4 APPROVAL OF THE PLANNED UN[T DISTRICT UNIT DEVELOPMENT PLAN
5 FOR THE PAMELA PLACE II RESIDENTIAL PROJECT LOCATED ON A 4.98
6 ACREPARCEL AT 901 AND 911 SUNNY SLOPE ROAD, AP No.'s 0.19-201-010,
7 011, 012, 017, and 018

9 WHEREAS, the project site has been rezoned to Planned Unit District by Ordinance No.
to 2027 N.C.S.; and,

12 WHEREAS, the Planning Commission of the City of Petaluma held a noticed public
i3 hearings on June 25, 1996 and July 9, 1996 on the subject application, heard testimony
14 and concluded that the findings and conditions for the project were adequate and
i 5 recommended to the City Council approval of the proposed development; and

t7 WHEREAS, The City Council has found that the requirements of the California
i 8 Environmental Quality Act have been satisfied through the preparation of an Initial Study
t9 which indicates that the proposed amendment, as mitigated through the adoption of a
20 Mitigated Negative Declaration pursuant to Resolution No. g6-243 N.C.S. will not
21 result in a significant impact on the environment, and that no further environmental
22 review is necessary; and,

24 WHEREAS, the City Council has adopted Ordinance No. 2027 N.C.S. rezoning the
25 Pamela Place II site to project specif c Planned Unit District.

27 NOW THEREFORE, BE IT RESOLVED that The City Council hereby conditionally
28' approves the Planned Unit Development Plan as reflected in the Development Plan
29 including: architecture, landscaping, and written development standards considered by
30 the Planning Commission on June 25, 1996 and July 9, 1996; all on file with the City of
31 Petaluma planning Department, pursuant to Section 19A-504 of the Toning ordinance.
32 1072 N.C.S., as amended, based on the following findings and subject to the following
33 conditions:

35 Findings for Approval of the PUD Development Plan and Standards
36 1. The City Council finds that the proposed Pamela Place II PUD District is on property
37 which has suitable relationship and access to one or more thoroughfares (Sunny Slope
38 Road, "I" and "D" Streets), and pursuant to the analysis in the FEIR and subsequent
39 improvements, thesethoroughfares are adequate to carry any additional traffic generated
a0 by the development.
41 2. The City Council tnds that the proposed Pamela Place II development presents a
42 unified and organized arrangement of buildings consistent with the buildings in the
43 surrounding neighborhood and that the facilities serving the proposed development are
a4 appropriate in relation to adjacent or nearby properties. The Planning Commission also
a5 fnds that the development proposes adequate landscaping and screening ensuring
46 compatibility with surrounding uses.

t 3. The City Council finds that the location of the proposed uses on the flatter portion of the
2 site preserves and protects [he natural and scenic qualities of the site. The Planning
3 , Commission further finds that adequate available public and private spaces are
4 designated on the PUD Development Plan.
5 4. The City Cotmcil finds that the development of Pamela Place 11 in the manner proposed
6 and as conditioned: 1) will not be detrimental to the public welfare as all potentially
7 significant enviromnental impacts have been reduced to a level of insignificance
8 according to the June 4, 1996 Initial Study; 2) will be in the best interests of the City;
9 and 3) will be in keeping with the general intent and spirit of the zoning regulations of
10 the City of Petaluma and with the Petaluma General as was determined upon the
t t certification of the Sunny Slope FEIR and Annexation.

14 Planned Unit Development Conditions:

16 1. The PUD Development Plan (Site Plan), the PUD Landscaping and Fencing Plan, and
t7 the Development Guidelines shall be amended according to the conditions of
]8 approval contained herein and reviewed and approved by SPARC prior to Final Map
19 approval.

2t 2. A full scale reproducible copy of the PUD Development Plan, Landscaping and
22 Fencing Plan and a final copy of the Development Guidelines as approved by SPARC
29 shall be submitted to the Planning Department prior to approval of the Final Map.

25 3. Prior to the issuance of any building permits for a home within the Pamela Place II
26 PUD, the developer shall first apply for, and receive Administrative SPARC approval
27 of the proposed home design for Lots 5, 6, 7, 8 and 9.
28 4. The PUD Development Guidelines shall be amended to 1) establish a minimum rear
29 yard setback of 35 feet for Lots 1, 2 and 3 and a 30 foot rear setback for Lot 4, and
3o require a minimum 15 foot front setback measured from the edge of right-of--way for
31 all Lots; 2) require full SPARC review/approval of home construction proposed for
32 Lots ] -4. SPARC review shall emphasize appropriate massing, design and measures
33 to reduce/avoid privacy impacts to adjacent homes.
34 5. The CC&R's recorded with the Final Map shall include a requirement that all
35 landscaping in the right-of--way adjacent to each lot within this subdivision shall be
36 maintained by the firture property owner.
