HomeMy WebLinkAboutResolution 96-033 N.C.S. 02/05/1996RESOLUTION NO. 96-33 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING CITY MANAGER TO SIGN AGREEMENTS WITH SONOMA COUNTY AGRICULTURAL PRESERVATION AND OPEN SPACE DISTRICT RE: MATCHING GRANT PROGRAM 1 WHEREAS, the City of Petaluma applied for matching grant funds from the Sonoma County 2 Agricultural Preservation and Open Space District for acquisition of f] O acres on the McNear 3 Peninsula and t27 acres of the "Alman" Marsh; and 4 5 WHEREAS, said applications were approved subject to the City of Petaluma confirming its 6 intentions regarding investment in access and habitat enhancement equivalent to the Open Space 7 District's match; acid 8 9 WFIEREAS, in the case of the McNcar Peninsula property, the match is $184,500 as reflected 10 in the attached Exhibit A, and in the case of the Ahnan property, the match is $57,500 as retected in 11 the attached Exhibit B; 12 13 NOW, THEREFORE, BE IT RESOLVED THAT the City Manager is hereby authorized to 14 execute said Letter Agreements. This letter will serve that purpose. I).n'nI ACni. ~~:nix:u -~ ~ ~ ~,-~~~-o,~ In order to satisfy this condition and proceed with closing the property acquisition, the District proposes the following terms: 1) The City agrees to adopt the final Petaluma River Access and Enhancement Plan ("the Plan") recommendations for the subject property by 12/31/96 in substantially the draft form in which it was presented to the District; 2) Within the context of the Plan, the City agrees to commit City funds or to secure in-kind contributions for the development of acommunity-oriented river park and marsh restoration (herein "the Project") on the subject property consistent with the Plan; ~) Tb,n miry a~rege th2t tpto! gvper~riir4 fec anti/!lr L^.-kind Contrl tlUtlOns utilized for development of the Project on the Property will be equal to or greater than the District grant award of $184,500; 4) The City agrees to begin development of the Project on the Property within five years of the date that this letter is executed by the District and the City; 5) The City agrees to provide the District with an accounting of all expenditures made by the City or in-kind contributions utilized by the City to develop the Project on the Property up to the grant amount of $184,500. ~~-33 Mr. John Scharer January 11, 1996 Page Two If the foregoing terms are acceptable to the City, please sign in the space provided below and return the signed original to me, retaining a copy for your records. Almon. The Board approval was conditioned on the District executing a letter agreement with the City prior to the disbursement of funds, regarding the C:ty', wmmitment to match the $57,500 District grant. This letter will serve that purpose.
