a APPEAL BY THIRTEEN RESIDENTS ON PAYRAN STREET AND APPROVES A
s CONDITIONAL USE PERMIT POR REPLACEMENT OF THE PAYRAN STREET
6 BRIDGE WFffIIN THE F-W. PLOODWAY DISTRICT

8 WHERF.,AS, the City of Petaluma proposes replacement of the Payran Street Bridge
9 within the F-W, Floodway District which requires approval of a Conditional Use Permit;

Iz WHEREAS, the Planning Commission. of the City of Petaluma held a noticed public
13 hearing on April 9, 1996 on the subject application, heard testimony from four
14 individuals and concluded that the findings and conditions for the project were adequate
I5 and approved the Conditional Use Permit; and
16
17 WHEREAS, Thirteen residents of Payran Street appealed the action taken by the
I8 Planning Commission on April 9, 1996 to the City Council on May 6, 1996; and
19
20 WHEREAS, the City Council held a public hearing on the appeal on May 6, 1996.

22 NOW 'THEREFORE, BE IT RESOLVED that the City Council denies the appeal and
23 sustains the Planning Commission's April 9, 1996 approval of a Conditional Use Permit
24 to replace the Payran Street Bridge within the F-W, Floodway District based on the
25 following findings and subject to the following condition:

27 Environmental Findines:

29 A Final Environmental Impact Report {FE[R) was prepared and certified by the City
9o Council on September 5, 1995 for the Petalwna River Flood Control Project. The FEIR
31 identified specitc impacts and required mitigation measures to be addressed through
32 subsequent project specific review. Pursuant to Section 15162 of the CEQA Guidelines,
33 the City Council finds that the previously certified EIR remains adequate in addressing, all
34 impacts associated with the proposed bridge replacement, and further, based on the
35 analysis contained in the FEIR, including the mitigation measures specific to the
36 replacement oP the Payran Street Bridge, the City Council finds:

38 1. The proposed bridge replacement is substantially similar to the previously considered
39 bridge design and location and therefore does not require any new environmental
40 analysis;

42 2. The Mitigation Measures certified by the Cily Council will reduce impacts created by
43 the bridge replacement to a level of less than. significant and no significant changes to
44 the enviromnental setting have occurred.
45 3. No new information has been discovered that indicates that the impacts, previously
46 identified in the FEIK, have increased in severity.

I Conditional Use Permit Findines:
3 L The proposed Payran Street Bridge replacement will conform to the requirements and
4 intent of the Petaluma Zoning Ordinance in that: 1) the bridge replacement satisfies
5 the Zero Net Fill requirement of Section 16-703.2 because fill will be removed from
6 the Floodway; 2) the height of the biidgewill be increased to approximately 2.5 feet
7 above the 100 year flood elevation; and the design of the bridge will allow for the
8 future channel widening Flood Control Project.

10 2. The proposed Payran Street Bridge replacement will couforln to the requirements and
I I intent, goals, and policies of the Petaluma General Plan in that the removal of fill and
12 the installation of a bridge which is well above the 100 year flood event elevation
13 satisfies the General Plan requirements of improving the Floodway and land adjacent
14 to the Floodway in an effort to reduce the potential risk of flood damage. The City
15 Council also finds that the bridge replacement meets the requirements of the
I6 Circulation Element of the Genera] Plan by restoring Payran Street to its Arterial
17 classification which provides for a more efficient neighborhood and area-wide
I8 circulation system. Once in place, the bridge will reestablish the circulation system
19 originally designed for this area and will carry the fraffic volumes anticipated for
20 Payran Street and the surrounding neighborhood.

23 3. The proposed Payran Street Bridge replacement will not constitute a mlisance or be
23 detrimental to the public welfare of the community because the installed bridge and
24 minor bank and abutment work will improve the existing .flood constraints at this
25 location along the Petaluma River. The .higher bridge will allow for greater flow
26 capacity of floodwater or debris contained in the floodwaters and will permit the later
27 channel widening phase of the Flood Control Project.

29 4. The height and location of the bridge allows for future floodway improvements to be
3o installed consistent with the Floodway Project and does not preclude any planned
31 improvements anticipated in the River Access and Enhancement Plan.

33 Use Permit Conditions:

35 l . All applicable mitigation and monitoring measures contained as a part of the FGIR for
36 the Flood Control Project certified by the City Council on September 5, 1995 shall be
37 implemented.

39 2. Prior to opening the Payran Street Bridge for traffic, afour-way stop sign controlled
40 intersection shall be established for the Jess(RoccalPayran Street intersection.
