LOCATED ON MAGNOLIA, AVENUE; SAMUEL; DRIVE AND GOSSAGE AVENUE.
EXECUTIVE SUMMARY Magnolia Place is a 44 -lot subdivision on Magnolia Avenue, Samuel Drive and
Gossage Avenue. The'Subdivision.received tentative map approval;on February 24, 2003. The final map
and 'improvement °plans were submitted to the Community Development Department and at least one
review has beenr completed'. The developer is requesting permission to commence grading activity on the
subdivision site prior to final map approval
2': BACKGROUND The developer; O'Brien Group is requestingpermission to commence grading activity
on the subdivision site prior.to final map approval. The final map and improvement plans are currently
under review by the Community Development Department.
According to section 20.36.010 of the Petaluma.Municipal Code, no permanent improvement work shall
be commenced until improvement plans and ofHesshave been approved P. r roved by the City Engineer and a
subdivision improvement contract has been executed in writing between the subdivider and the City.
Grading' is not considered a permanent, improvement as defined in this section.
The .City does require the developer to enter into a.grading agreement and provide a surety to secure the
performance of the grading work.
If the subdivider fails to secure final map approval, or the project is, abandoned after the grading is
complete, the subdivider agrees to restore the area graded to its prior condition as stated in the grading
agreement.
Condition of Approval #18' for the Magnolia Place Vesting Tentative -`Map required a final Soils
Investigation and- Geotechnical Report to be prepared by a registered professional civil engineer. The
soils report was to address site- specific 'soil conditions and Iinclude recommendations for site preparation
and grading. During the investigation for the January 27, 2004 geotechnical report prepared by Stevens,
Ferrone & Bailey, it determined.that 1.5 'to 13 feet of non - engineered fill existed on a
majority of the Gossage .Avenue project site. The engineers advised that if the proposed site,
improvements and building foundations were constructed on, the non - engineered fill, it could result in
damaging differential settlements at the ground surface. Therefore, the engineers determined it would be
necessary o remove the no
y n engineered fill to the native undisturbed soils, clean it of debris and replace
it as compacted, engineered fill. This Would require the removal of nearly all of the trees along the north
and south boundary of the Gossage Avenue site, most of which are blue gum eucalyptus.
The developer has also advised that the type of soil on Magnolia Avenue site mandated that that they
create a larger wetland mitigation area than previously anticipated to ensure that they meet the 2:1
wetland mitigation, required.'by' the Army Corps of Engineers and the Regional Water Quality Control
Board. This will require the removal:of additional eucalyptus trees and the relocation of several live oak
trees.
A Tree Assessment Report, prepared by Ralph Osterling & Associates dated: December 21, 200'1, was used,_
in the preparation of the Initial Study of Environmental Impacts for the development. At that time, th0
arbon'st concluded that 70 trees would be required to be removed and another 83 trees would be
impacted. Based on'the new information above, a revised Tree Assessment Report by Ralph Osterling &
Associates dated June 2, 2004, was'submitted which evaluated the project's impacts to trees. It was
found that a total of '142 out of the 445 trees on the two parcels would now have to be removed. Of these
142 `trees, 126 are non- indigenous to the Petaluma area. Another 3.4 trees, 33 of which are native coast
live oaks, will be impacted by the development. The arborist has; also noted. that numerous blue gum
eucalyptus. have originated from stump sprouts and while they may have good to excellent condition
ratings care :should be taken when , siting a home within striking distance of these trees because of the
generally weak attachment of the sprout to the stump from which it originated. Therefore; :in addition to
the need to,-remove the eucalyptus for.soil recompaction, the arborist agrees that it'would be. prudent to
remove the trees on. the. Gossage site and - replace them with native oaks or other desirable landscape
trees that are of appropriate size and character for residential backyards.
The mitigation measure imposed at the, time of environmental review required a replacement ratio of
3.2:1. Therefore; in order to .mitigate the, removal of -14f trees, 454 native trees will be planted on site.
Staff has carefully reviewed: the, applicant's conceptual Tree Mitigation.,Plan that demonstrates which
trees will remain, which will be removed,. which trees intended to be relocated and the locations and
species of replacement trees. The final landscape plan, which .must concur-, with the conceptual. Tree
Mitigation Plan, will be approved by the Site Plan and Architectural Review Committee ( SPARC). The
original. Tree- Assessment did not include any relocation of trees; the ,applicant now intends , to relocate
42 6" to 12" diameter live oak trees. The. trees suitable for relocation will be stored, in. a:nursery area on
the.Magnolia Avenue site just south of lot;27. These trees will be replanted within the development:afte�
home construction is complete. Staff has concluded that replanting with native species at `the.'required
ratio would reducelthe impact of the tree - removal to a level of insignificance.
Tentative Map .condition of approval #8 required SPARC. approval of the project prior to, issuance of any
grading or building permits. 'The project is scheduled for the June 24 SPARC meeting: 'The' Council may
allow :issuance of a grading. permit and defer the SPARC approval to prior to . issuance of building
permits..
3. ALTERNATIVES Deny permission to grade the subdivision site prior to final map approval. A denial will
delay the grading activity and push the schedule later into the construction season.
4. FINANCIAL, IMPACTS N/A
5. CONCLUSION The Community Development Department takes no exception to the request for grading
prior to final reap approval.

authorizing the developer, O'Brien to commence grading activities on the Magnolia Place

and securing the standard grading agreement.
