HomeMy WebLinkAboutResolution 2007-108 N.C.S. 06/18/2007 Resolution No. 2007-108 N.C.S. of the City of Petaluma, California ACCEPTING COMPLETION OF THE CONSTRUCTION CONTRACT FOR PETALUIVIA RIVER 2006 DREDGING PROJECT, PROJECT NO. G500150 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Petaluma River 2006 Dredging project ("Project"); and, WHEREAS, no bids for the Project were received on August 31, 2006 in accordance with California Public Contract Code Section 4105.5 and other applicable law; and, WHEREAS, in such a case, California Public Contract Code Section 20166 excuses further compliance with State law competitive bidding requirements; and, WHEREAS, due to the urgent need to remove accumulated silt from the Turning Basin, Petaluma River, and Marina, the PCDC issued a solicitation for competitive proposals from all interested contractors; and, WHEREAS, on September 7, 2006, PCDC received three proposals for the Project in accordance with California Public Contract Code Section 20166; and, WHEREAS, the apparent low proposal for the Project was the bid of North Bay Construction in the amount of $1,377,500; and, WHEREAS, by Resolution No. 200.6-145 N.C.S. adopted August 7, 2006, the City Council of the City of Petaluma and the Petaluma Community Development Commission ("PCDC") authorized the use of Redevelopment funds for public facilities and made specified findings and authorized and directed the City Manager of the City of Petaluma to execute a contract with the lowest responsible bidder for emergency dredging of the Petaluma River, Turning Basin and Marina, in accordance with State and Federal bidding requirements, the City Charter, Municipal Code, and State and other applicable law; and, WHEREAS, the following change orders affecting the Project amount have been approved: - - - - y,1,, ~ ~ ' x . _ . _ 1 $14,804.60 2 $52,148.50 3 $1,000.00 4 $17,750.00 5 ($18,830.00) 6 $122,883.43 Total Change Orders: $189,756.53; and, Resolution No. 2007-108 N.C.S. Page 1 WHEREAS, the final contract amount (Petaluma River, Turning Basin and Marina), as amended, including all change orders is $1,512,236.53; and WHEREAS, PCDC staff have inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma and the PCDC as follows: 1. The contract entitled Petaluma River 2006 Dredging Project, Project No. G500150 with a final contract amount of $1,512,236.53 is accepted as complete, subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file aNotice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3. Staff are hereby authorized and directed to release all undisputed retention, not subject to pending change orders, within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California.
