RESOLUTION OPPOSING TRUST STATUS AND
THE DEVELOPMENT OF 321 ACRES NEAR SAN PA13L0 BAY
1 WHEREAS, San Pablo Pacific, [ne. (SPP), a Nevada Corporation and self described real estate
2 investment company, has been formed for the purpose of developing and managing real estate on Native
3 American land; and
4
5 WHEREAS, SPP has released a proposal to develop approximately 321 acres located near the
6 intersection of Lakeville Highway and Highway 37; and
7
8 WHEREAS, SPP in their internal documents desires that this parcel of land be placed in trust for
9 the Hopland Band of Indians (HBI); and
10
I 1 WHEREAS, an existing Hopland Band of Indians reservation is located some 70 miles north of
12 this SPP property; and
13
14 WHEREAS, SPP documents state "the tribe could develop the property in any way they so
I S desire, without the consent or approval of the Sonoma County Planning or Building Departments: and
16
17 WHEREAS, State government has no limited regulatory mechanism for governing gambling
18 operations which could be proposed; and
19
20 WHEREAS, local law enforcement would have no authority to provide protection for citizens on
21 the reservation and are not adequately staffed to cope with the public safety impacts outside the
22 reservation; and
23
24 WHEREAS, the SPP proposal would impose a gated community of 66 housing traits and 20
25 acres of commercial enterprise on the land; and
26
27 WHEREAS, the San Pablo Bay property presently is completely rural and it's use is agricultural;
28 and
29
30 WHEREAS, influx of thousands of people into this sensitive rural area will cause unacceptable
31 levels of noise, air pollution, traffic congestion and housing problems; and
32
33 WHEREAS, the General Plan land use designation and zoning both designate the property for
34 agricultural use; and
35
36 WHEREAS, the General Plan has designated the maximum density to be one unit per 100 acres;
37 and
38
39 WHEREAS, infrastructure to serve the proposed development is not available, with limited water
40 and sewer capacity and limited access from Lakeville Highway; and

1 WHEREAS, the independent sovereignty of the Hopland Band ofIndians reservation on this site
2 would preempt local land use controls and the safeguards of the California Environmental Quality Act
3 which assures that land uses contrary to the community health, safety and general welfare are avoided
4 and environmental impacts mitigated;

6 NOW,, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma requests
7 that the Bureau of Indian Affairs denies reservation or trust status to the Hopland Band ofIndians on the
8 San Pablo Bay property unless the site is developed in compliance with the Sonoma County General
9 Plan requirements; and

] ] BE IT FURTHER RESOLVED that the City Council of the City of Petaluma has sincere interest
12 in working with Native Americans to address legitimate concerns providing Cheir goals do not jeopardize
13 the public health, safety and general welfare of the citizens of Sonoma County.
