Summary =Statement California voters approved the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002. Better known as Proposition 40', the Park Bond provides for Block Grant funding for Cities located in:Urbanized Areas. The City of Petaluma's Allocation is $1.51,911. By approving the recommended resolution, the City can make application to receive the funds. Recommended City Council Action /Suggested. Code: 4 '3 CITY OF PETALUMA CALIFORNIA FEBRUARY 23, 2004 AGENDA REPORT FOR, 8 Resolution Authorizing the City of Petaluma to Apply for Grant Funds for 9 the Roberfi-Z Terg Block Grant Prograin Under the California 10 Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Prote 11 Act of 2002 12 13 1, EXECUTIVE SUMMARY' 14 1'5 California voters approved the California Clean Water, Clean Air, Safe Neighborhood Parks, and 16 Coastal Protection Act of 'ZO02:( Proposition 40) . Part of the Bond Act allocated Block Grant 17 funding to Cities located. in an Urbanized Arica.. Funding to Cities,is,based on population. The City of 18 Petaluma has been allocated - $151,911 and must apply for the funds in order to receive them. The 19 recommended resolution if approved, starts that process. 20 21 2. BACKGROUND: 22 23 As a result of the successful 2002 Park Bond (Proppsition,40), voters approved the California Clean 219. Water, Clean Air, -Safe Neighborhood Parks and Coastal Protection Act. The Park Bond allocates 2 Block Grant funding to Cities located inan Urbanize Area, . based on population. The City of 26 Petaluma has been notified that it has been allocated $ 15.1,911 as a result of the Park Bond. 27 The Recreation, Music and Parks Commission, following the successful election, developed a list of 28 projects that have long been deferred due toa, shortfallin General Fund. The City Council, at 29 their meeting of September 1 1 7, 2002, approved Resolution No. 2002-154 authorizing the use of State 30 Park Bond (Proposition 40) funds -to he used -for identified deferred maintenance projects. 31 Projects discussed by the Recreation, Music and Parks Commission in, 2002 include: 3'2 ® Replacerne'nt of restroom roofs and interior fixtures :for Lucchesi, Oak Hill and 33 Walnut Parks 34 e Paving of paths, play areas and / or eating areas at Wickersham, La Tercera, McNear 35 Parks, and overlay for the Community Center parking tot. 36 • Tennis court resurfacing of tennis courts. at McNear, Del Oro and Lucchesi Parks 37 ® Irrigation renovation at La Tercera, Miwok, Wickersham and Walnut Parks. 38 39 Since their i - nitial disdussion, the Recreation, Music and Parks Commission and -the City Council has 40 also identified replacement ,of the boiler and solar collectors at the swim center as projects that - r0i 41 qualify under this program. 42 43 3. ALTERNATIVES 44 45 a. Approve the proposed resolution and apply for the allocated funds, b. Not take action at this time. FINANCIAL IMPACTS Projects, which up to now have had no funding, can finally be started. The projects identified by th Recreation, Music and Parks Commission have been.deferred for some time, resulting in further deterioration of infrastructure, and negatively impacting, the public who uses the, parks. Available funds will coverall inspection and construction costs for the projects. 5. CONCLUSION The 'City has:funding allocated to it as a resultlof a successful Park Bond. A: number of deferred.. maintenance projects have been.,delayed for a nurnber of years due to a.lac'k of General. Fund dollars. By applying for monies due the City; those long deferred projects can now be taken care of 6. OUTCOMES OR.PERFORMANCE MEASUREMENTS THAT WILL IDENTWY SUCCESS OR COMPLETION Once the resolution is approved, the required application with the approved resolution will be.sent to, the otffice of State Parks. The State will then send an,agreement for'-the: City Manager's signature.. Once the agreement is approved by State, staff will send a list of projects with a "Notice of Exemption" (CEQA) filed with the .County, to State Parks. A letter authorizing the, City. to move forward with, the projects will then be sent to the City, at which time staff can start the bidding and construction process. 7. PARK BOND (PROPOSITION 40) FUNDS TO�BE USED FO IDENTIFIED IDEFERRED'MAINTENANCE'PROJECTS ATTACHMENT ONE WHEREAS, the Parks and 'Recreation Department has a large number of deferred maintenance projects which have not been funded" over the years due m a shortage of maintenance funding, and, WHEREAS, the General Fund as a source of maintenance funding has not been consistent due to uncertain economic times; and, WHEREAS, the voters of the State of California have recently approved Park Bond Proposition 40, and the City of Petaluma will receive Per Capita Funds once criteria are identified by the Stam.Office of Parks and Recreation; and, WHEREAS, the :Recreation, Music, and Parks Commission, in order to correct deferred maintenance problems in the park system, have identified fifteen (15) deferred projects that .could be completed using the Park Bond Per Capita Funds;, and, W13 MEAS, the Recreation, Music, and Parks Commission is recommending that Per Capita Funds from the recently" approved State Park Bond (Proposition 40) be used for identified maintenance projects. NOW, THEREFORE, RE IT RESOLVED that the City Council of the City of Petaluma does ; hereby .authorize the use of State Park Bond''Per Capita Funds from Proposition 40 for identified projects as recommended by the Recreation, Music, and, Parks Commission. Miwok 0 0 0 3 3. $40 $40 Wickersham Walnut tank and pump installation 0 0 0 3 3 $15 $15 0 TOTAL $296 $2$6' RESOLUTION 2002 RESOURCES BOND ACT ROBERTI- Z'BERG- HARRIS' BLOCK GRANT PROGRAM Resolution No: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF APPROVING THE APPLICANT TO APPLY FOR GRANT FUNDS FOR THE ROBERTI Z'BERG- HARRIS BLOCK GRANT PROGRAM UNDER THE CALIEFORNIA CLEAN WATER, CLEAN AIR;'SAFE NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT OF 2002 WHEREAS, the.people of the State of California have enacted'the CALIFORNIA CLEAN- WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS AND COASTAL PROTECTION OF 2002' which provides funds for'the Roberti- Z'Berg- Harris Block Grant Program for grants to. eligible Applicants, and WHEREAS the California Department of Parks and Recreation has been delegated the responsibility for theadministration of the program within the State, setting up necessary procedures, and q WHEREAS,, said procedures established by the California Department of Parks and Recreation require the - . Applicants Governing Body to certify by. resolution the approval of the Applicant to apply for is the Roberti- Z'Berg- Harris allocation; and WHEREAS; the Applicant will enter into a Contract with the State of Califomia for the Project; NOW,, THEREFORE, BE IT RESOLVED. that the Petaluma City Council hereby: 1. Approves the filing of an Application for local assistance funds from the Roberti- Z'Berg- Harris Block Grant Program under. the California Clean Water, Clean Air; Safe Neighborhood-Parks. and Coastal Protection Act of 2002; and 2. Certifies that the Applicant has or will have suMicient funds to operate and maintain the Project(s); and 3. Certifies that the Applicant has: reviewed, understands, and. agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and 4. Certifies that the Project conforms to the recreation element of any applicable city or county general plan; and 5. Appoints; the City Manager as agent to conduct all negotiations; .execute and submit all documents:. . including,. but not limited to, Applications, agreements, payment requests and so on, which. may be necessary for the completion of the Project.
