APPROVAL OF AN AMENDMENT TO THE GENERAL PLAN LAND USE MAP
WHEREAS, the City received applications for amendments to the General Plan Land-Use
Map, as described below:
A. 1st Street/Riverfront Warehouse - te-designate properties located along 1st and
2nd Streets between "D" Street and the Foundry Wharf Business Park from
Industrial to Mixed Use as reflected on Exhibit A attached hereto; and
B. McNear Landing PUD Development Plan - re-designate a 1.3f acre portion of the
project site from Urban High to Open Space (0.651 acres) and Public Park (0.651
acres) as reflected on Exhibit AA attached hereto; and
WHEREAS, the Planning Commission held duly noticed public hearings on the 1st
Street/Riverfront Warehouse amendments on December 12, 1995, and on the McNear
Landing PUD Development Plan on November 28, 1995, and on December 5, 1995, and
considered all written and verbal communication on these matters before rendering their
recommendation for approval to the City Council; and
WHEREAS, all reports and communications to the Planning Commission were
forwarded to the City Council; and
WHEREAS, the City Council held a duly noticed public hearing on this amendment and
considered all written and verbal communication before rendering its decision; and
WHEREAS, the potential environmental impacts of these projects have been considered,
and proper action has been taken by the City Council in compliance with the California
Environmental Quality Act and local environmental guidelines;
NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby
approves the amendment subject to the following findings:

1. Because the proposed amendment will provide needed public access to and a
public park and open space along the river, the proposed amendment is deemed to
be in the public interest.
2. The proposed amendment is consistent and compatible with the General Plan and
any implementation programs which may be affected.
3. The number and type of homes to be constructed on this site is consistent with the
General Plan goals which encourage a mix of housing types as the project will
provide a substantial number of small single family lots which may provide more
affordable housing opportunities.

1 4. The General Plan policy of requiring development to be oriented toward the river
2 is achieved through the use of single loaded streets and a substantial number of
3 adjacent homes providing floor plans that are orient toward the river.

5 5. The potential impacts of the proposed amendment have been assessed and
6 mitigations proposed and thus the project as mitigated will not be detrimental to
7 the public health, safety or welfare.

9 6. The proposed amendment has been processed in accordance with applicable
to provisions of the California Environmental Quality Act (CEQA), and of the
11 California Government Code.

1.
Because the proposed amendment will facilitate more compatible uses and/or
16 development of affected properties, the proposed amendment is deemed to be in
17 the public interest.

The proposed General Plan amendment is consistent and compatible with the
20 General Plan and any implementation programs that may be affected including
21 applicable land use programs for river oriented uses and/or development.

The potential impacts of the proposed land use amendment have been assessed and
24 have been determined not to be detrimental to the public health, safety, or welfare.

The proposed amendment has been processed in accordance with the applicable
27 provisions of the California Environmental Quality Act (CEQA).

5.
This amendment to the land use designation of 25 properties shall in no way
3o diminish.the entitlements or status of existing uses nor shall it limit the potential for
31 existing uses to improve or expand. Further, this amendment shall in no way
32 preclude or adversely influence the consideration given to similar and/or other
33 appropriate Industrial uses which may propose to locate in the subject area.
