GIVING NOTICE OF A SPECIAL MUNICIPAL 2 ELECTION TO BE IiELD ON TUESDAY, NOVEMBER 5, 1996, 3 FOR A CFIARTER AMENDMENT REGARDING TERM OF CITY MANAGER 4 5 WHEREAS, under the provisions of the City of Petaluma Charter and the laws of the State of 6 California, a Special Municipal election shall be held on Tuesday, November 5, 7 1996, and, 8 WHEREAS, pursuant to authority provided by Article XI of the Constitution, Title 4, Division 9 2, Chapter 3 of the Government Code and Division 9, Chapter 3, Article 3 of the IO Elections Code of the State of California, the City Council of the City of Petaluma 11 desires to submit to the voters a proposed charter amendment; and; 12 WHEREAS, the City Council is authorized and directed by statute to submit the proposed 13 charter amendment to the voters: 14 NOW, THEREFORE, BE IT RESOLVED, ORDERED, AND DECLARED AS FOLLOWS: I5 1. Pursuant to the requirements of the State of California and the Petaluma City 16 Charter, there is called and ordered to be held in the City of Petaluma, California, 17 on Tuesday, November 5, 1996, a Special Municipal election for the purpose of I8 submitting a Charter amendment to the voters; and, t9 2. Pursuant to the requirements of the State of California. and the Petaluma City 20 Charter, there shall be a Special election on Tuesday, November 5, 1996, at which 21 election the following charter amendment shall be submitted to the voters: 22 23 Measure Cit Manager Term Shall the voters of the City of Petaluma amend Charter YES "Section 23 -The City Manager" to delete the sentence, "Heshall be appointed for an indefinite period."? NO 7/15/96 ReS,yo.,,.,....9.6-21,8.,N.cs. Page 1 of 2 1 t 3. The ballots to be used atthe election shall be in the form and content as required 2 by law; and, 3 4. The City Clerk is authorized, instructed and directed to procure and furnish any a and all official ballots, notices, printed matter and all supplies, equipment and 5 paraphernalia that may be necessary in order to property and lawfully conduct the 6 election; and, 7 5. The polls for the election shall be open at seven o'clock a. m. of the day of the s election and shall remain open continuously from that time until eight o'clock p.m. 9 of the same day when the polls shall be closed, except as provided in Section l0 14401 of the Elections Code of the State of California; and, t I 6. That in all particulars not recited in this resolution, the election shall be held and 12 conducted as provided by law for holding municipal elections; and, 13 7. That the notice of the time and place ofholding the election is given and the City 14 Clerk is authorized instructed and directed to give further or additional notice of l the election, in time, form and manner as required bylaw.
