VicinityMap Summary Statement On September 17, 2002, the Petaluma City Council passed Resolution 2002 -158, establishing an Underground Utility District in the vicinity of Water Street Between Washington Street and "B" Street. In 1WOcember 2003, the Petaluma Community Development Commission (PCDC) awarded a bid to North Bay onstruction to construct underground utilities in the established'Underground Utility District as part of the Water S,treet/River Walk Improvements Project 9891. Construction is scheduled to start March 1, 2004. The next phase of construction will be the Water Street/River Walk Improvements At Grade Site Improvements -Phase II, which 'includes streetscape elements such as streetlights, sidewalk resurfacing in brick cobbles and concrete 'overlays, landscaping and furnishings. In anticipation of this next phase of construction, twenty -three (23) streetlights must be ordered, for Water Street, now to avoid construction delays. At the same. time, on a parallel project, the Downtown Improvement Project 9053, Phase I, construction, problems have developed with a very old system for the 23'00 -volt lights on Western Avenue from Kentucky to Howard. In order. to avoid an expensive retrofit to an old lighting system, it is proposed that the electrical conduit be replaced and1hat twenty —five (25) lights must'be ordered, for Western Avenue, for early installation. The unit price for an order of lights can be reduced if we order in larger lots. The PCDC can save $240 per fixture by grouping the two project materials together. Street lighting materials have .a long lead —time from order to delivery, often exceeding three months. Therefore, the purpose of this item is to authorize the purchase of 'historic streetlights for two downtown redevelopment proj ects. In anticipation of this next phase of construction, twenty -three (23) streetlights, for Water Street, must be ordered now avoid construction. delays. Therefore; the'purpose of this item is to authorize the purchase of historic streetlights for two downtown redevelopment projects. 2. )BACKGROUND Over the past two years, the PCDC has worked with the Petaluma Downtown Association, ZAC Landscape Architects :and SPARC to develop the Water Street /River Walk Improvements to promote economic, vitality and ;growth in the Central Business District. The streetscape elements are the result of many hours of research, design, review and redesign. A specific decorative light fixture was approved by SPARC as part- of this: plan. Only one manufacturer, Holophane, whose local distributor is Republic Electric, produces the`particular light pole, arm and fixture selected by SPARC. N o� 3. ALTERNATIVES A. Purchase Decorative, Historic Street Lighting Fixtures: Under this option, the PCDC will authorize the purchase of Holo pliane decorative street 'lighting materials and provide them as PCDC furnished material to the contractor who was awarded the low -bid' 'construction contract the Water Street/River Walk Improvements Phase I- Utility Undergrounding. They will be installed as an extra to the contract. This option will also avoid additional costs_ for the continued maintenance of an old streetlight system on Wester Avenue, from Kentucky to Howard Streets, and provides the timeliest delivery and installation of the: materials needed. B. Defer Purchase of :Decorative Street Light .Fixtures & Allow Contractor for Phase II to Purchase Light Fixtures: Should these light fixtures be a sole source bid, it the manufacturer would provide: the same material price to all contractors, who would then mark up that price for handling: It is unlikely that bidding would, save the PCDC on the direct cost of the `materials. Indirect costs result from a lengthened construction contract and potentially lengthened construction disruption .to Water Street. The cost of the purchase will be as much as 1'0 %. higher than the quote by Republic Electric, due to contractor mark =up or approximately $.13;600. Also under.' this ;option, `the deferred delivery of the light fixtures -will -necessitate providing additional working days to the .Phase, II contractor to accommodate the light, fixture delivery schedule; thereby" delaying 'their installation. Iii addition, the replacement of the old lighting system of "Western Avenue would be deferred, thereby causing additional costs to be incurred to maintain an old'system. 4. FINANCIAL IMPACTS The FY 2003 -04 PCDC Adopted Budget includes funding, of $2,582,000 for Water Street/River Walk Improvements and funding of $6',345 for the entire Downtown Improvements project, which includes the purchase of streetlights. Sufficient funds are, available in the project budgets to cover' cost of 'the streetlight purchase, as shown on Tables 1 and 2 below. A. Alternative A:_ PCDC: Purchases,.. Decorative, Historic Street Lighting Fixtures:, Staff worked - directly With the only manufacturer of the decorative light fixtures 'approued ;by_SPARG to secure a fair price for the fixtures. The light fixtures match those being installed in the rest' of`the district. The cost of the purchase is $136;032. The cost of twenty —three (23). fixtures for Water. Street is $65,182 and the cost of twenty fixtures for Westem Avenue from the .Downtown Project;is $70,850 at'a unit cost,of $2,83.4 each. B. Alternative D: Include :Purchase of Decorative °Street; Light= Fixtures iii , the Water Street /River Walk At Grade. Site Improvements :Phase II Bid Package; Should these light fixtures be a sole source bid _item; the manufacturer would provide the same material price to all contractors; who would then mark up that price for handling: It ;is unlikely that b idding would save the PCDC. on the direct cost of the materials. CONCLUSION , It is in the best interest of the City, the 'downtown, merchants and patrons, impacted by construction f the PCDC, to directly purchase decorative street -light fixtures for the Water Street/River Walk Proj4p and for the Downtown .Improvement's Project.. This method of purchase will construction time, reduces the duration of the impacts of construction on Water Street avoids 'the .cost of repairing an antiquated lighfing system_<of Western Avenue, saves the PCDC money'through lower product cost and will avoid construction delays. 6. OUTCOMES OR, PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR.COMPLETION: The historic streetlights will be installed on both Water Street and Western Avenue by the fall of 2004. 7. ' RECOMMENDATION It is recommended that the PCDC adopt the attached resolution authorizing :the PCpC'to purchase 48 light poles and luminaries as quoted on, the attached 'letter from Republic Electric, dated. February 3, 2004. • M "SOLUTION #, 2004- ATTACHMENT #`1 PETALUMA, COMMUNITY DEVELOPMENT COMMISSION ° THE PURCHASE OF HISTORIC STREETLIGHTS FOR WATER STREET/RIVER WALK IMPROVEMENTS PROJECT 9891 AND FOR DOWNTOWN IMPROVEMENTS PROJECT 9053, STREETLIGHTS FOR WESTERN AVENUE FROM KENTUCKY TO HOWARD STREETS WHEREAS on June 16, 2003, the Petaluma Community Development Commission ( "PCDC ") held a public hearing and adopted the FY 2003- 04'PCDC Budget for the period from July 1, 2003 to June 30, 2004; WHEREAS, the Commission finds that the transactions authorized in this resolution are consistent with and effectuate the purposes of California, Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); WHEREAS, the Commission has an, interest in expediting the construction of the Water Street/River Walk Project #9891 and avoiding the high cost of maintaining an obsolete lighting system on Western Avenue by replacing the street lights between Kentucky Street and Howard Street;. WHEREAS, SPARC has approved the installation of historic, stteetlights in the Project Area with specifications which are consistent with the historic character of the district; WHEREAS, City staff have investigated potential sources from which such historic streetlights may be obtained; W EREAS, City staff have identified a supplier who can manufacture such streetlights in accordance with the specifications approved by SPARC; WHEREAS, City staff is aware of no other supplier who can manufacture such streetlights in accordance with such specifications within a reasonable tirneframe and at reasonable cost; WHEREAS, Section 4.04.050 of Petaluma Municipal Code provides for dispensing with public bidding when a commodity can be obtained from only one vendor, and WHEREAS, City staff have negotiated with Republic Electric, which has quoted a maximum unit price of $2,834 for historic street lights and luminaries, for streetlights conforming to the SPARC- approved specifications; WHEREAS City, staff have'been advised, that production of the historic streetlights will require a 12 -16 week manufacturing process; and WHEREAS, the time needed to competitively bid the purchase of the historic streetlights would delay timely installation of public improvements within the ,Project Area, delay implementation of the redevelopment plan for the Project Area, and likely result in a significant increase in cost. NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development Commission hereby: 40 : Finds that competitive bidding is not required by law because competitive bidding would be disadvantageous to the City of Petaluma, the Project Area and the PCDC because it would unreasonably delay implementation of public improvements necessary for the implementation of the Project Area redevelopment plan, and (ii) competitive bidding would be unlikely to result in a lower price for manufacture of the Histo streetlights than the price quoted by Republic Electric. 1 2.
