4 RESOLUTION ESTABLISHING
5 CHARGES AND FINES FOR THE OPERATION
6 AND MAINTENANCE OF THE
7 WASTEWATER DISPOSAL SYSTEM

11 WHEREAS, the City of Petaluma operates a wastewater treatment and disposal
12 system, and
13
14 WHEREAS, the City has established a revenue program which equitably distributes
15 the costs of the system to the users., and
16
17 WHEREAS, the City Council adopted Resolution 87-114 N.C.S., 91-104 N.C.S., 92-
18 236 N.C.S., and 93-259 N.C.S. which established various charges and fees in accordance with
19 the revenue program and certain charges need to be amended;.

21 WHEREAS, heretofore the City did not have an adopted fine schedule;
22
23 NOW, THEREFORE BE IT RESOLVED that in accordance with Chapters 15.44
24 through 15..76 of the Petaluma Municipal Code, the following charges, fees and the fine
25 schedule. is adopted and Resolutions 91-106 N.C.S., 92236 N.C.S., and 93-259 N.C.S. are
26 repealed;

28 Section 1- Sewer Charees

30 A) Residential Rate of $15.00 per month for each resident unit
31
32 B) Non-Residential Rate (Minor User) of:

34 i) the greater of $15.00 per month for each account or
35
36 ii) $1.58 for each 100 cubic feet (CCF), of water use or discharge as determined
37 by the Director of Engineering, multiplied by the following strength factors by
38 user classification for Minor Users, as defined in Section 15..64.020.

10 C) Permitted Industrial User (Major User), shall pay a rate of:

12 i) the greater of $15:00 per month for each account or
13
14 ii) $1.58 for each 100 cubic feet (CCF) of water use or discharge as determined by
15 the Director of Engineering.

17 D) Permitted Industrial User Surcharge for exceeding 250 mg/I of BOD or TSS or 50 mg/1
18 oil and grease or copper exceeding the domestic levels of copper as determined by the
19 Director of Engineering shall be applied as provided in Chapter 15.64 of the Petaluma
20 Municipal Code and shall be calculated based on the following surcharge rate and
21 formula:

18 fee of $400.

20 J) Special discharges, (one time discharger) $50 permit fee plus $0.03 per gallon
21 dischazged.

23 Section 2 -Administrative Fines

25 A) Any user discharging wastewater in excess of the limitations in Section 15.48.030 of
26 the Petaluma Municipal Code shall be subject to the following fine schedule. The
27 minimum fine for exceeding a permit limitation will be $250. If more than one
28 violation of the same daily limit occurs within one calendar month, the largest
29 exceedence will be used to determine the fine.

18 Section 3 -Outside Sewer Charees

20 A) Residential users outside of the City limits shall be charged $.80 per month for each
21 residential unit addition to the charge in Section lA.

23 B) Non-Residential Minor users outside of the City limits shall be charged $.80 per month
24 for each account in addition to the chazge in Section 1B.

26 C) Permitted industrial users shall be chazged the $.80 per month in addition to the charge
27 in Section 1C.

29 Section 4 -Definitions

31 Definitions of language used in this resolution shall be as set out in Chapters 15.44 through
32 15.76 of the Petaluma Municipal Code.
