MAKING APPLICATION `f0 TFIE LOCAL AGENCY FORMATION COMMISSION
(LAFCO) TO INITIATE PROCEEDINGS FOR
REORGANIZATION OP A 50 ACRE PORTION OF CER`T'AIN PROPERTY
KNOWN AS CROSS CREEK SUBDIVISION,
ASSESSORS PARCEL NUMBER 017-050-001
PURSUANT TO THE CORTESE/KNOX
LOCAL GOVERNMENT REORGANI"CATION ACT OF 1985
WFIEREAS, after considerable public review and input, the City Council adopted under
Resolution No. 96-178 N.C.S., the Mitigated Negative Declaration for the Cross Creek
Subdivision; and
WHEREAS. in order to implement the project, it is necessary to annex a portion of
certain property known as Assessor's Parcel Number 017-050-001;
NOW TFIEREFORE BE IT RESOLVED that pursuant to the Municipal Organization
Act (Government Code 35000 et. seq.) the Petaluma City Council hereby makes
application to the Local Agency Formation Commission of Sonoma County for a
proposed reorganization as follows:
An Annexation of a portion of territory known as Assessor's Parcel Number 017-
050-001 to the corporate boundaries. of the City of Petaluma;
Said territory is developed with a single residence and associated outbuildings,
and is comprised of approximately 50 acres, as described more completely in
Exhibit A (legal description and map).
BE IT FURTI-TER RESOLVED that the reasons for the requested reorganization are:
The property is contiguous to [he City and is within the adopted Sphere of
Influence and General Plan Urban Limit Line of the City of Petaluma.
2. The City has completed an extensive environmental review process for the area
culminating in the approval of a Mitigated Negative Declaration.
3. The owner of said property has initiated said annexation.
4. By Ordinance No. 2025 N.C.S.. the City of Petaluma has prezoned the affected 50
acre portion of the property to the Planned Unit Development (PUD) District.

2 5. This annexation is consistent with the objectives and policies of the General Plan,
3 , as documented elsewhere in the Mitigated Negative Declaration and General PIan
4 Amendment for the Cross Creek Subdivision.
6 6. This annexation will enable several provisions of the General Plan to be achieved,
7 including those pertaining to preservation and enhancement of the City's open
8 space system, protection of the Petaluma Airport and coordination of land uses
9 within the airport Inner Approach. Zone; and ensuring long term compatibility
10 with agricultural uses on unincorporated property beyond the Urban Limit Line.

12 BE IT FURTHER RESOLVED that the requirements of the California Environmental
13 Quality Act (CEQA) and its Guidelines have been satisfied and are thoroughly addressed
14 in the Mitigated Negative Declaration adopted by City Council Resolution No. 96-178
15 N.C.S., on July 1, 1996 and incorporated herein by reference.

17 The City Clerk is hereby authorized and directed~to file a certified copy of this resolution
18 with the Executive Officer of the Sonoma County Local Agency Formation Commission.
