Shoemaker George Norwood AN ORDINANCE PROVIDING FOR THE ESTAB- LISI IMENT OF THE PLANNING. COM IISSION; REPEALING ORDINANCES NO.. 121 N.C.S., 261 N..C.S., AND 315 N.C.S. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUTvIAA AS FOLLOWS: Section to Establishment of a Planning Commission. A - Planning Commission consisting of seven (7) members is hereby established for this City. The members of said Planning Com- mission shall includes (1) Albert J. Bigelow, member of the City Council, who shall serve until. June 30, 1954, and until his successor is appointed by the City Council and qualifies. (2) George Dickerson, selected to serve until June 30, 1957, and until his successor is appointed by the City Council and qualifies. (3) Everett'A. Matzen, selected to serve until June 30, 195.7, and until his successor is appointed by the City Council and qualifies. (4) Harold Seiler, selected to serve until June 30, and until his successor is appointed by the City Council and qualifies. (5) Phil Talamantes, selected to serve until June 30, 1955, and until his successor is appointed by the City Council and qualifies. (6) Stanley Forster, selected to serve until June 30, 1955, . and until his successor is appointed by the City Council and qualifies. ('7) An additional member to be selected by resolution of the City :Council, to serve until June 30, 1955. Section 2. Qualifications and Appointment of Members. One- of the members of said Commission shall be a member of, and selected'by, the City Council. The remaining members of said Commission shall be appointed by the City Council, and must have resided in the City of Petaluma not less than one (1) year prior t °o 'their appointment. ,�: j _ l Section 3. Terms of Office. The member of said Commission selected from the City Council shall serve until the 30th day of June, after his appointment and until his successor "is appointed and qualifies, or until he ceases to be a member of the City Council, which ever occurs first. Terms of office for each of the other members of said Commission hereafter appointed shall be four years, saviing'and excepting the members to be appointed hereunder for said term ending June 30, 1957. . Section 4. Vacancies Upon the death, resignation, disability to perform the duties of a member of the Commission, or upon a permanent departure from this City, or upon the failure to attend any meetings of the Commission for ten (10) consecutive weeks, the Council shall declare the office of such member vacant and thereupon appoint some qualified person to fill such vacancy for the unexpired term of such member. .Section 5. Duties of Planning Commission. The Planning Commission shall perform the duties prescribed in the present or any future zoning ordinance or subdivision of this City or any similar ordinance, statute, rule or regulation of the State of California, County of Sonoma, .or this City pertain- ing to the districting or zoning or dividing the City into districts or zones and the construction of improve- ments, the use, division or subdivision of property within this City,' Said Planning Commission shall also have the duty of studying the needs of this City with respect to and advise.and recommend to the Council concerning the establishment, modifica- tions and change of zones or districts and designations of the uses to which property contained therein may be prohibited, restricted and regulated. Said Commission shall also have , and perform the powers and duties hereafter designated and- delegated by the City Council. not have right to employ any persons or incur any expenses or obligations against the City, except as provided by and for which.appropriations are made by the City Council pursuant to and in accordance with budgets adopted by the City Council. Section 7, Repeal of Other Ordinances. Ordinance Noe 121 N.C.S., 261 N.C.S., 315 N.C.S., and all ordinances in conflict with this ordinance are hereby repealed. Rules and Regulations of the Planning Commission® The Planning Commission shall have the right and duty to adopt such rules and regulations as it shall determine for the holding and conducting of its meetings and hearings and the selection of its officers and for t'he performance of any of its functions or responsibilities. Said Commission shall not have right to employ any persons or incur any expenses or obligations against the City, except as provided by and for which.appropriations are made by the City Council pursuant to and in accordance with budgets adopted by the City Council.
