io WHEREAS, the City Council of the City of Petaluma on December 19, 1988, adopted
11 Resolution No.88-396 N.C.S. approving a Development Program for the Petaluma Auto Plaza
Iz Planned Community Dish~ict (PCD); and

14 WHEREAS; an application to amend the previously approved Auto Plaza PCD Development
15 Program was submitted to the Planning Department by the current property owner, Robert
I6 Benson, on May 8; 1995; and

18 WHEREAS, by action taken on July 11, ] 99~, the Planning Commission considered and
19 forwarded a recommendation to conditionally approve the proposed antendments to the PCD
20 DevelopmentProgram; and

22 WHEREAS, the proposed project has complied with the requirements of CEQA pursuant to
23 Section 15162 of the Guidelines; through preparation and adoption of a Mitigated Negative
24 Declaration on December 5, 1988 (Resolution No. 88-387), which addressed the potential
25 environmental impacts associated with the development of the Auto Plaza related to potential
26 impacts to: archaeological, historic, and biological resources; aesthetics; traffic and circulation
2~ conditions; and flooding conditions; and

29 NOW, THEREI'ORE, BE IT RESOLVED that the City Cowrcil hereby approves the amendment
30 to the Auto Plaza PCD Development Program to include a full service restaurant as a
3] conditionally permitted use on the southerly 1.25 acres of Parcel 3 of Parcel Map No. 261; 1250
32 Auto Center Drive based on the following findings and subject to the following conditions:

34 Findings fora PCD Development Program Amendment:

36 1. The PCD Development Program as amended to permit a full service restaurant as a
37 conditionally Permitted use on a 1.25acre portion of Lot 3 of Parcel Map 261 conforms
38 to the General Plan's land use designation of Thoroughfare Commercial because it

provides a complementary service/attraction (food) for the city-wide and regional
2 customer(s) served by the dealerships.

4 2. The proposed amendment will serve the public necessity, convenience and general
5 welfare by providing a needed service for the benefit of employees and customers of the
6 Auto Plaza area.

8 3. The proposed amendment will serve the public convenience. and genera] welfare by
9 potentially reducing employee/customer vehicle trips, particularly during lunch hour.

t I 4. The existing streets (Auto Center Drive, Benson Way, Industrial Avenue) and arterials
12 (Corona Road, Petaluma Boulevard North) are suitable and adequate to serve the
13 proposed use and the anticipated traffic which will be generated thereby.

15 5. The PCD Development Program amendment to include a Bill service restaurant as a
16 conditionally permitted use on a specitlc 1.25 acre site is appropriate in size, and location
17 to the existing and future dealerslips, and to the overall economic objectives of the
18 Petaluma Auto Plaza PCD.

20 6. The PCD Development Program amendment to include a full service restaurant as a
2I conditionally permitted use, as conditioned, on a specific 1.25 acre site is appropriate in
22 size and location, and the overall planning purposes intended; and that the development
23 of a restaurant pursuant to the provisions of the PCD Development Program will be in
2d harmony with the character of the surrounding areas.

26 7. The amendment to the Auto Plaza PCD to expand uses allowed within the PCD will.
27 provide needed service uses for the customers and employees o'f the Auto Plaza.

29 8. The proposed project has complied with the requirements of CIJQA pursuant to Section
30 15162 of the Guidelines, through preparation and adoption of a Mitigated Negative
31 Declaration on December 5, 1988 (Resolution No. 88-387), which addressed the potential
32 environmental impacts associated with the development of ehe Auto Plaza related to
33 potential impacts to: archaeological, historic, and biological resources; aesthetics, traffic
34 and circulation conditions; and flooding conditions. This proposed amendment to the
35 PCD Development Program to allow a full service restaurant as a conditional use does
36 notinri-oduce the potential for significurt environmental effects not addressed through the

I previously .adopted negative declaration. "Therefore, pursuant to Section 15162 of the
2 CEQA Guidelines, no further environmental review is necessary in conjunction with this
3 proposal, and no farther environmental analysis is nece"scary.

s Conditions of PCD Development Program Amendment:

7 1. City staff shall amend the I'ctaluma Auto Plaza PCD Development Program under
8 CONDITIONAL USES (Section IV) to include: "A full service restaurant on a specific
9 1.25 acre site; a portion of Parcel 3 oP Parcel Map 261 (see Exhibit A for location
1 o purposes).

i2 2. City staffshall amend the petaluma Auto Plaza PCD Development Program to include a
i3 provision tinder SIGNAGE (Section XXI) which prohibits the useof the 60' free standing
I4 lighted digital sign for restaurant advertisements.

16 3. Design of the future building shall reflect the highest level of design attention and detail
17 to reflect the prominence of this site.
