Location Map Summary, Statement The Denman Reach flood reduction and "River'Plan implementation project will create a flood terrace along the east bank of the Petaluma River from Corona Road upstream on City owned properties, purchased with grant funds. The project also entails ;construction of an upland parking lot, educational kiosk, benches, trails, and streetfront landscaping. The upland area has been designed, and construction plans and specifications prepared by Questa Engineering. The City is currently contracting with Argonaut Constructors for the reconstruction of Industrial Avenue. Once the project engineer's estimate was completed ($129,570), a price quote was 'requ'ested from Argonaut Constructors for the parking lot and associated improvements ($119,686). Authorizing a Change Order will allow `the upland improvements to be constructed in a timely manner with the road improvements and will complywith funding agency, Department of Water Resources, drawdown deadlines. Later this spring, improvements to create the flood terrace improvements will occur, when regulatorypennits are obtained and soils conditions allow substantial grading activities to occur. CHANGE ORDER WITH ARGONAUT CONSTRUCTORS TO ADD THE UPLAND IMPROVEMENTS FOR THE l)ENMAN REACH —RIVER PLAN IMPROVEMENT PROJECT, CONSISTING OF THE STAGING-AREA AND STREET FRONTAGE IMPROVEMENTS. 1. BACKGROUND At the direction of the City. Council, grant funds were applied. for - from the State Department of Water Resources, Urban 'Streams Restoration Program. The State, awarded the City two grants, totaling $1,559,682 for the purchase and res p toration of the Grange, Banker and Amaral Properties in accordance with the River Access and Enhancement, Plan. The four .purchased properties are located on the west side. of Industrial Avenue, north of. Corona Road (see attached. location map). The project has been, designed m accordance with the adopted River Plan, to provide for the creation of the flood terrace. The upland area and the landscaping plan has been designed utilizing native species P p allow the to access the river with mmimum maintenance responsibilities. The improvements will trail from the staging , area. The educational kiosk is being designed to match the kiosk designs for Shollenberger Park and McNear Peninsula Park. 3. ALTERNATIVES ® Adopt Resolution_ as recommended. ®. Provide alternative direction. FINANCIAL IMPACTS The construction will be funded by a combination of grant funds and Flood Mitigation and Drainage Fees through the approved Capital Improvement Project budget (C5.00303). The City received two ants totaling, $1,559,682, to pur the Grange, Banker, and Amaral properties and begin the restoration and enhancement; called for in the adopted River Access and Enhancement Plan. The matching funds, $238,416, were included in the 2003 -2004 Surface Water budget. Discussions with Sonoma County Water Agency and the Southern Sonoma County Resource Conservation District resulted in the approval of $200,000 Zone 2A funds for inclusion in the project. The costs associated with the task proposed within this Report and proposed :Change Order are includeT in the approved grant budgets for Phases 1 and 2, of this project. No additional funding for this work is anticipated. CONCLUSION Upon authorization by the- City Council, a Change Order will be executed and work on, ; the upland area of this portion of the .D,erurian Reach project' will proceed. Adoption of the Resolution will allow progress to continue on the implementation of the upland restoration. Location Map - &­ _ob RESOLUTION AUTHORIZING A CHANGE ORDER WITH ARGONAUT' CONSTRUCTORS TO ADD THE iJPLAND,IMPROVEMENTS FOR THE I)ENMAN REACH — RIVER PLAN I MI'ROVEMENT PROJECT, CONSISTING OF THE STAGING AREA AND STREET FRONTAGE IMPROVEMENTS WHEREAS, the City of Petaluma was awarded $1,559,6'82 in grant. funds from the State Department of Water Resources, Urban Streams Restoration. Program; and' WHEREAS, such grant funds are to be utilized to fund work on the Denman Reach project including improvements for flood terrace, trail - irrigation, landscaping and related improvements to affected streets; and WHEREAS, the City of Petaluma has awarded a contract to Argonaut Constructors for reconstruction of Industrial Avenue; and WHEREAS, the upland restoration portion of the Denman Reach Phase 1 River Plan implementation project involves roadway changes, impacting Industrial avenue, including, "but not limited to, grading, parking lot, trails, site amenities, and othef, work; and WHERAS, if such portion of the Denman -Reach project is contracted for separately and/or awarded following completion of the Industrial Avenue reconstruction work, the City will incur additional costs and/or fail to realize cost savings as a result of the need for coordination of separate contracts impacting the same public facilities, and due to duplicative work concerning Industrial Avenue repair and improvements; and WHEREAS, City staff has negotiated a proposal in the amount of $119,686 with Argonaut Constructors for the construction of the grading, parking lot, trails, and site amenities for the upland restoration portion of the Denman Reach Phase 1 River Plan implementation project; and Page 1 WHEREAS, competitive bidding of the grading, parking lot, trails, and site amenities Work for the • upland restoration portion of the Denman Reach Phase PRiver Plan implementation project would ,result in the public 'incurring additional expense, including, but not limited to additional costs and/or failure to realize ,cost savings as a result of the need for coordination of separate contracts impacting the same public facilities,, and, due to duplicative work concerning Industrial Avenue repair and improvements; and therefore competitive bidding of such work would not produce an advantage for the public; NOW, THEREFORE,;BE IT , RESOLVED, by the'City Council of the City of'Petaluma as follows: The above recitals are hereby declared to be true and. correct and findings of the -City Council of the City of Petaluma. 2. Issuance of a change order to Argonaut Constructors for the grading, parking lot, trails, and site amenities work for the upland restoration portion of the Denman Reach Phase. l River Plan implementation project as described above is exempt from California Public Contract'Code competitive bidding requirements pursuant to the established common -law doctrine articulated in the case of Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.-App. 3d 631. 3., The City Manager is hereby authorized to execute a Change Order with the firm Argonaut Constructors, in an amount not to exceed $120 for Denman Reach improvements •as defined in the authorized Change Order.
