HomeMy WebLinkAboutResolution 96-164 06/17/1996 4 _ Resolution No. ss-ls4 NC.S. of the City of Petaluma, California 1 2 APPROVING THE WASTEWATER FACILITIES PROJECT AND 3 LONG RANGE MANAGEMENT PROGRAM, AS RECOMMENDED IN THE FINAL 4 PROJECT REPORT, AS AtYfENDED MAY 1996 s ADOPTING MITIGATION MEASURES AND MONITORING PROGRAM, AND 6 SETTING FORTH SPECIFIC FINDINGS 7 AND STATEMENT OF OVERRIDING CONSIDERATIONS s 9 to WHEREAS, the need for new and expanded wastewater management facilities was tl identified in a facility review report prepared by the City's treatment plant operator in 12 November 1989. 13 14 WHEREAS, the San Francisco Bay Regional Water Quality Control Board adopted Order 15 No. 90-153 in December 1990 which required the City to begin planning for expansion of 16 the treatment system to meet the community's projected population growth. 17 18 WHEREAS, the City embarked on a planning program as described in Resolution 96-163 19 to complete planning studies and an environmental impact report for expansion of the 20 wastewater management system including an extensive public participation program 21 22 WHEREAS, a Draft EIR was prepared,' dated December 1994, and submitted to the 23 Planning Commission which, after conducting public hearings, directed that additional 24 information and new alternatives be evaluated prior to forwarding to the City Council. 25 26 WHEREAS, a "Draft Project Report" was prepared, dated June 1995, which contains a. 27 description of existing facilities, Facility needs, design options and siting alternatives, z8 operations and management, and estimated costs for expansion and improvement of the 29 City's wastewater management system. 30 31 WHEREAS, a `Revised Draft Eaviron~~x>~ital Impact Report" (EIR) was prepared 32 pursuant to local and state CEQA Guidelines. The EIR evaluated the design options and 33 siting alternatives for improvement and expansion of the wastewater management system 34 as defined in the Project Report and identified potential impacts, mitigation measures, 35 monitoring program and the design options and siting alternatives that would reduce 36 adverse impacts to the environment. 37 38 WHEREAS, following publication and distribution of the Revised Draft EIR, staff made 39 project recommendations for siting and development of new treatment, storage and 40 distribution facilities and the long range wastewater management program .based upon the 41 information presented in the Revised Draft EIR. 42 43 WHEREAS, the project recommendations were presented and unanimously adopted by 44 Citizen's Wastewater Advisory Committee and forwarded for fuirther consideration by the 45 Planning Commission during the review of the Revised Draft EIR. 46 ses no....96-164,.,.,.. e.as. Page 1 of 6 pages Wastewater Facilities Project and Long Rdnge Manngemen( Program Resolution 9G-164 Approval of the Frnal Project Report, ns aurended June !7[h, I996 1 WHEREAS, Planning Commission held public hearings on the Revised Draft EIR, the 2 Draft Project Report and the recommendations submitted by the Citizen's Wastewater 3 Advisory Committee and unanimously approved the project recommendations for 4 incorporation into the. Final Project Report and directed the preparation of a Final EIR 5 with response to comments for consideration by the City Council. 6 7 WHEREAS, a "Final Project Repor•l" and "Final EIR" dated December 1995 were 8 prepared and made available for public review and distributed to the State Clearinghouse, 9 responsible agencies and the decision-making bodies. A notice of availability and public to hearing date was published in the local paper and sent to interested parties and property 11 owners potentially affected. 12 13 WHEREAS, public hearings were held before the City Council on February 12th and 14 March 25th, 1996 during which time all interested parties were given an opportunity to 15 speak on any aspect of the project or environmental documents. The City Council closed 16 the public hearings on March 25th, 1996 and continued the Council's discussion to April 17 22nd, 1996. 18 l9 WHEREAS, the City Council authorized city staff to arrange additional follow-up 20 meetings with those who spoke at the public hearings in order to assist staff in developing 21 proactive responses to the comments received. 22 23 WHEREAS, the follow-up meetings were held on April 17th, 1996 and May 8th, 1996 24 and. the outcome of those meetings were presented to the City Council and used in 25 developing responses by staff. 26 27 WHEREAS, a report entitled 'Responses to Comments ora the Final ELR, Final Project 28 Report and the Regttest for Proposal/Draft Conh•act Docawaents" (Response Document) 29 was prepared and distributed to the City Council and to those who submitted comments 30 on May 6th, 1996. 31 32 WHEREAS, the staff report and Response Document identified specific changes to the 33 EIR, Final Project Report/Project Recommendations and the Request for Proposal/Draft 34 Contract Documents to address the concerns raised. 35 36 WHEREAS, the City Council considered the Response Document and staff 37 recommendations on May 13th, 1996 and provided an opportunity for additional public 38 comments and directed staff to prepare legislation for consideration on June 17th, 1996. 39 4o WHEREAS, the City Council certified the Final EIR by Resolution #96-163 on June 17th, 4l 1996 in accordance with Section 15090 of CEQA Guidelines. 42 June 17, 1966 Reso. 96-164 NCS Page 2 of 6 pages Wastetivater Facilities Project and Lang RnngeMni~agement Program Resolufion 96-764 Approval ojthe FrnnJ Project Report, ar mnended June 771h, 1996 1 NOW THEREFORE BE IT RESOLVED by the CityCouncil of the City of Petaluma that 2 in accordance with Section 21081 of the California Environmental Quality Act (CEQA); 3 and Sections 1509.1 and 15093 of the CEQA Guidelines and based upon substantial 4 evidence presented in the record, the following written findings, rationale, mitigation 5 measures, monitoring program and statement of overriding considerations as set forth in 6 that document entitled, "City of Petaluma Wastewater Facility Project and Long Range 7 Management Program, dated June 17, 1996" (Long Range Management Program) are s hereby adopted by the Petaluma City Council and incorporated in this resolution as if set 9 forth in its entirety. 10 ]1 BE IT FURTHER RESOLVED by the City Council of the City of Petaluma that all 12 mitigation measures and monitoring requirements identified in the Long Range 13 Management Program are hereby adopted and incorporated as conditions of approval of 14 the City's Wastewater Facilities Project and Long Range Management Program. 15 Although these mitigation measures will substantially lessen the unavoidable impacts l6 identified above, the measures may not fully mitigate all of the impacts below a level of 17 significance as set forth in that document. 18 19 BE IT FURTHER RESOLVED that in accordance with Section 15093 of the CEQA zo Guidelines, the City Council has considered the benetits of the proposed Wastewater 21 Facilities Project and Long Range Management Program and the unavoidable 22 environmental risks and finds that the unavoidable adverse impacts are acceptable based 23 on the findings and overriding considerations in Long Range Management Program and z4 .incorporated by reference herein. 25 26 BE IT FURTHER RESOLVED that, the City Council has considered a reasonable range 27 of alternatives to the project design,]ocation, and capacity and has determined that the 28 recommended alternatives in the Final Project Report substantially reduce or avoid 29 significant impacts to the maximum feasible extent and are environmentally superior to 30 other reasonable alternatives evaluated. 31 32 BE IT FURTHER RESOLVED by the City Council of the City of Petaluma that the 33 Wastewater Facilities Project and Long Range Management Program as defined in Final 3a Project Report and amended by the staff report and responses dated May 13th 1996, is 35 hereby approved as the basis for expansion, improvement and operation of the City's 36 Wastewater Management System.includingthe following: 37 38 L APPROVAL OF TILE OXIDATION POND SITE FOR DEVELOPMENT AND 39 OPEItATIONOFNEWWASIEWATF_IZ7REATMENTFACIIIIIESINCLUDING: June 17, 1966 Reso. 96-16d NCS Page 3 of 6 pages Wastewater Facili(ies Project and Lang Rm~rge Managemeirt Program Resolution 96-164 Approval of the Final Projecf Report, as mnended June 17th, 1996 1 2 (I) Construction and operation of new wastewater treatment facilities and/or 3 modifications to the existing oxidation ponds, incorporating advanced 4 treatment processes to meet Title 33 .Standards for unr•esh•icted irrigation. and 5 shallow water dischauge requbrtnents, as recommended to the Final Project 6 Report, and identified herein; THE APPROVAL DOES NOT 21 INCLUDE SPECIFIC SITES FOR IRRIGATION EXPANSION OR ANY USER 22 AGREEMENTS. SPECIFIC SITES AND USER AGREEMENTS FOR EXPANDED 23 IRRIGATION AND ANY INCREASE IN TFIE DISCHARGE; INFILTRATION AND 24 INFLOW CONTROL, OR ONSITE BIOSOLIDS REUSE FACILITIES WILL BE 25 SUBJECT TO FURTHER ENVIRONMENTAL REVIEW. 26 27 28 BE IT FURTHER RESOLVED THAT the City Council hereby authorizes the City 29 Mananer to negotiate professional service contracts to proceed with the land 3o acquisition process, geotechnical studies for the reservoir, permitting for marsh 31 enhancement. and additional environmental studies of irrigation sites and possible 32 increase in the discharge. 33 34 Attachment: Wastewater Facility Project and Long Range .Management Program 35 which includes Findings, Mitigation Measures, Monitoring Program 36 and Statement of Overriding Considerations 37 Under the power and authority conferred upon this Council by the Charter of said City.
