HomeMy WebLinkAboutResolution 96-223 07/15/1996. ~ Resolution No. 9s-zz3 N.C.S. of the City of Petaluma, California t CALLING AND GIVING NOTICE OF A SPECIAL MUNICIPAL 2 ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 1996, 3 FOR SUBMITTAL OF A CHARTER AMENDMENT ON 4 THE CITY MANAGER REMOVAL FROM OFFICE 5 6 WHEREAS, under the provisions of the City of Petaluma Charter and the laws of the State of 7 California, a Special Municipal election shall be held on Tuesday, November 5, 8 1996, and, 9 WHEREAS, pursuant to authority provided by Article XI of the Constitution, Title 4, Division l0 2, Chapter 3 of the Government Code and Division 9, Chapter 3, Article 3 of the 11 Elections Code of the State of California, the City Council of the City of Petaluma 12 desires to submit to the voters a proposed charter amendment; and, 13 WHEREAS, the City Council is authorized and directed by statute to submit the proposed 14 charter amendment to the voters: 15 NOW, THEREFORE, BE IT RESOLVED, ORDERED, AND DECLARED AS FOLLOWS: 16 1. Pursuant to the requirements of the State of California and the Petaluma City 17 Charter, there is called and ordered to be held in the City of Petaluma, California, to on Tuesday, November 5, 1996, a Special Municipal election for the purpose of 19 submitting a charter amendment regarding removal of the City Manager; and, 20 2. Pursuant to the requirements of the State of California and the Petaluma City 2t Charter, there shall be a Special election on Tuesday, November 5, 1996, at which 22 election the following charter amendment shall be submitted to the voters: 23 Measure Votes to Kemove C~tv Manager Shall the voters of the City of Petaluma amend a portion YES of Charter "Section 23 -The City Manager" to delete "He cannot be removed from office except. by a vote of five NO members of the council." and replace that with "He cannot be removed from office except by a vote of four members of the council."? kP5 No_ 96-223,.,,.,,, n.cs. Page 1 of 2 pages 1 z 3. The ballots to be used at the election shall be in the form and content as required 3 by law; and, 4 4. The City Clerk is authorized, instructed and directed to procure and furnish any 5 and all official ballots, notices, printed matter and all supplies, equipment and 6 paraphernalia that may be necessary in order to property and lawfully conduct the 7 election; and, 8 5. The polls for the election shall be open at seven o'clock a.m. of the day of the 9 election and shall remain open continuously from that time until eight o'clock p.m. to of the same day when the polls shall be closed, except as provided in Section 11 14401 of the Elections Code of the State of California; and, 1z 6. That in all particulars not recited in this resolution, the election shall be held and 13 conducted as provided by law for holding municipal elections; and, 14 7. That the notice of the time and place of holding the election is given and the City 15 Clerk is authorized instructed and directed to give further or additional notice of 16 the election, in time, form and manner as required bylaw.
