Resolution Approving Maximum Rates Rate Schedule Summary Statement: Based on the contract entered into with Green Waste Recovery for the collection and disposal -of solid waste, recyclables and. green waste, including, street sweeping services, the attached maximum rates are approved to be effective January 1, 2006: The rates reflect. increased fuel costs, increased disposal costs, and an increased level of service, including single stream residential recycling and weekly yard waste collection. File Code: s' CTI'Y OF PETALUMA, .CALIFORNIA December 19, 2005 I 4 AGENDA REPORT FOR Resolution Approving Maximum Rates and Charges For The Collection And Removal Of Garbage And Rubbish From- -Business Establishments And Places of Residence Pursuant To Petaluma Municipal Code 'Sections 8.1:6.210 And 8.16.220 1. EXECUTIVE SUMMARY: The City Council approves rate adjustments for the collection of refuse, recyclables, and green waste within the City Limits per existing City ordinances. The maximum rates the franchisee, Green Waste Recovery, may charge are outlined in the attached "resolution and rate sheet. 2. BACKGROUND: As a result of new service requirements contained in the new franchise agreement, and increases in fuel cost and increased disposal cost; and through negotiations with, the service provider, Green Waste Recovery, the attached maximum rates and charges are approved for 2006, effective January 1, 2006. Rates are reviewed .and may be adjusted annually per the franchise agreement. These rates will serve as the basis for rates and charges for the remainder of the life of the contract. 3. ALTERNATIVES: ® None. The proposed rates have been reviewed by City staff and consultant, "and have been agreed to by the service provider. 4. FINANCIAL IMPACTS: Revenue from the rates and charges serve as compensation to the service provider. Additionally, the City receives.a franchise fee as part of the contract. 5. CONCLUSION: The new rates and charges are appropriate for the services provided. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT..WILL IDENTIFY SUCCESS OR COMPLETION: The new service provider; Green Waste Recovery, will initiate new service effective January 1, 2006. 7. RECOMMENDATION: • Approve the rates and charges as outlined in the attached resolution and rate sheet. W RESOLUTION APPROVINGMAXIMUM RATES AND CHARGES FOR THE COLLECTIQN AND -REMOVAL, OF,GARBAGE AND. RUBBISH FROM BUSINESS ESTABLISHMENTS AND PLACES OF'RESIDENCE PURSUANT TO PETALUMA MUNICIPAL CODE SECTIONS 8.16.210. AND 8.16.220 WHEREAS, Sections 8.16.210 and 8.16.220 of the, Petaluma Municipal .Code provide that the City Council -shall from time to time and byresolution set,the maximum charges and rates for the collection and removal of garbage and rubbish from business establishments and places of residence; .and WHEREAS, when the City sets the rates of a private contractor, those rates must be sufficient to allow the contractor a reasonable rate of return; and WHEREAS, on September 13, 2005, the City and GreenWaste Recovery, Inc., entered into that certain "Franchise Agreement Between the City of Petaluma and GreenWaste Recovery, Inc., for Solid Waste, Recyclable Materials, and Yard Trimmings Services" ("the Agreement"); and WHEREAS, the Agreement'grants GreenWaste, Recovery, Inc. ("GreenWaste"), commencing on January 1, 2006, an exclusive franchise to collect, transport and process solid waste, recyclablel matters; yard trimmings, and residential food scraps generated in the City ("the Services"), subject to limitations set forth in the Agreement; and WHEREAS, in the Agreement, GreenWaste provided the City with information concerning GreenWaste's costs of providing the Services pursuant to the Agreement in 2006 and 2007, and GreenWaste agreed that for 2006 and 2007 those costs shall be fixed and shall not be adjusted to reflect increases in costs above those anticipated; and WHEREAS, based on the costs for the year 2006 set forth in the Agreement, the City has developed the maximum charges and rates attached hereto as Exhibit A to become effective on ® January 1, 2006; and 3 WHEREAS, the City Council finds "that the maximum charges and rates set forth in Exhibit A are reasonable and would provide a fair and reasonable. return to GreenWaste.
