'The applicant, 'Cobblestone Homes, has requested approval of a 40 square foot lot. line adjustment between
lot 22 and the City of Petaluma owned pa ' reel "A" of the Washington Creek Subdivision. The project is
located between East Washington,Street, Noriel. Lane, Redwood Circle and Prince Park. The adjustment is
being requested to fix a minor construction error of a retaining wall located at the rear of lot 22. A small
portion of the wall was inadvertently installed on the City owned parcel "A".

RESOLUTION APPROVING A LINE ADJUSTMENT FOR WASHINGTON CREEK
SUBDIVISION
EXECUTIVE SUMMARY The applicant, Cobblestone. Homes, has requested approval of a
40 square foot lot line,adjustment between lot 22 and the City of Petaluma owned parcel
"A" of the Washington Creek Subdivision. The project is located between East
Washington Street, Noriel Lane, Redwood Circle and Prince: Park. The adjustment is
being requested to fix a minor construction error of °a retaining wall located at the rear of
lot 22. A small portion of the wall was inadvertently.nstalled on the City owned parcel

2. BACKGROUND The developer, Cobblestone Homes is requesting approval of a lot line
adjustment application. The subdivision received tentative map-approval on February 25,
2002. On August:8, 2002, the project was approved by the Site Plan and Architectural
Review Committee (SPARC). On September 9, 2002, the City Council authorized
grading on the site prior to final map approval. The ^ City Council approved the final map
application for the project on March 3, 2003.
A 625 square foot lot line adjustment, between lands owned by the City of Petaluma and
lands owned by the project :developer was approved by the City Council as:, part of the
final map process for this project_. The developer provided' the City of Petaluma financial
compensation in the sum of $11'000'.001 for the portion of City owned land adjusted as part
of the final map process. The' $1,000.0:0 amount was determined by an independent real
estate appraisal firm. The firm provided a high/low ($10005500) range of land values
based on current values and chose to paythe 'City the highest land value amount
($1000.00) determined by the appraisal. Because the'developer paid the highest land
value amount for the previous lot line adjustment, 'it would be staff's recommendation not
to require any additional compensation for smal1,:40 square foot area.
3. ALTERNATIVES
Disapprove the lot line adjustment application and direct the developer to demolish and
rebuild the wall.

4. FINANCIAL IMPACTS: N/A
5. CONCLUSION The developer has filed the appropriate lot line adjustment application
with the Community Development Department and paid all necessary fees. The, proposed
lot .line adjustment is. in conforrnance with the Zoning Ordinance, Subdivision Ordinance
and Subdivision Map Act.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR
COMPLETION: N/A
7. RECOMMENDATION Staff recommends that the City Council adopt a resolution
approving a lot line adjustment.for the Washington Creek Subdivision.

12 . WHEREAS, the Community Development Director and the City Engineer have reviewed the lot
13 line adjustment application for the Washington Creek Subdivision and have reported it to be in
14 conformity with the Zoning Ordinance; 'Subdivision Ordinance and Subdivision Map Act and
15 such reports have been forwarded to and.reviewed by this Council; and,

18 NOW, THEREFORE, BE IT RESOLVED;

20 1. That said lot line adjustment of Washington Creek Subdivision is hereby approved; and,

22 2. The City Engineer is hereby authorized and directed to sign and seal the Notice of Lot
23 line Adjustment certifying, that the City Council has approved the same. The City
24 Manager and City Clerk shall thereupon cause said.Notice of Lot Line Adjustment to be
25 recorded in the Office , of the Sonoma County Recorder.

This application is for a Lot Line Adjustment to correct an encroachment of the as -built
retaining wall for Lot 22 of Washington Creek Village on Parcel A as shown on the final
map for Washington. Creek Village. The area 'of the adjustment is 40 square feet. The
new property line as 'proposed, meets the conditions of approval for Washington Creek
Village tentative map. The original mapped property line was placed farther away from
the creek than the minimum distance required as part of the tentative map conditions.
The proposed position of the lot line assures that the as constructed retaining wall is
located within the bounds of Lot 22.
