3 APPROVAL OF A TENTATIVE SUBDIVISION MAP FOR THE WOODSIDE
a VILLAGE RESIDENTIAL PROJECT LOCATED BETWEEN CAPRI AVENUE
5 AND CAPRI CREEK AND SOUTH OF MARIA DRiVF,; AP No. 137-061-027

8 WHEREAS, Mardel LLC filed an application for a Tentative Subdivision Map on
9 February 20, 1996, for a subdivision known as the Woodside Village Subdivision; and
to
t i WHEREAS, the City Council has found that the requirements of the California
t2 Environmental Quality Act have been satisfied through the preparation of an Initial Study
t3 which indicates that the proposed project, as mitigated through the adoption of a
i4 Mitigated Negative Declaration pursuant to Resolution No. 96-166 N.C.S., will not
I5 result in significant environmental impacts, and that no further environmental review is
t6 necessary; and

]8 WHEREAS, the Planning Commission held duly noticed public hearings to
19 consider the project on March 26, 1996, and May 14, 1996, at which time the Planning
20 Commission recommended that the City Council conditionally approved the Tentative
21 Subdivision Map; and
22
23 WHEREAS, the City Council has adopted Ordinance No. 201 fi N.C.S.
24 rezoning the Woodside Village Subdivision site to Planned Unit District, and approved
25 Resolution No. 96-170 N.C.S. approving the Woodside Village Planned Unit
26 Development Plan.

2s NOW, THEREFORE, BE IT RESi)LVED, that this Council hereby finds as
29 follows:

t Tentative Map Finding;
2 The proposed subdivision, as conditionally approved, together with provisions for
3 its design and improvement, is consistent with the General Plan as a well-
4 designed development that is harmonious with its setting within the east side of
5 Petaluma and provides adequate pedestrian and vehicle access and services to the
6 proposed lots.

8 2. The site is physically suitable for the type of Urban Diversified (8.8 du/ac) density
9 single-family residential development as conditionally proposed with building
io setbacks and specific unit plan layout.

t2 3. The Tentative Subdivision Map provides reasonable public access from Capri
13 Avenue and Woodside Circle to the proposed lots.

15 4. The proposed map, subject to the following conditions, complies with the
I6 requirements of the Municipal Code, Chapter 20.20 and the Subdivision Map Act.

18 5. The proposed map has complied with the requirements of CEQA, through the
i9 preparation and certification of a Mitigated Negative Declaration prepared and
20 adopted (Resolution No. gg-lgg N.C.S.) by the City Council for this project
2t which addresses the potential environmental impacts associated with its
22 development, and no further environmental analysis is necessary.

24 6. The design of the subdivision and the type of improvements will not cause public
25 health problems as the improvements including sanitary sewer, storm drains acid
26 water systems, designed to the satisfaction of the City Engineer.

28 7. Omission of a public sidewalk on the easterly side of Woodside Circle will not
29 jeopardize public safety.

I Conditions for the Tentative Maw
2 1. All requirements from the City Engineering Departmeut shall be complied with,
3 including:

5 a. Parking shall not be permitted on the southeasterly side of Woodside
6 Circle. No parking shall be permitted along Capri Avenue. "No Parking"
7 signs and/or markings shall be installed on Capri Avenue at the
8 developer's expense, subject to the City Eugineei s review and approval
9 prior Final Map recordation.

i t b. The Capri Avenue half street improvements shall conform to the structural
12 section at the centerline of the right of way in order to eliminate the
13 existing longitudinal pavement cracks. Capri Avenue shat] be improved to
14 a 28-foot curb-to-curb reduced minor residential street. Street
t s improvements with this project shall be provided to include a width of 28-
16 feet from face of curb to face of curb. Vehicular parking shall be
t7 prohibited on bath sides with this street width.

t9 c. City standard traffic control signing and pavement markings shall be
20 installed. Capri Avenue shall be provided with centerline markings which
21 shall continue with an arc around to Woodsorrel Drive. Stop sign, bar and
22 legend shall be installed on Woodside Circle at both locations intersecting
23 Capri Avenue. The curb neck down, as shown on the tentative map where
24 Woodsorrel Drive changes to Woodside Circle, shall not be installed.

26 d. No lot to lot drainage shall be allowed. Surface runoff shall be addressed
27 within each individual lot then conveyed to an approved storm drain
28 system.

i e. "The proposed declaration of covenants, conditions, at~d restrictions of
2 Woodside Village shall be submitted for City review and approval. The
3 document shall address all publicly and privately maintained facilities,
a structures, easements, improvements, utilities; etc. within the
5 development.

7 £ Pursuant to Municipal Code Section 20.36.140, all utility distribution
8 facilities shall be placed underground.

to g. Improvement Plans shall be prepared per City Department of Engineering
tt minimum design criteria, improvement plan preparation vid standard
12 details and specifications.

14 h. The developer shall comply with all requirements of the Petaluma
I5 Municipal Code including but not limited to Chapter 20,
I6 .SUBDIVISIONS.

18 i. A three percent (3%) plan check/inspection fee shall be based upon the
19 estimated construction costs for the subdivision. The estimated cost shall
20 be based upon the "Improvements" as defined in the Municipal Code.

22 j. 'fhe Sonoma County Water Agency shall review and approve the
23 improvement plans for this subdivision.

25 2. All requirements from the City I^ire Marshal's office shall be complied with,
z6 including:

28 a. Post address at or near main entry door -minimum four (4) inch letters on
29 contrasting background.

i b. Address locator required to be posted at or near the driveway entrance.
2 Reflectorized numbers are acceptable. Location and design to be approved
3 by the Pire Marshall's office.

5 c. In residential buildings less than 3,500 sq.ft. in floor area, provide lire
6 suppression system at normal sources of ignition. These areas are
7 specifically at clothes dryers, kitchen stoves, furnaces, water heaters,
8 fireplaces and in attic areas at vents anti chimneys for these appliances and
9 equipment. In addition, spare sprinklers (one of each type in the
to residence) and wrench shall he provided in a red spare sprinkler head box
u in the garage.

13 d. Pire hydrants shall be spaced at a maximum of 300' apart. Location and
14 type of fire hydrants are to be approved by the Fire Marshall's Office.

f6 e. All roofing material shall be rated Class "B" or better, treated in
17 accordance with the Uniform Building Code Standard 32.7 and City of
IS Petaluma Ordinance 1744.

20 3. All requirements of PG&E shall be complied with, including:

22 a. Gas and electric service to this development will be provided in
23 accordance with the applicable extension rules, copies of which are
24 available from this office upon request.
25
26 b. The cost of any relocation of existing PG&E facilities necessitated by this
27 project will be the responsibility of the requester.

29 4. All requirements of Sonoma County Water Agency shall be complied with,
3o including:

2 a. Grading and drainage requirements shall be designed in conformance with
3 the Agency's Flood Control Design Criteria.

5 5. All requirements from the City Planning Department shall be complied with,
6 including:

8 a. A11 mitigation and monitoring measures of the Mitigated Negative.
9 Declaration (Resolution No. 96-166 N.C.S.) adopted for this project shall
to be enforced, as applicable, with all components of the Final Map and
I I associated public/private improvement plans..

I3 b. All conditions of the PUD Development Plan (Resolution
I4 No.96-17tN.C.S.) adopted for this Tentative Subdivision Map shall be
15 enforced, as applicable, with all components of the Final Map and
I6 associated public/private improvement plans.

18 c. The Tentative Subdivision Map shall be reviewed and approved by
19 SPARC, and amended accordingly, subject to staff review and approval
20 prior to Final Map approval.

32 d. A full scale reproducible copy of the 'T'entative Subdivision Map as
23 approved by SPARC shall be submitted to the Planning Department,
24 subject to staff review and approval prior to Final Map approval.

26 e. Development of all public and private improvements of the Final Map
27 must comply with all applicable mitigation and monitoring measures of
28 the Mitigated Negative Declaration (Resolution No.96-16 ,C.C.S.), and all
29 applicable conditions of the PUD Development Plan and Tentative
3o Subdivision Map.

r f. The applicants/developers shall defend, indemnify, and hold harmless the
2 City or any of its boards, commission, agents, officers, and employees
3 from any claim, action or proceeding against the City, its boards,
4 commission, agents, officers, or employees to attack, set aside; void, or
5 annul, the approval of the project when such claim or action is brought
6 within the time period provided for in applicable State and/or local
~ statutes. The City shall promptly notify the applicants/developers of any
8 such claim, action, or proceeding. The City shall coordinate in the
9 defense. Nothing contained in this condition shall prohibit the City from
IO participating in a defense of any claim, action, or proceeding if the City
I I bears its own attorney's fees and costs, and the City defends the action in
12 good faith.

14 g. Signs shall be installed to prohibit parking within the right-of-way of
15 Capri Avenue prior to the issuance of the first Certificate of Occupancy for
i6 anew home in this subdivision.

18 h. The applicant shall record a notice on the deed of each new lot which
19 fronts on Capri Avenue in a form acceptable to [he City Attorney, advising
20 prospective buyers that parking is prohibited on Capri Avenue. The notice
21 shall be recorded in conjunction with the Final Map.

23 6. All requirements from the Public Works Department shall be complied with,
24 including:
25
26 a. Locate the water meters on Capri Avenue. or Woodside Circle, not up the
27 private drives.

29 b. Provide one water meter for each unit.

4 7. All street names shall be subject to review and approval of the StreeC Naming
s Committee prior to Final Map approval.

7 8. This project shall be subject to the City's Special Development Fees, including:
8 Sewer and Water Connection, Commwtity Facilities Impact, Storm Drainage
9 Impact, Traffic Mitigation, In-Lieu Contribution Ior provision of affordable
to housing, Park and Recreation Land Improvements, and School Facilities (paid
