Summary Statement
California voters approved the California Clean Water, Clean Air, Safe Neighborhood Parks; and Coastal
Protection Act of 2002. Better known as Proposition. 40,, the Park. Bond provides for Per Capita funding
for Cities and Counties. The:.City of Petaluma 's Per Capita Allocation is $247,000.
By approving the recommended resolution the City can make application to receive the funds.

11 1. EXECUTIVE SUMMARY

13 California voters approved Proposition 40 (Park Bond) in 2002. Part of the Bond Act allocated Per
14 Capita funding "to Cities and Counties based on.population. The City of.Petaluma has been
15 allocated $247,000 and must apply for the funds. The recommended resolution if approved, starts
16 that process.

18 2. BACKGROUND

20 As a result of the successful 2002 Park,Bond (Proposition 40); voters approved the California Clean
21 Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act. The Park Bond allocates
22. Per Capita funding to local jurisdictions based population. The City of Petaluma has been
23 notified that it has been allocated $24.7,000 as a result of the Park Bond.
24 The Recreation„ Music and Parks Commission, following the successful election developed a list of
projects that have long been deferred due to a shortfall in the General Fund. The City Council, at
their meeting - of September 17, 2002, approved Resolution No. 2002 -154 authorizing the use of State
27 Park Bond (Proposition 40) funds to be used for identified deferred maintenance projects.
28 Projects discussed by the Recreation, Music and Parks Commission in 2002 include:
29 ® Replacement of restroom roofs and interior fixtures for Lucchesi, Oak Hill and
30 Walnut Parks
31 ® Paving of paths, play areas and / or eating ,areas "at Wickersham, La Tercera, McNear.
32 Parks, and overlay for the Community Center parking lot.
33 ® Tennis court resurfacing of tennis courts At McNear, Del Oro and Lucchesi Parks
34 ® Irrigation renovation at La Tercera, Miwok, Wickersham and Walnut Parks.

36 Since their initial discussion,, the Recreation, Music and 'Parks Commission and the City Council has
37 also identified replacement of the boiler and solar' collectors atthe swim center as projects that
18 qualify under °this program.

40 3. ALTERNATIVES

42 a. Approve the proposed resolution and apply for the 'allocated funds.
43 b. Not take action at'this time. The City has until 2011 to finish all projects.

45 4. FINANCIAL IMPACTS

Projects, which up to now have had no funding, can finally be started. The projects identified by the
Recreation, Music and Parks Commission have been .deferred for some time, resulting in further
1 deterioration of infrastructure, and negatively impacting the public .who uses the parks. Available
2 funds will cover all inspection and construction costs for the projects.

4 5. CONCLUSION
5 The City'has funding allocated to it as a result of a successful Park Bond. A number of deferred
6 maintenance projects have been delayed for a number of years. due to a lack, of General Fund dollar
7 By applying for monies due the City; those long deferred projects. can now be taken care of

9 6. OUTCOMES OR PERFORMANCE MEASUREMENTS TUAT WILL IDENTIFY SUCCES&OR .

11 Once�the resolution is approved, the required application with the approved resolution will be sent to
12 the office of,State.Parks. The State will then send. an agreement for the City Manager's signature.
13 Once the agreement is approved by the State, staff will send a list of projects with a "Notice of
14 Exemption" '(CEQA) filed with - the County, to State Parks. A letter authorizing the City to move
15 forward with the projects will then be sent to the City, at which time staff,can start the bidding and
16 construction: process.

18 7. RECOMMENDATIom

20 The City Council approve the State required resolution in order to start the process'to acquire the
21 allocated funding, and when funds are received, to schedule the long deferred list of projects.

AUTHORIZING TFIE USE OF
STATE PARK BOND ,(PROPOSITION 40) FUNDS
TO BE USED FOR IDENTIFD
DEFERRED MAINTENANCE PROJECTS
WHE REAS. the. Parks and .Recreation DePartment has a large 'number, of deferred
maintenance . projects •which have not been funded over` the years due to a shoitage of
maintenance funding, and,
WHEREAS, the General Fund as a source of maintenance funding has not been
consistent due to uncertain economic times; and,
WHEREAS, the voters of the State of California have recently approved Park Bond
Proposition 40 and the City- of Petaluma will receive Per. Capita Funds once criteria are
identified by the State Office of Parks and Recreation; and,
W11 MEAS, the Recreation Music, and Parks Commission, in order`to correct deferred
maintenance problems in "the :park system, have identified fifteen (15) deferred projects that
.could be completedlusing the Par'k'Bond Per Capita Funds and,
WHEREAS, the Recreation, Music, and Parks Commission is recommending: that Per
Capita Funds from the recently approved State Park Bond (Proposition 40) be used for identified
maintenance projects.
NOW 'THEREFORE, BE IT RESOLVED that the' City Council of the City of
Petaluma does hereby authorize the use of State Park Bond Per Capita Funds from Proposition
40 for identified projects , as,- recommended by the Recreation, Music, and Parks Commission.
Under the, power and authority conferred upon this Gouncil,by. the Charter of said City

RESOLUTION`OF' TBE CITY COUNCIL OF' THE CITY OF PETALUMA
APPROVING TKE APPLICANT TO APPLE' FOIL; GRANT FUNDS FOR THE -PER CAPITA
GRANT PROGRAM UNDER THE,,CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE
NEIGHBORHOOD PARKS, AND COASTAL PROTECTION OF'2002
WHEREAS, the people of the State of'Californa have enacted the Per Capita Grant;Program
which provides funds for the acquisition and development of neighborhood, community, and regional
parks and recreation lands and facilities; and
WHEREAS, the California Department of Parks and Recreation has been:delegatpo the
responsibility for the °administration of the grant program, setting up necessary - and
WHEREAS said procedures established by the. California Department of Parks andRecreation
require the Applicant's Governing Body to certify by resolution the approval. ofthet Applicant to apply for
the Per Capita Allocation, and
WHEREAS the Applicant will ,enter into a Contract with the State of California;

NOW, THEREFORE, BE IT RESOLVED tharthe Petaluma City Council 'hereby:
Approves the filing of an Application for local assistance funds from the Per Capita. Grant Program
under the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection`Act of
2002; and
2. Certifies that the Applicant has or will have sufficient funds tooperate and maintain the.Project(s); and

3. Certifies that the Applicant has reviewed, understands and agrees to the General Provisions contained
in the Contract shown in the Procedural Guide; and
4. Appoints the City Manager as agent to conduct all negotiations, execute. and submit all documents
including, but not :limited to Applications, agreements, payment requests' and ,so on, which may be
necessary for the completion of Project(s).
