HomeMy WebLinkAboutResolution 2009-013 N.C.S. 01/26/2009Resolution No. 2009-013 N.C.S. of the City of Petaluma, California URGING THE SONOMA COUNTY TRANSPORTATION AUTHORITY (SCTA) TO DESIGNATE ALL MEASURE M FUNDS FROM THE MARIN/SONOMA NARROWS, SEGMENT C (MSN-C) PROJECT TO HELP FULLY FUND THE EAST WASHINGTON STREET INTERCHANGE COMPONENT (PROJECT RDA100280, PREVIOUSLY PROJECT C500306) OF CALTRANS MSN- C HIGH OCCUPANCY VEHICLE (HOV) PROJECT, AND TO FULLY FUND DESIGN OF THE MSN-C HOV PROJECT; CONSENTING TO THE EXPENDITURE OF TAX INCREMENT FUNDS IN THE PETALUMA COMMUNITY DEVELOPMENT PROJECT AREA, ADOPTING FINDINGS REQUIRED BY HEALTH & SAFETY CODE SECTION 33445 FOR SAID PROJECT; AND DIRECTING STAFF TO PURSUE STIMULUS PACKAGE FUNDING WHEREAS, in June, 2007, the Petaluma Community Development Commission held a public hearing and adopted the Five Year Implementation Plan for the Central Business District Project Area and the Petaluma Community Development Area (collectively, the "Project Areas") furtherance of the City's adopted Redevelopment Plans for the CBD and PCD; and, WHEREAS, California Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay for the cost of the construction of improvements which are publicly owned if the legislative body determines all of the following: That the improvements are of benefit to the project area or the immediate neighborhood in which the project is located. That no other reasonable means of financing the improvements is available to the community. That the payment of funds for the cost of the improvements will assist in the elimination of one or more blighting conditions inside the project area, and will be consistent with the implementation plan adopted by the redevelopment agency. WHEREAS, the Petaluma Community Development Commission ("PCDC") Five -Year Implementation Plan ("Implementation Plan") for the Central Business District ("CBD") and Petaluma Community Development ("PCD") areas (collectively, the "Project Areas")provides for the transfer of certain specified tax increment funds for the purpose of funding roadway reconstruction and related improvements ("Public Improvements") to arterial and collector streets, as more particularly described in the Implementation Plan; and, WHEREAS, the City of Petaluma, SCTA, and California Department of Transportation are partners in the delivery of improvements to the Highway 101 corridor (known as Segment C of the Marin/Sonoma Narrows Project; or MSN-C) that will include adding a high occupancy vehicle lane (HOV) in each direction, from Old Redwood Highway to Route 116, improving on - and off- ramps, and providing traffic management technologies that maximize congestion management in the corridor; and, Resolution No.2004-OB N.C.S. Page I WHEREAS, the Implementation Plan provides for the use of $4 million in tax increment funds for the purpose of funding the right-of-way acquisitions and construction of the East Washington Interchange ramp improvement component of Caltrans' Marin/Sonoma Narrows, Segment C (MSN-C) Project as more particularly described in the Implementation Plan (collectively, "Public Improvements") within the Project Areas and for the benefit of the Project Areas; and, WHEREAS, on December 19, 2005, by PCDC Resolution No. 2005-20, the Petaluma Community Development Commission authorized the Executive Director to allocate $4M from PCDC account undesignated fund balance to East Washington Interchange Project RDA 100280 (previous project number C500306) for right-of-way acquisition and construction of the ramp improvements to the East Washington Interchange component; and, WHEREAS, PCDC and City staff are aware of no other local source of funds reasonably available to undertake the City's share of funding for the Public Improvements, as the only other source available for such purpose would be City general fund revenues which are committed for the provision of essential services such as police and fire services; and, WHEREAS, the Public Improvements are of benefit to the Project Areas and/or the immediate neighborhood in which the Public Improvements will be located, regardless of whether the Public Improvements are in another project area, in that they will facilitate improvement to the traffic circulation along the East Washington Street corridor in the future; and, WHEREAS, payment of funds for the Public Improvements will eliminate blighting conditions in the Project Areas in that they will facilitate improvement to traffic circulation and pedestrian/vehicular safety along the East Washington Street corridor and facilitate redevelopment of large parcels of vacant and underutilized land; and, WHEREAS, the work includes right-of-way acquisition for the installation of a new northbound on -ramp and realignment of the souhbound on -ramp at the East Washington Interchange; and, WHEREAS, the current funding for the East Washington Interchange component (Project RDA100280) of the MSN-C Project and design of the full MSN-C Project consists of consists of $1M in demonstration funds, $9.5M in Measure M funding, $13.5M in SAFETEA- LU (federal) funds, and $4M in PCDC funds, for a total of$28M in available funding; and, WHEREAS, the current estimated Interchange Project cost, including right-of-way land acquisition, is $21.5M, and design cost of the MSN-C is estimated at $6.5M, for a total cost of $28M: and, WHEREAS, the Petaluma City Council has determined that it is in the best interest of the community to continue pursuing right-of-way acquisition of Plaza North, Plaza South and Regency shopping centers. and construction of the East Washington Street Interchange component ahead of the MSN-C HOV Project; and, WHEREAS, to move both Projects forward,, Council urges the Sonoma County Transportation Authority Board to designate all Measure M funds from the MSN-C Project to Resolution No. 3009-013 N.GS. Page 2 fund the East Washington Interchange component (Project RDA100280, previous project number C500306) and complete design of the MSN-C Project; and, WHEREAS, it is anticipated that federal stimulus packages from the State or federal level will be enacted over the next few months, for which Project RDA 100280 may be eligible for inclusion. NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council: 1. Adopts the above factual recitals as true and correct, and as its findings. 2. Based upon the foregoing, finds that (i) the expenditure of tax increment funds to undertake the Public Improvements as set forth in this Resolution and the Implementation Plan will be of benefit to the Project Areas, (ii) no other reasonable means of financing the Public Improvements_ is reasonably available, (iii) completion of the Public Improvements will eliminate blighting conditions in the Project Areas; and (iv) completion of the Public Improvements is consistent with the Implementation Plan adopted for the,Project Areas 3. Consents to the expenditure of tax increment funds in the amount of $4M for the completion of the Public Improvements as set forth in this Resolution. 4. Urges Sonoma County Transportation Authority to designate all Measure M funds in the Maria/Sonoma Narrows, Segment C Project to fund the East Washington Interchange component (Project RDA 100280, previously C500306) and complete full design of the MSN-C Project; and 5. Directs staffto continue to pursue inclusion of the East Washington Interchange component (Project RDA 100280) of the MSN-C HOV Project in upcoming State and/or federal stimulus packages Under the power and authority conferred upon this Council by the Charter of said City.
