t RESOLUTION OPPOSING AB 638 (KNIGHT)
2 CONCEALED WEAPONS BILL

5 WHEREAS, the percentage of homicides committed with guns increased nationwide
6 from 1985 to 1992, while other homicides decreased; and
7
8 WHEREAS, more Californians die from gun-shot wounds than in car crashes, and in
9 1995, Californians purchased an average of nearly 700 handguns daily; and
10
11 WHEREAS, on January 31st, the State Assembly passed AB 638, which would
t2 dramatically weaken California's carrying concealed weapons (CCW) law by virtually
13 eliminating the discretion of local law enforcement officials to deny CCW permits; and

15 WHEREAS, AB 638 would require law enforcement officials to grant concealed
t6 weapons permits to any adult Californian who has not been convicted of a serious crime, is not
t9 a member of a street gang, is not a domestic violence offender and has passed a test. Persons
is with long criminal records, buY no serious criminal convictions, would still be eligible for
t9 CCW permits. Persons with serious substance abuse problems, including persons convicted of
20 driving under the influence of alcohol or other drugs, would be eligible for concealed weapons
21 permits; and

23 WHEREAS, AB 638 repeals the provision in current law which grants local
24 jurisdictions the authority to place "reasonable restrictions or conditions" on carrying permits;
25 and
26
27 WHEREAS, AB 638 places unreasonable service and administrative demands on law
28 enforcement agencies with no definitive reimbursement program; and

3o WHEREAS, AB 638 does not specify standardized training and certification criteria
31 for applicants; and

33 WHEREAS, AB 638 is opposed. by the California Police Chief's Association, the
34 California Sheriff's Association, Attorney. General Dan. Luhgtt;n, the California District
•35 Attorney's Association, and the California Peace Officer's Association; and

37 WHEREAS, AB 638 must now be approved by the California Senate Committee on
38 Criminal Procedure and the fulf:State Senate before it can become law.

40 NOW, THEREFORE; BE IT~RESOLVED, the Petaluma-City Council strongly urges
41 the California State Senate, 'arid 'in particular the Senate Criminal Procedure Committee, to
42 defeat AB 638 and ensure that the controls local governments have in granting concealed
43 weapon permits are not weakened,
