RECYCLED WATER USE AGREEMENTS EXECUTIVE SUMMARY.: Petaluma's water recycling program is informed by a unique partnership between the City and seven locally owned ranches. The program supports the City's continued compliance with the Regional Water Quality Control Board's requirements that prohibit the discharge of treated wastewater -into the Petaluma River from, May 'l through October 20, and provides for the beneficial reuse of recycled water by the ranchers for irrigation of their pastures. The current agreements with the; landowners expired in March 2004. BACKGROUND: History The City of Petaluma beganus'ing:reclaimed-wastewater in 1976. The Petaluma Wastewater Irrigation„'S_tudy, conducted byMr. Dan;Silacci using a 50-acre parcel west of the City's oxidation ponds, provided firm evidence that effluent from the oxidation ponds could 'successfully irrigate a range of crops„ including barley, wheat, oats, forage mix;:,9udan. grass; ,and' silage corn; under focal ,soil' an&climatic conditions. This early effort laid, the groundwork for the City',s extensive agricultural irrigation partnership with the local `ranching community. In November, of'1979, the State Water Resources Control Board approved the City's concept of constructing an extensive water -recycling program. Two months later the San Francisco Regional Water Quality Control Board issued an order prohibiting the City from discharging treated effluent into the Petaluma River from May 1 through October 20. This required the City to find an alternate use for the water during the warmer 1. ,)k months of the year, and also provide_ d the legal impetus for the City's implementation of the water -recycling program'. The identified benefits of the water -recycling concept were: o Preservation of agricultural land in open space; • : Increased local agricultural productivity; and • Increased local economic activity. The City estimated that 500 acres of agricultural land was necessary for the. recycling program. In,April of 1980, the City interviewed local ranchers to determine if they were interested in receiving and using,recycled water for irrigation. Of the 20, ranchers interviewed, 9 were interested. The nine landowners had more land available than was needed, allowing the design engineer to -calculate .the most .cost effective means for getting recycled water to, the various ranches. At: that tune; the City Council chose to develop, a partnership with, local ranchers for utilization of the water and to; not purchase Wand for the irrigation.program. Construction of the water recycling facilities was: completed in 1983; and consisted of three=pump stations; transmission pipelines and 15 hydrants- located' on the- individual. parcels. In 1984; the City began -pumping. -recycled water under pressure to the hydrants. From the>hydrants, the landownersaccepted the water and distributed it to their lands through wheel lines and:aluminum surface irrigation pipe. At the program onset, itheCity provided the necessary inigation,equipment. Qver the years, upgrades to the irrigation equipment have been,made'bytheranchers, through fees paid_ by the Cify to the -ranchers for utilizing the recycled water. 'In 1985 and 1986 the City contracted with EOS to assist the landowners with application of recycled waterto their lands. Inr 19871 the City issued a Request fof. Proposals (RFP) to seven firms fora 10=year contract for the application of recycled Ovate' to. the lands. In response,. the City received proposals from EOS and Redwood .Agricultural..Management, Inca (RAM). The City Council, approved a contract with RAM to,manage the application of recycled waterto-the agricultural lands. The City extended itsecontract with RAM for' one year in 1997 at a rate. of $3.00/acre-foot. In 1998, the Cityexecuted 4-year contracts directly with the seven,landowners: at an average. rate of $220 per acre-foot. This approach resulted in:signifi'cant cost savings ;to ,the program. The City also set a' maximum total entitlement of 2,155 acre-feet peryear, for agricultural irrigation. In 2002, the City executed,2-year contracts with the seven, landowners. The current contracts expired'in March 2004. A historical comparison of agreement terms and rates:is provided, in Table 1. 'The, Ci ''s'National Pollutant Discharge ,Elimination S. stem. �1 h' g y (1VPDES) permit still prohilits'the discharge of treated effluentinto the Peialuma, River _fifrom May 1 through October M 2 Current Program The City currently delivers recycled water through eighteen hydrants ('additions in,1994 and 2062) to ten customers in Sonoma County. The majority, ofrecycled water is currentlyused for irrigation of local agriculturallands, and the remainder is used to irrigate a portion of Adobe Creek Golf Course and one small vineyard. Rooster Run Golf Course is scheduled to receive recycled water starting this summer. A. Ranching Partnerships Each.participating landowner, successfully converted their lands from dry native rangeland to, irrigated permanentpasture. This was. accomplished through cultivation and re-seeding.of the lands. ,In addition, many landowners have installed fencing and cross - fencing to segregate fields and manage livestock. The fencing prevents livestock and machinery from. entering -recently irrigated fields before they dry.. Today approximately'800 acres of agricultural land. is irrigated "with an average of 560 million gal-lons,�(1690 acre=feet) of.recycled water annually. The, irrigated lands are shown on Figure .1: The recycled. water is distributed from the oxidation ponds to the lands through .three pump, stations operating.in series, transir_iissionpipes, and 18 hydrants. Containment,of powntiatrunoff is provided by nine check dams. -In 2003, Petaluma produced 694 million gallons (2130 acre-feet) of recycled Water. This amounts to over 3.7% of the City's annual average.flow. This is one of the highest recycled water rates in ® the Bay Area. l_. Golf .Course: Partnerships In 1990; the Adobe Creek'Golf'Course began paying,the City for irrigation of approximately WO acres of and. The City -is in the fourteenth year of a fifty-year agreement with the, golf course. The golf course' annually uses about'l 00 million gallons (307 acre-feet) of, recycled water-. In accordance with the; City Council direction provided: on_ February 25, 2002, the Department of Water Resources and Conservation designed the Phase 1 Recycled Water Pipeline Project, which will. convey secondary recycled water to Rooster Run Golf Course in the near term, and "serve: as the backbone of the City's urban recycled water prograrn, in ,the long term.. Approximately 19,000 :feet of 20 inch diameter pipeline will be installed to � convey recycled water from, the City's oxidation ponds to Rooster Run Golf'Course. If is,estimated that the annual' amount -of potable water saved.will be 138 million gallons (423'-acre=feet); which is equivalent to the annual, amount'of water used by over 1;00.0, households. Construction of the pipeline started last September and is scheduled for full commissioningin Spring 2004. C; Vineyard: Partnership Hydrant ,1.8 was added.to the,program in 2002 to serve Karren Vineyard. The, 30-acre vineyard utilizes approximately 4 million gallons (f2.3 acre-feet) through a.drip irrigation system each season. 3 y. Permits: The City's water reclamation program is operated under the authority of the Regional Water Quality Control Board. The program:'s requirements. are contained in "Order'No. 88-036, which specifies how the water- can be used, the: water quality standard; and the monitoring program..A copyofthe permit -is provided as Exhibit B to the draft 'agreement, which is.provided.under Attachment A. Criteria for the use of recycled water. in California;is specified in ritle.22 of the California Code.of Regulations., The City's wastewater'treatment plant on,Hopper Street produces "disinfected,secondary 23 wastewater" as .defined by Title 22. As shown on ,Table.2, "disinfected, secondary 23 wastewater" can be used to irrigate golf°courses, sod farms; pasture formilk- animals, fodder crops and cemeteries. The City -contracts with Veolia' Water to monitor the activity of the Users of 'recycled water. Compliance with the permit must be verified on.a daily basis by the monitors of the program. The City informs the Regional Water Quality Control Board of the water recycling program,through monthly reports: The City is currently in the design phase forthe new Ellis Creek Water Recycling Facility located adjacent'to. the ponds on.Lakeville Highway. This facility will produce disinfected tertiary'recycled water meeting Title 22 requirements for'uhrestricted use. As ,shown,on Table�2,, allowable' irrigation uses for disinfected tertiary water includepafks, and playgrounds, schoolyards', residential landscaping, unrestricted access golf courses, • food crops, and otheruses not prohibited_ by the -California Code>of Regulations. Once the new plant goes online in Year 2007, water meeting California Title;22 requirements .for disinfectedtertiary recycled water will be. available for use in the�urban.seiting-. POtnent for itecvcled Water. The ability for�an entity to pay'for recycled water (payment capacity) 'is' directly "related to the: value that the recycled water brings to the user and also the°value of thecrop .grown by the: user: For example, recycled water is very valuable to golf courses since it can be purchased.at a Power cost than:potable water and'is usedao grow a crop ,(.grass) tha6s essentialto the user. This is true' for users who operate vineyards ,and grow truck crops and for.. any userthat is dependent upon potable water. However, the,payment capacity of users who 'irrigate pasture is relatively limited. A report titled Farm Level Payment. Capacityfor Secondary and Tertiary 'T,reated .later in Sonoma County (Northwest.Economic Associated,. March 14, 1997) concluded that "-The net,returns available for (recycled) water ... are negative :for apples; prunes, silage, hay/Oats, and ap sture.." (Emphasis: added. Please, contact Margaret .Orr at 778-43U4 if you wouldaike &copy of this report.) Additionally, a recent surveyof three entities; (City of Santa Rosa, Novato Sanitary District, and. Monterey'Regional Water'.Pollution Control ` Agency) with water recyclin&programs determined that. Santa Rosa and. Novato do ,not charge .users who, use reclaimed; water for irrigation of -pasture. Santa. Rosa pays users to 4 • take -water for irrigation, of pasture. Santa Rosa ,also provides ranchers with maintenance ,services and irrigation equipment. Novato has ,a long=term lease with"the'County Flood Control District: for land and utilizes., this land for summer"irrigation. Fixed sprinklers were.instal_led by Novato, and Aare. maintained by Novato. Two ranchers ,lease the land from the District and grow hay obtaining six .cuts per year over the two that dry farming might allow. 'A potable water supply was added to the system for the cows to drink. No payments areprovided.hut extensive district labor is utilized to keep the program viable. Monterey receives- payment for the, tertiary water ,it provides to growers: Profitable crops such as artichokes, lettuce„ broccoli, cauliflower, celery,, strawberries, and flowers are grown. The payment equates to approximately $1331acre.for these high -end tertiary water supported crops.. There are. other examples where users are charged for, recycled water. Santa 'Rosa. charges Gallo for using recycled water, as Petaluma, similarly charges Karren Vineyard. Additionally, the' Napa Sanitation District charges for recycled water provided to a golf course and industrial;park., Petaluma charges Adobe Creek Golf Course -for use of recycled water and Rooster Run Golf Course will also pay once distribution is begun this spring. `In each case; :the user ,places a'high value on the recycled water since it can be purchased at a lowerprice4han potable water. The payment capacity°of pasture farmers who use recycled water for°irrigation continues to be limited. Thus, the City has always provided funding for our, ranching partners. ® Over the years the funding haswarie . (Table 1). On March, 2, 1998 ,the City Council authorized City Management to�execute four-year agreements for -the iise of recycled waterwith .the seven landowners. At that time, a. maximum annual agricultural irrigation entitlement of,2,1S5 acre-feet was established. The, payment was "reduced from $300 per acre foot in 1199.7 to an average of $220°per acre-foot in 1.9.98. In 2002, the City executed new agreements with the seven'land'owners for a.two-year term.. 'The payment was further reduced to $210 per'acre-foot. The City of Petaluma requires:the ranchers to provide insurance :including workers compensation, general liability and automobile liability. Probosed.Promm (2004.2007) In preparation for the upcoming irrigation seasons,, the City participated in three -meetings with the.ranching;partners to discuss modifications to the program. On February. 4, 2004, thel City discussed.thechange°in available waterwith therx4nch rs (to, accommodate Rooster Run,Golf Course). It was proposed,that land be eliminated from. the program that°is ,difficult to ,access orhas potential regulatory issues. Eliminating- these lands from the programreduced irrigation:demands for, ranching by 72 million gallons (221 acre- feet). Additional meetings with the ranchers were held on March' `l9 Nand March 22, 2004. A copy of the draft _agreement is provided in Attachment A. 3. REcomMFNnATloN: City Management has identified a payment,,recommendation for City,Council' consideration for the proposed:four-year agreement enclosed in this packet. City Management is proposing a four-year. agreement because the :addition of the new 5 .y Ellis Creek Water Recycling:Facility will expand the City's water recycling opportunities. A potential extension in the agreement with the ranchers- may be warranted and is included as part of: the proposed Agreement. Entitlement Under the 1998 and 2002 recycled water agreements, a maximum entitlement of 2,155 acre-feet�per year was set for agricultural reuse. The total maximum ;entitlement for the 2004-2007 program has been reduced, to 1:,690 acre-feet,. a decrease of 465acre-feet per year; or.22%. Payment The 2002recycled:water agreements,included apayment of$210°per acre-foot:of . recycled water and A total maximum entitlement of.2,1.55 :acre-feet, for an. estimated total: program budget cost of $452,550. ($21.0 per acre-foot x 2,155. ,acre=feet). The proposed 2004=2007 agreements include a ,total;maximum entitlement of 1,690 :acre-feet and continuethe payment.,o f $210 per acre-foot of recycled water used,, for an estimated budget cost:of�$354,900 ($210 per acre-footx 1,690 acre=feet). This is a differenceiof $97,650 CityNlanagement:recommends.a portion of 'this -,difference be r_e nested "into the maintenance of the irrigation equipment by establishing, a maintenance allowance: of $89,570 peryear. Theindividual;maintenance allowance for each-rahch would be proportioned from the; $89,570 and be based on the. number of acres of land irrigated with recycled water. The proportionate maintenance>allowance for each�ranch is shown on Table 3.. The he allowance is -designed to' provide funding. for maintenance of the. aluminum -,piping, sprinklers; check, dam,pumps and other irifrast-ructureused in support of irrigation.. Much of this equipment has reached the end ofits useful life: Repairing and,replacing this equipmentreduces thexisk ofan equipment -related failure and,improves, the operational integrity of the system. 4. FINANCIAL.IMPACTS: The cost of the ,program isestimated to be $4.44,4,70 -annually, through.2007. 5. CONCLUSION: Following the award, ,the ,ranchers will enter into a four-year contract with, the City and submit the required insurance. 6. OUTCOME&.OR PERFORMANCE MEASUREMENTS'THAT WILL IDENTIFY SUCCESS OR COMELETION:, Successful use of recycled water on agricultural land and continued compliance, with the City's National.Pollutant Discharge Elimination, System (NPDES) permit as issued by the California Regional Water, Quality Control Board. • M. •7. SECTION 3.4 OUALITY OF RECYCLED WATER. The quality of the Recycled, Water shall be in accordance with the Permit. SECTION 3.5 RECEIPT AND USE OF RECYCLED. WATER. (A) General. User agrees to take; accept and use Recycled Waterafovirrigation of User's Land. (B) Irrigated Land. User agrees.to use Recycled Water for irrigation of certain acres of Land. It is understood that the Land to be.ihigated may change yearly"depending on the User's ranching operations and management. Land designated.in Exhibit D colored in yellow may not be,irrigated with Recycled Water. All other areas as outlined in Exhibit D are Allowable, Land, The City reserves the right to adjust the Allowable Land as needed. (C) Check Dams. User shall maintain any and all Check Dams located on User's ® property free and clear of silt; sediment, vegetation and any other material that may inhibit function of Check.Dam. During the Irrigation Season, User shall maintain lowest possible level in Check Dam. User shall apply ponded water from Check Dam to Land in accordance with these Specifications. At the end of the Irrigation. Season, User shall empty Check Dam to lowest possible level. User shall prevent runoff from leaving Check Dams during thei Irrigation Season. (D) Berms. User ,shall. construct and maintain berms as' necessary to prevent runoff of Recycled Water. Maintenance may include grading and, debris removal. SECTION 16 SCHEDULE AND COORDINATION WITH OTHER USERS. (A) Shorta-ge. User acknowledges that City is obligated to deliver Recycled Wate_rlo other users. User also. acknowledges that City's distribution:system is. not an "on -demand" system and that distribution and use of Recycled Water- must be: coordinated among the Users.. (B) ReQional Water Oualitv Control Board. User shall use Recycled Water in accordance with Section.B Reclaimed Water Use Restrictions and Section Cl of Board Order No. 88-036 or successor Permit. (C) Stater Health Department: 'User shall use Recycled Water in accordance with applicable requirements of Title 22'of the California Administrative Code. SECTION 3.8 PERMISSION TO ENTER. 'User hereby grants City, acting through its duly°authorized employees, agents;: representatives,,or contractors, . reasonable access to'User's property to ,do any necessary work associated with these Specifications, including; ,but not limited to, meter reading, monitoring of Recycled Water use by User, repair of City owned equipment, or any other monitoring of Recycled Water related activity on said property. When entering User's property, City shall 'interfere as little as possible with User's other operations and land usages of the property. SECTION 3.9 IRRIGATION BOUIPMENT: (A) Use. City shall further hold the User; its officers, agents and employees harmless for any liability for ground water contamination which may occur on adjoining properties as the result of the program. Furthermore, should damages occur to other third parties, such as adjacent land owners, and persons handling the Recycled Water and provided that the User has complied with all the terms and conditions of these Specifications and has not acted in a negligent or willful fashion, City shall assume such liability and shall hold User harmless and indemnify User from any such damages and/or claims for damages. SECTION 8.0 CONTRACT TERMINATION. (A) General. Notwithstanding any other provision set forth herein, City may terminate or suspend this Agreement immediately for cause. From October 21 through April 30, wastewater maybe discharged to the: Petaluma River from the plant's oxidation ponds. 2. The discharge of wastewater fiom ,the Petaluma treatment plant to the Petaluma River from October 21 through April 30 is covered by a separate set of requirements adopted 'by the Regional Board under the National Pollutant Discharge 'Elimination System. 3. Section 13523 of 'the California Water Code provides that a Regional Board, after consulting with -and receiving the recommendations from the State Department of Public Health, and if it determines such action. to be necessary to protect the public health, safety, or, welfare, shalt prescribe water reclamation requirements for water which is used or proposed to be used as, reclaimed water. The use of reclaimed water for the purposes specified in Finding 1 could affect lJ J • is the public health, safety, or welfare, and requirements for these uses are therefore necessary in accordance to the ,Water Cade. 4. The Board adopted a Water Quality Control Plan (Basin Plan) for the San Francisco Bay Basin in December 1:986. The water quality objectives for reclaimed wastewater, as set forth in the Basin Plan, are specified in Title 22, Section 60301 - 60357 of the Caldomia Administrative Code. 5. The producer and Users are presently governed by Regional -Board Order No. 82-1S. 6. The Board has notified the Producer, the Users, and interested agencies of its intent to prescribe water reclamation requirements for the proposed uses. 7. The Board at a public -meeting heard and considered all comments pertaining to this reuse. IT IS HEREBY ORDERED, that the Producer and Users, in order to meet the provisions contained in Division 7 of the California Water Code and regulations adopted thereunder, shall comply with the following: A. General Reporting responsibilities of waste dischargers are specified in this Regional Board's Resolution No. 73-16 and in Section 13225(a). 13268; 13383, and 13387(b) of the California Water Code. The principal purposes of a monitoring program by'a waste discharger, also referred as a self - monitoring program, are: a. To document compliance with waste discharge requirements and, prohibitions established by the 'Regional Board. b. To facilitate self -policing by the waste discharger in the prevention and abatement of pollution arising from waste tdischarge. • 2. Sampling and Analytical Methods Sample collection, storage, and analyses shall'be performed according to the latest edition of "Standard Methods for the Examination of Water and Wastewater" prepared and published jointly by the American Public Health Association, American.Water Works Association, and Water Pollution Control Federation; or other methods .approved and. specified by. the Executive Officer of this Regional, Board. Water `and waste analyses shall be performed by a laboratory approved for these analyses by the State Department of Health or a laboratory approved by the Executive Officer. The Director of the laboratory whose name.appears on the certification shall supervise all the analytical work in his laboratory and shall sign all reports of such work to the Regional Board. 3. ' During the times when reclaimed water is being supplied for irrigation, the pond system integrity shall be visually checked -for the following items: I. Any observed standing water which is believed to be seepage from the ponds shall be analyzed for Total Coliform, Fecal ColHorm, Fecal Strepptoccocci, and electrical conductivity. For each reclaimed water User, the following shall be recorded after inspection by either the Producer or User: i. The specific "runs" irrigated, type of equipment used, and hours of irrigation. ii. Location and extent of any spray transport outside the setback areas, including spray transport outside property lines. lii. Location and extent of any runoff to check dams,, stream channels containing surface, water, or offsite. iv. Location and source of any odors of sewage origin. 4. The written report shall include pertinent information explaining reasons for the non-compliance and shall indicate what steps were taken to prevent the problems from recurring. • 0 Z. Self -Monitoring Reports Written report by the Producer shall be filed regularly for each calendar month by the 15th day of the following month. The reports will be comprised of the following: a. Letter of Transmittal A letter transmitting self -monitoring reports shall accompany each report. Such a letter shall include a discussion of requirement violations found during the. past month and actions taken or planned for correcting the violations such as operations modifications, and/or facilities" expansion. if the Producer' or User has previously submitted a time schedule for correcting requirement violations, a reference to the correspondence transmitting such a schedule will be satisfactory. The letter shall contain a statement by the official, under penalty of perjury, that to the best of the signer's knowledge the report is true and correct. b. Results of Analyses and Observations Tabulations of the results from such required analyses and/or observations specified in Table I by date, time, type of sample, and station. • 1. List the analyses for which the Producer is approved by the State Department of Health. ii. List of analyses performed for the Producer by another approved laboratory. Copies of reports signed by the laboratory director shall. also be submitted as part of the self - monitoring report. 3. This Order is iniended,,to serve as a region -wide general permit for publicly owned wastewater ,and water agencies that recycle treated municipal wastewater. It is intended to replace individual .reuse Orders and. applies to the following suppliers of recycled water: a. Producers of secondary and tertiary recycled water that meets CCR Title 22 water reuse criteria and is reused for a direct beneficial use or a controlled use that would not otherwise occur. b. A Distributor of recycled water.- who receives wastewater from a municipal wastewater,facility, may or may,4ot:give it additional treatment to meet CCR Title 22 water reuse criteria for`its intended use(s) and distributes it to. users: In some cases - 'a written agreemen (e.g., Joint Powers Agreement or equivalent contractual agreement) between a Producer. and a Distributor may be preferable to issuing this Order to the Distributor. c. Although the statewide criteria specified in Title 22 apply only to use of recycled water andnot to fhe disposal: of wastewater to land (e:g:, to meet NPDES restriction_ s for receiving water discharge) those discharges to land may pose an identical degree of public exposure and' risk. REUSE FACILITIES A_Nb THEIR RESPONSIBII-r= 5. Most of the publicly :owned wastewater treatment, plants (POTWs) in the Region, hereinafter referred to as the Producers, produce treated wastewater of suffident . quality to allow its reuse for certain applications as prescribed in this Order. Water service agencies also have authority under the provisions set' forth in this Order to distribute recycled water within their respective jurisdictions. 6. POTWs provide_ at least secondary treatment to Distributors or Users; under written agreements with the participating Producers/Distributors respectively. The recycled water meets the quality, criteria established by. California Department of Health Services. (DHS) and this Order. Additional treatment by the Producer, Distributor or User-rnav be necessary to meet the intended use. The Producer or - Distributor.is`responsible for,insuring that water reuse is adequately monitored through an approved program. i. Decisions,regarding new treatment and distribution facility construction, operation, funding, cost -sharing. and related aspects are the responsibility of the .Producer, Distributor and affected Users. STATE RECLAMATION POLICIES AND REGULATIONS 8. In )uly • 199'2 Section 13523.1 was added to the California Water Code, authorizing regional boards to issue; master reclamation permits to a producer and/or distributor of recycled water in lieu of prescribing individual water -reuse requirements for a user of recycled water. Section 13523.1 also removes the requirement, except upon written request 'of a regional board;, that 'Users file a report with a regional board to use recycled water from a producer/distributor for whom a master reuse Order hasbeen issued. Similarly, it exempts any such user of recycled water"from the rC9uirement to file a report with a regional board related to any material change in the character of the recycled water or Its use: For further discussion of State Policies and Regulations see Attachment G. State Health Regulations 9. Section, 13523 of the California Water Code provides that a Regional Board, after consultation with .and. upon receipt of recommendations from DHS, and.if it determines such .action to be necessary to protect the public health, safety, or welfare, shall prescribe water reuse requirements for water which Is, used or proposed to be used as recycled water. 10. This Order's requirements conform with and implement the Department of Health Services's� water reuse criteria as ;set forth in Title 22, Division 4, Sections 603.01 through 6035'5 of the California Code of'Regulations (hereinreferred to as the DHS -reuse driteria). Revisions to Title 22 shall become part of this Order automatically upon final adoption of those revisions by DHS. REGIONAL BOARD BASIN PLAN 11. The Board adopted a revised Water Quality. Control. Plan for the San Francisco Bay Basin (Basin Plan) on December 17, 19'86 prescribing water quality objectives for • ground and surface waters throughout the region. The. The City shall not be obligated to provide Recycled Water in excess of the maximum entitlement of Iacre-feet during any Irrigation Season. (.C) Maximum Irrigation Rate. Maximum irrigation rate shall be gallons per minute. V. AMENDMENTS This document expresses the entire Agreement between City and User and supersedes any previous or contemporaneous communications, representations or agreements. Secondary recycled water shall not be applied so as to cause runoff or degradation of any water body or wetland. 6. Recycled water shall not be .applied in groundwater recharge and wellhead protection areas (so designated by local agencies). 7. The. use of recycled water shall not cause rising groundwater discharging to surface waters to impair surface water quality objectives or beneficial uses. B. The Incidental discharge of recycled water to waters of the°State shall not unreasonably affect present and anticipated beneficial uses. of water, .and not result in water quality less than that prescribed in water quality control plans or policies. 9. No recycled water shall be discharged from treatment facilities, irrigation holding ; tanks, storage ponds, or other containment, other than for permitted reuse In accordance with this Order, other Board issued Waste Discharge Requirements or NPDES permits, contingency plan ,in an approved Water Reuse Program (NOI report), or for discharge, to a ,municipal sewage treatment system.- 10. Miinimum Recycled Water Quality Water to be recycled for reuse shall at a minimum be adequately oxidized and disinfected water that receives at least secondary level treatment and meets, at a minimum; the following limits: a. Dissolved Oxygen 1.0 mg/1 minimum b. Dissolved Sulfide 0.1 mg/I maximum c. Total Coliform All water recycled for reuse authorized under this permit must meet the total coliform limits specified below (at .either the Producer's wastewater treatment plant or, if necessary; after additional treatment at a Distributor's plant. 4. Secondary - 23 Recycled- Water {Restricted Use) Secondarw23 recycled water shall meet the following total colifonn limit prior to delivery for reuse purposes: a. Total coliiform After adequate .contact with disinfectant the number of total coliform organisms shall not exceed: (a) a, median value of 23 MPN/10O.ml as determined,'ffom the bacteriological results of the last seven days for which sample:;analvses have been completed, and (b) a maximum"value of 240 MPN/100m1 in more than one sample in any 30 day period. b.. Reuse, Applications: i Secondary recycled water may be used where the public has restricted access or exposure. See Attachment A for a list of reuse applications. 5. Secondary-2.2 Recycled Water Second ary-2.2 recycled water shall meet the following total coliforrn limit prior to delivery for reuse purposes: a. -Total cotifocm After adequate. contact with disinfectant. the number of total colifocm organisms shall not exceed (a) a median value of 2.2'MPN/100ml as 5 determined from -the bacteriological results of, the lastsevmdays for which sample analyses have been completed, and (b) a maximum value of23 NfPN/1.00m1 in more than one sample in any 30 day period. b. Reuse Applications: See Attachment A for reuse. applications. 6. Tertiary Recycled Water Tertiary recycled. water shall be coagulated (except as identified in'Part C below), and filtered; and'meet the following total coliform, disinfection process and. turbidity limits prior to delivery for reuse purposes: a. Total coliform After adequate contact with disinfectant the number. of total coliform organisms shall not exceed:; (1) a median value of 2.2 MPN/100ml as determined from the bacteriological results of the -last seven days for which sample analyses have, been completed, and (2) a maximum value of 23 MPN/100m1 in more than one sample in any 30 day, period. No sample shall exceed a total colform value of 240 MPN/100 MI. b. Disinfection Process 1) A chlorine disinfection process that provides a CT (chlorine concentration tirries mbdal contact time) value of not less than 300 milligram -minutes per liter at all times with a modal contact time of at least 90 minutes„'based on peak daily design flow (or an equivalent combination of,chforine concentration and contact time subject to Executive Officer approval); or 2) A disinfection process .that, when combined with. the filtration process, has been demonstrated to reduce the concentration of plaque -forming units of F-specific bacteriophage MS-2, or polio virus; per. unit volume of water in, the wastewater to one hundred thousandths (1/100,000) of the initial concentration.in the filter influent throughout the range of qualities of'wastewater that will occur during -the recycled water treatment process_. A virus that is at least as resistant to disinfection as polio virus may 2be used for purposes of the demonstration.. The above demonstration must be approved by the DHS and the Executive Officer. c. Turbidity The turbidity of filtered recycled water shall not exceed any of the following. 1) 2 NTU daily average, 5 N-TU more than 5 percent of the time, or 10 NTU at any time. Coagulation need not be used as part of the treatment process provided the turbidity of the influent to the filters does not exceed 5 NTU more than 5 percent of the time. • 6 d. Reuse Applications: See attachment A for reuse applications. Recvcled Water Storage Limitations a. Any storage, facility containing recycled water for reuse applications shall be managed in a manner to control odor or nuisance conditions. Should such problems develop, a management plan shall be devised and implemented to monitor, correct, and control future occurrences. b: All wastewater storage ponds shall be adequately protected from erosion, washout and flooding from a 24-hour, rainfall event having a predicted frequency of once in 160 years. G REUSE PROGRAM PROVISIONS Producer Responsibilities I. Producers wishing to be covered under this General Water Reuse Order shall-submitallotice of Intent (NOI) irr accordance with Attachment B. Producers who are currently covered by an individual ,order, and do not submit an NOI, will continue to be covered bytheir individual orders and.Order 91-042. Producer responsibilities in this section may be required of or undertaken by the Distributor as appropriate. In such cases the Distributor shall submit the NOi or the Producer shall show evidence of an agreement" with the Distributor to undertake the responsibilities. In any cases respective responsibilities shall be spelled,out in the joint agreement. Z. This Order becomes effective upon written approval of the NOT report by the Executive Officerand supersedes any current Water Reuse kequiremerits. The Regional Board will coordinate with DHS.to obtain their concurrence of NOI reports prior to approval by the Executive Officer. 3. Under this Order a Producer may authorize specific reuse projects on a case -by - ,case basis in accordance with a Producer designed permit-based;program for Users of recycled water. The Producer shall develop administrative procedures Specifying how the permit based system for regulating users, will be implemented and how compliance with the. DHS" reuse criteria will be assured. Upon Board approval of the Producer's, program, which shall -accompany the NOI, the, Producer may authorize. specific reuse projects on a case -by -case basis once the administrative elements of,the water -reuse program are in place. 4. The Producer shall establish and enforce rules and regulations for recycled "water uses goveming'the design and construction of reclaimed water use facilities and the use of recycled water in accordance with DHS reuse criteria. S. The Producer or Distributor (as appropriate) shall submit to DHS for review and approval. documentation, of the "proper installation of Title 22 mandated backtlow prevention devices and the absence of cross connections prior to commencing use of recycled water at sites meeting any of the following criteria: accordance with DIJS reuse criteria and C'CR Title.22.•Section 760'5. Reports of testing and maintence shall be maintained"by ffiel Producer. 15. The Produ-cer, and U-sers'shall maintain in good working order and operate as efficiently as possible any facility or control. :systerri installed by the Producer or Users, respectively, to achieve compliance with the water reuse requirements. 16. The Producer, Distributor and Users should receive appropriate employee training to assure proper operation of recycling facilities, worker protection, and compiiance-with this Order. Jn accordance with CCR'Title 117, Section 7586, each Producer; ;Disthbutor and User shall designate a Recycled Water Supervisor'respons ble for compliance with a Producer's, permit conditions. 17. The; Producer and Users ,shall,.,assure that all above ground equipment, including pumps, piping, ttorage.reservoir, and valves, etc. which may at any time; contain recycled watershall be adequately and clearly identified with, appropriate warning signs. The Producer and Users shall make all necessary provisions to inform the public that the liquid being distributed is recycled water and is unfit for human :consumption. D. GENERAL PROVISIONS 1. The Producer will document compliance with all conditions of this Order andof water reuse Wteria in Title 17 and Title 22 of the California Code of Regulations. 2. Current Water Reclamation Reuse Requirements that are superseded by this Order pursuant to Provisions C. 1 and 2, will be rescinded under a separate Order(s). I This Order. provides authorization for tanker -truck distribution of recycled water, and s'upercedes Order No.., 91-04�2 for those Producers; pursuant to C.2.Order 91- 042 stays in effect far ;those not under the General Order. 4. Each. Producer should .strive to investigate, as resources permit, all possible potential reuse strategies such as groundwater recharge, surface water augmentation, and dual water supply, for new construction, in order to.move towards achieving a goal of reusing the maximum possible amount of recycled water. S. When directed by the Regional Board,.'in groundwater basins that are a significant source of drinking water where there is:a likely potential -for groundwater degradation from salt buildup from_ extensive water recycling irrigation,, a Producer shall prepare and submit a Salt ManaRement`Program, acceptable to'theExecutive Officer, to insure that the overall impact of permitted water recycling projects does not degrade groundwater resources. 6. If'any.condition or criteria set forth in this Order conflicts or is inconsistent'with any requirement set forth in any State regulation, the'more stringent condition or criterion shall apply. 7. Regional Board' staff will conduct an annual inspection/audit of each Producer's water reuse ,program and conduct periodic spot field inspections on reuse projects. 8. The Producer, User/Distributor shall permit the Board or ltsr authorized representatives, it accordance with Section 13267(c) of the California Water Code: 9 a. Vv`here the proposed use is a new use that is not covered in the DHS reuse criteria b. Dual plumbed systems (per Title 22 definition. — within building plumbing and residential irrigation). c. Large,. high volume usage or otherwise complex sites as defined.in the Producer's Water Reuse'Program (pursuantto Provision L3.). 6. The .Producer will be responsible for ensuring that. recycled water meets the quality standards of .this Order. and for the operation and maintenarice� of major transport faciiities and associated .appurtenances. The Producer, shall hold the Users responsiblefor. the application and use' of recycled water on their designated use areas and assodated, operations and main in accordance with all, applicable DHS reuse criteria requirements. 7. The Producer shall conduct: periodic inspections of the User's facilities, and . operations -to .monitor,and' assure copiiance, with conditions of the. Producer's permit and. this Order.. The Producer, shall take whatever actions are necessary; including .the .termination of delivery of recycled water to the User,, to correct! any User violations. 8. The Producer shall comply with all applicable items of the attached Standard Provisions' and Reporting Requirements, or any amendments thereafter. 9. When additional site'specific requirements and/or Provisions are applied to a reuse project as a, condition of:adoption of .this Order, they shall be identified in the NOI and appended to this Order as Attachment E. Joint Responsibilities 10. Each User shall demonstrate to ,the Producer,the means. by which all applicable use area requirements, as ,specified in DHS reuse criteria, will be complied with. 11. If someone other, than the User (User''s Agent) is responsible for'applyin .g the recvdedwater, e.g. a truck hauler, then the User,shall inform them of these requirements in a written permit or othe'usuitable manner-. A User's Agent shall fill out a Recycled Water Release Form or equivalent, traking documentation when receiving recycled water from the Producer. 12. A.copy,of the, Water Use ,Permit must be provided W the. User by the Producer. The'Users must have these Lavail,able at all times for inspection by Regional Board staff;, the'Producer; or State/Courity Health Officers: 13. The Producer shall comply with the self —monitoring program as adopted by the Board and as may be amended by the Executive Officer.. The Producer is responsible for collecting reports from Users. Users are responsible for submitting on —site observation reports and use data to the, Producer; viiho will compile and file an'annual report with the Regional Board. The!Producer; at Its discretion, may assume the User's' responsibility for on -site observation reports and use data. 14. The Producer shall assure that cross-connections:between'potabl.e water, and non potable water systems have not been creaied and that'backflow prevention devices are in.proper'workirig -order by conducting or requiring User'testing, in. 8 • 01 a. G E: i FIRAL • - 'Reporting responsibilities of water receding agencies are specified 'in Sections 132�5(a); 13267(b), 13268, 13383, and 13387(b) of'the California Water Code and thisRegional' Board's Resolution No. 73=16, • The principal purposes of a monitoring program by water recyclers, also referred to as the self=monitoring program, are: 1) To document compliance with water quality requirements and prohibitions established by this Regional Board; and 2) To facilitate self=policing by the water recyclers. B. RECYCLED WATER MONiTOR1NG A Producer shall develop and implement a water reuse monitoring program. When the User(s) .Is other than the Producer, delegation of responsibilities must be clearly spelled out and included in the Producer's Water Use. Permits. Recycled Water Effluent Quality - Producer Program The Producer's self -monitoring, program is applicable during periods when recycled water is in use. The,SMP program shall include the observations, sampling, measurements, and analyses prescribed in Table 1. Description of Sampling and Observation Stations a. Recycled Water Station Description E-001 Location at the wastewater treatment plant where a representative sample of treated effluent being diverted for reuse can be obtained and total diverted flow can be measured. Monitoring of Recycled Water Users - Producer/User .Program Self -Monitoring Program The Producer will' set individual user monitoring, requirements based on the size, volume used, complexity, etc. of each use area. Producer conducted monitoring, or user self -monitoring if approved by the Producer, shall be conducted at least annually. All recycled use ,areas, while recycled water is being used, shall beinspected at a frequency, specified by the Producer's Water Reuse Permit , for the following deriLlerfdes or violations of use: 1. Standard Observations a. Evidence of runoff of recycled water from the site (show affected area on a sketch, estimate volume). b. Odor of wastewater origin from irrigation site. If present, indicate apparent source, characterization,arfd direction of travel. 2 C. Evidence of ponding of recycled water, and evidence of mosquitoes breeding within the irrigation area due'to ponded water. d. warning signs properly posted to inform public that irrigation or water • use is recycled water which is not safe for drinking. e. Evidence of leaks or breaks in the irrigation system pipelites or tubing. f. Evidence of broken; or otherwise faulty drip .irrigation system emitters or spray irrigation sprinklers. g. Evidence of overflows, leaks, erosion of dikes, etc. of storage pond(s) or impoundment(s). All violations shall be followed by a discussion of when and how deficiences were corrected. 2. Description of Sampling and Observation Stations a. Land Observation Stations Station ` Desorption L-1 to L-n Locations at a suffici.ent-number of points at reuse areas in order to ensure, compliance with water reuse requirements. b. Impoundment Stations Station DesLzipdon P-1 to P-n Locations at points along the periphery of each storage, ornamental, golf course, or other pond or impoundment. Inspection Program A Producer shall also conduct periodic random_ inspections of Users to ensure compliance with DHS reuse criteria and the'Water Reuse Permit. Any, significant repairs or modifications made to the -system Involving compliance with this Order shallbe-describedin the Annual Report. C- REPORTING, REQUIREMENTS 1. Significant Violation Reporting Violations of the DHS reuse criteria that impact or threaten to impact public health or water quality. shall be reported to the Board by`phone_ within 24 hours, followed by a written report within 15 days describing corrective actions taken. 2. Annual Report to the Regional Board An annual report for each calender year shall be `submitted to the' Board by the Producer. byffi March,15 of each :year. The report. shall contain a statement by the reporting ocial, under- penalty of perjury, that to the 'best of the signers knowledge the report is true and correct. 3 The report shall. include: • a. Tabulation of SMP recycled water analyses (see Table 1). b: A tabular summary of recycled water use by: billing period by each User. C. A list of new authorized recycled water Users, including the name of customers, application, source and projected annual flow to be delivered. d. A summary of the total daily recycled water delivered by the Producer. e. Tabulation of User -,site inspections conducted by the Producer. f. A summary of effluent violations related to recycled water use, violations found during inspection of reuse sites, corrective actions taken and any changes to, .or revoking of User authorizations by the Producer. in addition there shall be a comprehensive discussion of the progress and results of the water recycling program. The discussion shall also include: g. An, update regarding current and future, development of the water recycling program, including planning; design and construction of facilities, preparation of required reports and technical docbments and progress toward regulatory approvals. h. Restricted access golf course: A golf course where public access is controlled so that areas irrigated with recycled water cannot 'be used as if they, were part of a park, playground, or school vard and where irrigation is conducted only In areas and during periods when the golf course is not being used by golfers. Restricted Recreational Impoundment: An impoundment of recycled water in which recreation is limited to fishing, boating, and other non -body -contact water recreational activities. Spray Irrigation: The. applicationof recycled water to crops to maintain vegetation or support growth of vegetation by applying it from sprinklers or orifices in piping. Spray irrigation does not include drip irrigation. Surface Irrigation: Application of -recycled water by means other than spraying such that contact between the edible portion of any food crop and recycled water is prevented (i.e., drip or flood irrigation). Use Site Area: An area of recycled water use with defined boundries. A use site area may contain one or more facilities. . User Supervisor: A person designated, by the owner or manager of the property upon which recycled water will be applied_, to discharge the responsibility of the owner or manager of the property for: (ayinstallation, operation and maintenance of a system that enables recycled water to be used; (ti) for prevention of potential hazards; (c) implementing and complying with conditions of all Water Reuse .Orders/Permits and associated documents; and (d) coordination with the cross -connection control program of the, supplier of drinking water and the local health/environmental health agency. (A Recycled Water Supervisor and User Supervisor may. be one in the same in some instances). ATTACHMENT G STATE WATER REUSE POLICIES/REGULATIONS California Water. Code Summaries California Water Code Section 13512 declares it is the intention of the Legislature that the State :undertake all possible steps to.encourage development of water'reuse facilities so that reclaimed water may be made available to help'meet the growing water demands of the State. Section 13510,states that the people of the state have a primary interest in the development of facilities to reuse water containing waste to supplement existing surface and underground water supplies and' to assist in meeting the future water requirements of the State. Section 13511 states- that a substantial portion of the future water requirements of this state may be economically met by beneficial use of reclaimed water. Use of recycled water constitutes the development of "new basic water supplies". Section 13550 states that the use of potable domestic water for non potable uses; including, but not limited to, cemeteries, golf courses, parks, highway landscaped areas, and industrial and .irrigation uses, is a waste or an unreasonable use of the water, if reclaimed water -of adequate quality is available at reasonable cost. Section 13551 states that a person or public agency shall not use water from any source of quality suitable for potable domestic use for non potable uses, including cemeteries, ,golf courses, parks, highway landscaped areas, and industrial and irrigation uses, if suitable reclaimed water is available as provided in' Section 13550. Section 13241 states that it may be possible for the quality of water, to .,be changed to . some degree withou t.,unreasonab ly affecting beneficial uses. Factors that the Board must consider when establishing or amending water quality objectives include, but are not limited to: (a) P,ast,'present, and probable future. beriefi'ei_al, uses of water. (b) Environmental characteristics, of the'hydrographic unit - under consideration; including the quality of water available thereto. (c) Water quality conditions fhat could reasonably be achieved through the coordinated control of all factors which affect water quality in the area. (d) Economic considerations. (e) The need for develoning'housing within the region. (f) The need to develop and, use recycled water. Re;ional Board Basin Plan — Recia-mation Policy Summaries Policy Statement To date in this region, disposal of most municipal and industrial wastewater has primarily involved,discharges into the Reoion's watersheds and the San Francisco estuary system. With growing awareness of the impacts of toxic discharges, the drought, future urbanization, and growth on the local aquatic habitat, there is an increasing' need to look for othersources of water. Increasingly conservation and reclamation will be needed to deal with these long-term water issues. The Regional Board recognizes that the people of the San Francisco Bay Region are interested in developing the capaciry to conserve and reclaim water to supplem;eat existing water supplies, meet future°water requirements; and r;esiore the re-ion's watersheds and estuary system-. • Disposal of wastewater'to,inl'and,, estuarine or coastal waters is not considered a permanent solution where th'e.poiential exists for conservation and reclamation. California Water Code states that the State Water Resources Control Board shall take all appropriate proceedings or actions to prevent waste, unreasonable use, or unreasonable methods of use. ....Section 132'5(i) mandates that the Regional Board encourage regional planning and actionfor water quality control. Source Quality Control The quality of influent to a reclamation plant affects the quality of effluent production, particularly in those: communities that import high -quality surface water from the Sierra Nevada. Reclamation treatment and costs are directly dependent on the quality of influent into the plant. The quality of this influent depends'on the quality of the water supply and the quality of the waste discharges to'the reclamation plant. Reclamation requires that industrial pretreatment and pollution prevention programs be'sufficient to remove toxic. constituents. Reclamation, also requires adequate monitoring and enforcement. Additionally, maximum recycling and separate treatment of waste by industries should be encouraged where feasible. Government Coordination Implementation of reclamation projects requires the involvement, approval, and support of a number of agencies, including state and local health departments, the Regional Board, local POTWs and water districts, and land'use planning agencies. Interagency coordination must be a priority of all parties involved in reclamation. Failure to coordinate activities can result in the inability to carry out reclamation projects in a timely, consistent, and cost-effective manner. The Regional Board seeks • cooperation and participation of professionals from the water reclamation industry and the water, health, and regulatory agencies to ensure the development of criteria that are both attainable and appropriate. Regional Water Quality Control Board — Water Reuse Permits If a Regional Water Quality Control Board (Regional Board) determines that it is necessary to protect public health, safety, or welfare, it may prescribe water reclamation (reuse) requirements where reclaimed water is used or proposed to be used (Water Code Section 13523). Where regulatory reclamation criteria has been adopted by the Department of Health Services; no person may either reclaim water or use reclaimed water until the Regional Board has either issued reclamationrequirements or waived the necessity for such ;requirements (Water Code Section 13524). In the process of issuing reclamation requirements, the Regional Board.must consult with and consider recommendations of the:Department (Water Code Section 13523). Any reclamation requirements which are issued by the Regional Board, whether applicable to the reclaimer or to the user of reclaimed water, must include or be in conformance with any regulatory reclamation criteria adopted by the Department. • f Department of Health Services - Title 22 Wastewater Reclamation Criteria To assure, protection of public health where water use is involved, the Califoriia • Department of Health Services (Department) has been statutorily directed to establish statewide 'reclarnati'on criteria for .the various uses of reclaimed water (Water Code Section 13521). The .Departmerithas, promulgated regulatory criteria, which are currently set forth, in the. California ,Code of, Regulations, Title 222, Division 4,, Section 6630i et seq. The Department's regulatory criteria; include.numerical limitations and requirements, treatment method, nquirements,. and provisions and requirements related to sampling and analysis, engineering reports, design, operation,. maintenance and reliability of facilities. The Department's'regulations also permit the granting of exceptions to reclaimed water quality requirements in some cases, call for acase-by- case reviewnf,groundwater recharge projects, anddallo.w use of altemative:,methods of treatment so long as the alternative methods used are. determined by the Department to assure equivalent treatment and reliability. If Commercial General Liability Insurance or other form with .a general aggregate liability is used, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit. 2. Automobile Liability: $1,000,000 per accident for bodily injury and property damage. 3. Employer's Liability: Bodily Injury by Accident - $1,000,000 each accident. Bodily Injury by Disease - $1,000,000 policy limit. 'Bodily Injury by Disease - $1,000,000 each employee. 4. Such other insurance coverages and limits as may be required by the City. C. Deductibles and. Self :Insured Retentions Any deductibles or self -insured retentions must be declared to and approved by the City. D. Other Insurance Provisions The required general liability and automobile policies are to contain, or be endorsed to contain the following provisions- 1. The City, its officers,' officials, employees; agents and volunteers are to be covered as insureds as respects: liability arising, out of activities performed by or on. behalf of the Consultant; products and completed operations of the Consultant; premises owned, occupied or used by the Consultant; or automobiles owned, leased, hired. or borrowed' by the Consultant: The coverage shall contain no special limitations on the scope of protection afforded to the City, its officers, officials, employees, agents or volunteers. 2. For any claims related to this project, the Consultant's insurance coverage shall be primary insurance as respects the City, its officers, officials, employees, agents and volunteers. Any insurance or self -'insurance maintained by the City, its officers, officials, employees, agents or volunteers shall be excess of the Consultant's insurance and. shall not contribute with it. 3. Any failure to comply`rvith reporting or other provisions of the policies including breaches of warranties shall not affect coverage provided to the City, its officers, officials, employees, :agents or volunteers. 4. The Consultant's insurance shall apply separately to each insured against whom claim is made or suit is brought except, with respect to the limits of the insurer's liability. 5. Each, insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, canceled by either party, reduced in coverage or:in limits except after thirty (30) days' prior written notice by certified mail, return receipt xequested, has been given to the,City. 40 E. Acceptability of.dnsurers Insurance is to be placed with insurers with a current A.M. Best's rating of no less than ANH. F. Verification ofiCoverage Consultant, shall furnish the City with original endorsements effecting coverage required by this clause. The endorsements are to be signed by a person authorized by that insurer to bind coverage on its behalf. The endorsements are to be on forms provided by the City. All endorsements are to be received and approved by the City before work commences. As an alternative to the City's forms, the Consultant's insurer may provide complete, certified copies of all required- insurance policies, including endorsements effecting the coverage required by the City.
