4 ACCEPTING COMPLETION OF THE
5 PETALUMA MARSH ENHANCEMENT PHASE I
6 PROJECT NO. 9788

9 WI3EREAS, the City Council awarded the construction contract for the Petaluma
10 Marsh Enhancement Phase I (Project No. 9788) to North Bay Construction, Inc., 431
I 1 Payran Street, Petaluma, CA 94952 on August 7, 1995;

13 WHEREAS, North Bay Construction, Inc. has completed the work to the satisfaction
14 of the Director of Engineering;

16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
17 Petaluma, that the project is hereby accepted. subject to the general contractor, North
18 Bay Construction, Inc., and the landscape subcontractor, North Bay Landscaping Inc.,
19 executing the three-year maintenance agreement between the City and North Bay
20 Landscaping, Inc. to maintain the mitigation project and furnish a maintenance bond
21 acceptable to the City of Petaluma;

23 BE IT FURTHER RESOLVED that the City Clerk is hereby authorized [o sign the
24 Notice of Completion and the City Clerk to file the same with the County Recorder.

26 BE IT FURTHER RESOLVED that the Finance Department is hereby authorized to
27 release the 10% retention payment to North Bay Construction Inc., thirty-five (35) days
28 after the recordation of the Notice of Completion provided that no liens or stop notices
29 have been filed against the project.
