and believed the map was in order'. Mr. Simpkins declared that the realignment of St. Francis Drive to connect with McDowell :Blvd. s'hould..have been - -5 - Planning Commission April 8, 1969 ,SONOMA VISTA known earlier since the original tentative SUBDIVISION map was submitted to the City on February 14, TENTATIVE MAP 1969. It was further noted that several delays FILE 9 -69 in "the processing of the tentative map were due (Continued) to redesign of street alignment and lot configura- tion and Council action needed on a proposed park site location to possibly be incorporated into the tentative map. After some further ciscussion, the Commission agreed to review the map at the next meeting held on April 15, 1969. SERVICE STATION Chairman Stanley opened the public hearing to ORDINANCE consider amending the Zoning Ordinance to pro - RES. 13 -69 vide for regulation of service stations within the City of Petaluma. Many service station operators including "Bob Acorne,were present. There were no objections to the proposed ordinance as presented by Mr. McGivern. Res. 13 -169 recommending the adoption of the service station ordinance to the City Council was intro- duced by Comm. Koenitzer, seconded by Comm. Perry, and passed by all members present. JIM ROSE The Commission considered the site design pre - SITE DESIGN sented by Mr. Jim Rose for an automobile sales REVIEW lot and office to be located at 123 Petaluma Boulevard South. Mr. Anderson presented the staff report recommending approval of the site design subject to the following conditions: 1. Public improvements, including street, curb, gutter and sidewalk shall be constructed along the D Strt frontage of the site in accord - ance with 'the-recommendation of the City Engin- eer. Design and construction of the public improvements shall be as required by the City Engineer in accordance with City standards. 2. Landscaping shall be provided as shown on Exhibit "A" 3. The small building proposed to be used for a sales office shall conform to all requirements of the Uniform Building Code and shall pre- sent a pleasing appearance to the street. 4. The subject automobile sales lot shall conform to the Zoning Ordinance in all respects. 5. All signs shall comply.'.with the Zoning Ordinance and City sign regulations. -6- Planning Commission. In order to expedite the matter, the Commission decided to act on the r- equest, thereby giving Mr. Rose the oppor- tunity to appeal the decision to the Council .if he so desired. A motion approving site design review with the conditions as outlined in the staff report,-was introduced by Comm. Koenitzer, seconded .'by Comm. Styles, and passed as follows: Ayes: Comm.
