3 Jeff Mayne, Petaluma, addressed the City Council regarding TOT funding and
4 commented on the various events that take place in the downtown that'.benefit from
5 that funding.

7 CITY COUNCIL COMMENT
9 , IMayor Glass indicated he is an advocate for TOT funds going to the General fund to
10 provide.services that, are essential to running the: City. He indicated ,he would, like to: try 'to.
1 get the community to band together and support their own and to support the Cinnabar
12 Theatre. He concluded by explaining the Fire and Police Union contracts and their
13 implications on the ,budget.

15 Council Member Healy stated he is optimistic that after the November election he is
16 hopeful that local governments' will have constitutional protections in the State of
17 California. He pointed out there is at least one and possibly a second measure that
18 voters will have the opportunity to support that will stop the raids on local government
19 finance s° by the State of` California. He continued by explaining that the TOT funds ;from
20 the Sheraton come into the General Fund. The loansi that go back are- out, of the
21 Redevelopment .Agency,. None of those funds would be available to support the groups
22 that the audience: represents., He stressed and wanted - to make sure that the groups that
23 have ,been funded over the, years can survive and are around for the next year when
24 things hopefully get better... As people come forward to speak, he. asked that ;they'
25 explain what their group would need to sui=vi've over the .next couple of years so as to be
26 in a ,position to ramp back up to .where you, want to be in the future. He concluded by
27 stating he is not. certain ,the Council will come to closure ,on this issue tonight because
28 there are still some moving pieces in Sacramento but there should be more information
29 in the next week. The community, howeve�r will have a greater indication of what the
30 Council is`trying to achieve.

32 Council Member Tor, liatt indicated one of the things the Council'has try to focus on
33 year after year in a TOT policy when funds are given, . is trying to encourage these
34 organizations' to try.. to'become self- supporting and to rely less on TOT funds., She stressed
35 the need to actively work on marketing programs. She noted th'e Mayor has been doing
36 some outreach to t ry to get corporate sponsorship for the Cinnabar. She supported using
,37 the current fund balance and commented on the possibility of using some
38 Redevelopment 'Agency monies, but those would be required to be used for very
39 specific projects.

41 Vice Mayor Moynihan commented - on the good job the Vis'itor's Program has done in
42 supporting' non -pro- fits. He continued by commenting on the budget increases., due to
43 increased compensation costs and suggested that if the City didn't do that they could
44 possibly fund more* things. He pointed out it is up to' the City Council to make= those
45 decisions and stated he hopes the Council has the fortitude to implement that in orderto
46 tend to the community's.needs.

48 Council Member'Torliatt commented that she had attended the life celebration at the
49 Phoenix Theater honoring the late Gene Ruggles.

In :conclusion, Council Member Torliatt remarked that the, Council had received. a letter
from the City Schools requesting a joint meeting in early October to discuss issues of
mutual concern. She indicated her support for setting that meeting.
Council Member Harris reported on having attended the Planning Commission. Meeting
where the recommendation for the adaptive reuse and revitalization of 331 Keller Street
was discussed. ln,.addition, the Plan ning;'Commission also passed, unanimously, the
Riverview Subdivision at McN'ear and Mission Drive.

A. Continuation : of Discussions and Overview of Proposed FY 2004 -.2005 Budget to
'include presentations by the following public safety departments:
4. - Transient Occupancy Tax (TOT)
Public Input Regarding TOT Fundine
Mary Regan, Cinnabar Theatre, addressed the City,Council in support for
TOT funding for the Cinnabar Theatre; indicating it is a community theatre.
Jared Emerson- Johnson, Petaluma,.addressed the City Council in support
-of the Cinnabar Theatre, citing it as a very.professional organization.
Richard Jencks, Mill Valley, addressed the City Council in support of the
Cinnabar Theatre and urged , the Council to continue their support of TOT
= funding.
Grace. Wick, Cinnabar Theatre, addressed the City Council in support of
Cinnabar and in support of'kids.:. .
Jeffrey Weissman, Petaluma, addressed the City Council as an entertainer
dt Cinnabar and urged continued' funding.
Michael Hansen, Petaluma, addressed the City Council in support of the
Cinnabar Theatre.
Lisa Eldredge, Cinnabar Theatre, addressed the City Council in support of
continued funding for the Cinnabar Theatre.
Dick Kapash, Petal uma;.:addressed the City Council as President of the
E3oard of: Directors of Cinnabar and urged continued support.
Marcy Telles, 'San Rafael, addressed the City Council in support of the
"Cinnabar and noted they are doing everything possible to support them.
She pointed out that Cinnabar hasa national reputation.

Subcommittee to work that out.

Council Member Harris commented on the exciting things going on in the
26
downtown. He commented. on the potential capture.;of tourist dollars and
27
suggested the continued funding of,;the Visitors Bureau at a reduced
28
amount.. He added that all `the programs bring visitors to Petaluma and he
29
would support.. a TOT Subcommittee to discuss. distribution of funds.

Council Member Healy commented that the testimony this evening has
32
been impressive. He recognized programs are competing against each
33
other for the needed TOT funds: He, noted there has to be some real
34
connection to the redevelopment area to use Redevelopment Agency
35
funds. H'e, too, supported a TOT Subcommittee.

v Vice ,M y y i d the TOT tax is not really a -tax on the

hotels aiss actually the hotel g ests that are paying the tax and they
39
should be provided a service "for that payment. He indicated he does
40
believe in the multiplier effect and doesn't feel it would be good to cut
41
fle ;funding for the 'Petaluma Visitors Program. He, added the Petaluma
42
Visitors Program needs to work collectively to fund the non- profits and
43
stated PCDC funds should not be used. He indicated if it is determined the
44
use of 'Redevelopment - Agency-funds is legal, perhaps they could be
45
used. He ,expressed future funding should be consistent and the Council
46
should stick with pro moting- ;Petaluma-. He indicated he is not comfortable
47
using public funds to fund non - profits and that the public should support
48
ones of their choice.

Mayor Glass reiterated the :Council's obligation regarding Police and Fire
• 51 contracts, negotiations and possible arbitration proceedings.

City Manager Bierman confirmed that the Council TOT Subcommittee
would have 'approximately $400,000 to appropriate in a lump sum, or to
various programs as they see fit.
Council Member 'Healy supported the Subcommittee concept and
indicated the City Attorney should determine at what level the Council
might possibly use Redevelopment Agency funds.
Vice Mayor Moynihan repeated his desire to have a discussion regarding
a compensation policy as some additional programs. could 'be funded if
other expenditures were reduced.
City Manager Bierman clarified he could make available to the TOT
Subcommittee approximately $350,000 to $400,000 to consider for
funding of programs.

Continuation' of Budget Discussion:

City Manager Bierman gave an overview of the proposed departmental
budget.
Vice Mayor Moynihan requested .clarification as to why Administrative
Services is picking up oversight of 'the Airport 8, Transit Operations.
City Manager Bierman responded the Director of Administrative Services
would only be monitoring those contracts.
Animal- Services
Nancee Tavares, .Animal Services Manager, gave an overview of the
departmental budget.
City Council :discussion centered on ;use of volunteers and, it was noted
that the pledge for offsetting costs for the new facility still has about
"$34,000 outstanding.
Vice Mayor Moynihan asked for a breakout of revenue sources and a
variance report.
3. General Plan
Pamela 'Tuft, Director of General Plan Administration, gave an overview of
the proposed budget. It was noted that they hope to have the General
Plan to the City Council for consideration in Iate.July.
Vice Mayor Moynihan commented on the reduction in the budget and
how that° might impact the ability to deliver. the General Plan as noted.
Staff responded the budget reflects encumbered contracts, He

continued ;;by asking for a variance .report, and commented on the
continuation to burden the. Parks and Recreation Department with
maintenance costs 'for capital improvements that' have no additional
funding for maintenance.
Council Member Torliatt noted the Recreation, Music and Parks
Commission would be reviewing the budget and would hopefully report
to the Council any concerns they might have.
Vice Mayor Moynihan pointed out the importance of reviewing all park
projects, side -by -side; to allow the , community to prioritize, as they are not
being presented consistently in CIP projects.
Council Member Torliatt indicated the Recreation, Music and Parks
Commission should look at all of those projects that are coming forward.
