CENT SALES TAX MEASURE FOR NOVEMBER BALLOT
1. EXECUTIVE SUMMARY The -Sonoma County Transportation Authority (SCTA) has
adopted the draft 2,004 Comprehensive Transportation Plan (CTP) that sets forth projects
throughout the County and the cities that are required to reduce traffic congestion and
maintain the existing transportation system. The 2004 CTP,look& at. all. modes of
transportation (i.e:. local roads, state highways, bike and.pedestrian routes, local transit
service, passenger rail service, ,etc:) and identifies a severe deficit in available
transportation funding to meet the needs of all modes. In order'to meet a portion of this
need, the SCTA has determined. a local revenue! source is necessary to leverage state and
federal -funding. Becoming a "sel_f .help" ,county will allow, more projects, to be delivered
in a timely fashion and will'minimize'the impacts of the state budget crisis.
2. BAcxGROUND The determination that a local revenue source is needed coincided with
• several other actions. In 20,02, the SCTA endorsed a plan by the Sonoma -Marin Area Rail
Transit Commission (SMART) to legislatively create a,two- county rail district and
ultimately pursue a quarter =cent transactions and use tax measure for passenger'rai_t
transit. The expectation was that SMART would place a tax measure on the ballot in-
Sonoma and Marin Counties in November 2004. Earlier this .year; Marin County r
indicated it was pursuing a separate tax measure in November for local transportation
needs. At SMART s June 2004 meeting, the SMART:Board of Directors unable to
go forward with a Arans4ctioifg. and 'use tax measure in November 2004. At.that same
meeting, the SMART Board of Directors indicated that they would pursue a quarter -cent
tax measure for the rail project: in 2006'
In'response to the SMART decision the SCTA directed staff to prepare a draft
expenditure plan for a quarter cent retail transactions and use tax measure to fund local
transporiation projects, such as local street and road.mairitenance, wrdening Highway
101, increasing, local bus service, improving bike and °pedestrian facilities, and
completing the initial" steps for the development of passenger -rail service.
The proposed. SCTA:measure, entitled "Traffic Relief Act for Sonoma. County," would be
,'laced on'the N6vember'20'04 ballot as the first phase of a ;two -phase funding plan for
transportation. The second phase would be the 2006 transactions and use tax ballot
measure by SMART, devoted exclusively to fully funding passenger rail needs..
The SCTA believes the Traffic Relief Act for Sonoma County. is;needed in order to
address severa ' issues to maintenance of the existing transportation system, traffic
relief and safely-
There is a burgeoning need for funds -to fix potholes and maintain local streets and roads
in the cities and the unincorporated area. Unfortunately, state .and federal funds can only
cover a portion, of that need. The Traffic Relief Act for Sonoma County would add an
estimated $90 million in funding to the state and federal funds- and.give_ci ties and the,
County a reliable source of funding to help, secure other grants: These funds will help
prevent further. erosion of the existing . roadway system and in many instances .bicycle
lanes will be `incorporated into the roadway projects.
The Traffic Relief Act for °Sonoma County also proposes to use approximately $90,
million in, transactions and use tax revenues for corridor improvement projects acid traffic
.congestion relief projects on the local roadways.; These projects will.require state or local
matching funds from the cities and County but.without funding from a local transactions
and use, tax measure, these projects would not be possible to `build - for, decades.
Funding for Highway 101 is an important „element of the Traffic Relief Act for Sonoma
County as California's economic crisis and the resulting state, budget cuts have delayed
delivery of Hwy 101 widening by at least 3 to 5 years:-'In addrhon,, the state is using
GARVEE bonds for a greater number of projects statewide and that could reduce
Sonoma County's ability to use that funding tool,to build two key:segments on Highway.
101. Given the financial situation of the state, without a transactions and use tax
measure; Highway 1 01, widenmg.from'Petaluma'to Windsor will not be:corripleted by
2010 as proposed in the' 2010 Construction Plan. `
Becoming a self -help county will allow`the SCTA and'its member
leverage other funds sources and enable prof ects `to step to the head of the line for state
funds. With local funds available project sponsors, can provide match money and the
'state then sees ; larger projects and greater benefits using fewer. state dollars. Without
local funds, Sonoma County ata disadvantageaand projects can be further delayed._
Having.adequate local dollars to,pay for 50 60 of the�Higlway 101 wideningwill allow
local control over delivery and get projects- built'earlier.
Passenger rail in Sonoma and Marin Counties will. require a '/4 cent transactions and use
tax `in the two counties in ,order,to fully fund the project. It is anticipated the SMART
Board of'Directors will pursue such a tax on the 2006 ballot. Under the proposed
expenditure plan by the SCTA, the interim funding will be provided',to accelerate the
delivery of the projectland match $17M instate,funding that will otherwise'expire in
201,0. These funds will be used to fina. lize the environmental document including public
outreachcomplete,fnal ed ineering line,. improveraificrossings.on local,
roads and assist in station site development. Overall, these funds will help to keep the
project moving forward 'and. on schedule.

Local tra nsit roviders have been facing cuts in service since 2002. The proposed

expenditure plan, will restore service and provide enhanced services via express bus
routes„ senior ;..and�disabled,servi'ces, shuttle connections to the future rail project and`•
other transit opportunities that may arise.
The SCTA projects that approximately $20 million will be available for bike and
pedestrian paths. over the next twenty years given existing, funding sources. ' Traffic
Relief Act for Sonoma County proposes to add $19 million for projects: throughout the
county that are focused on increasing overall safety, closing, gaps in pathways and
enhancing safe routes to.schools and. transit.
It, is. anticipated, that bonds will be used to accelerate the rail and Highway 101 elements"
of the plan but `bonding costs will be accounted for within the percentage allotted to each
mode category.
State law governing local transportation authorities requires. 'a.majority of the cities
representing a majority of the; population in the incorporated area of the county and the
Board of Supervisors to approve the draft expenditure plan prior to its final adoption by
SCTA. The proposed plan's incorporated in the attached resolution.

WHE'REAS', pursuant to California Public Utilities; Code sections 180000 et. seq., the
Sonoma County Transportation Authority proposes to. impose a quarter =cent retail transactions
and use tax for a.period_ not to exceed twenty (20) years to fund transportation improvements
within S'onoma,County; and
WHEREAS, Public Utilities Code sections, 180201 and 180206 require a local,
transportation authori to ado t a transporta p y p � p ion expenditure plan for the expenditure of the
revenues expected to ,be: ,derived from. the tax;, and
WHEREAS, Public.:Utilities Code section 180205 requires the local transportation
authority to obtain approval of the :expenditure plan from a.majority of the cities representing a
majority of the incorporated population "within the county 'and 'ffom the Board of Supervisors
prior to the authority's adoption of the plan; and
WHEREAS-, the Sonoma County Transportation Authority has approved a draft
expenditure plan entitled "Traffic Relief Act for Sonoma County " attached hereto as Exhibit
A; and .
WHEREAS, the Traff c'Relief Act for Sonoma- County was developed with input from
the Transportation Authority's Citizens Advisory Committee, Technical Advisory Committee,
Countywide Bicycle Advisory Committee, transit operators, cities and the county us well as from
the public and the SCTA's approved 2004 Comprehensive Transportation Plan; and
WHEREAS, ,the Traffic - Relief Act For Sonoma County is the first of a two phase
funding plan for`transportation,that will ultimately include`a two - county retail transactions and
use tax measure to fully fund passenger rail service in Mar-in and Sonoma Counties to be
imposed by the Sonoma= Marin Rail Transit District (SMART) ;_and
_.WHEREAS, the Traffic Relief Act for - Sonoma County consists of programs and
projects that are, essential to the movement of people and goods throughout Sonoma County and-
will provide critical assistance in solving traffic congestion problems inS'onoma County as well
as alleviating backlogs' of local road maintenance.
NOW, THEREFORE, BE IT RESOLVED that the City Council for ".the City:of
Petaluma,hereb_y approves the Traffic Relief Act T& Sonoma County; and
BE IT FURTHER RESOLVED that the City Council for the City of Petaluma
recommends that, upon.the'Sonoma'County Transportation Authority's request, the Sonoma
County Board of':Supervisors place a measure on the November 2004 ballot to authorize the .
imposition. and: collection of a one quarter of one percent (' /e of I%) .retail'transactions and use
tax fora period:not to exceed°iwenty (20) years to fund the programs bind projects described in

II. EXPENDITURE PLAN SUMMARY
Traffic Relief Act:for Sonoma County
The Traffic ,Relief ,Act for Sonoma County provides for investment in three program
categories.. Each program category will receive a `percentage< share of sales tax revenues,
currently estimated at $470 million (in 2004 dollars) over a. 20 =year period.

Description section of this document. A summary chart with projects and programs is
attached, to this plan as.Appendix A:
Oversight and Administration
The implementation of the Traffic.Relief Act for Sonoma County will be the responsibility
of the Sonoma County 'Transportation Authority. The SCTA : is composed of twelve.
elected officials: a representative from.each.of the nine citmes in, Sonoma County and three
members of the Sonoma County Board of Supervisors.
The SCTA will be responsible for developing and updating a ,strategic plan, to guide
allocation decisions and project delivery. The SCTA will develop the initial strategic plan
by July 1, 2005, and prepare and update it at least every .five; years. during the ,term of the
plan.
The Citizens Advisory, Committee established under the original ordinance that created
the SCTA will serve as an, independent oversight body ,that will advise the SCTA on the
administration of the Traffic Relief Act for Sonoma "County and report to the public via
annual audits of the Act.
The SCTA will work closely and cooperatively with the California Department of
Transportation (Caltrans) and the Metropolitan Transportation' Commission (MTC) on
programming state and - federal ,grants to match funding from, the Traffic Relief Act :for
Sonoma County for programs and projects. These partnerships will help to maximize the
state and federal funds that can be, leveraged with alocal source of funds and to deliver
projects in a timely manner:

Authority. The 2004 - Comprehensive 'Transportation. Plan. identifies. g gals
related to the movement of people and goods'tlrough the: improvement- and maintenance
of all modes of transportation. These goals are further supported by specific objectives.for
different geographic areas of the County. These. -goals and objectives, are reflective, of
public feedback heard iii, workshops and at outreach events throughout tl'e :county_
Taken together; these goals and objectives create the strategy 'through which Soriorna
County. can shape, 'its transportation future. A complete list of. the. `goals' and objectives is
attached to this plan las Appendix B.
IV. PROJECT DESCRIPTIONS
The Traffic. Relief Act for Sonoma •County has three program g

divided into specific projects. The expenditure pla .calls for a specific percentage of
revenue to be allocated to each of thet categories and the funding then distributed to the
proposed list of projects.,T'he lists below do not.reflect priority order..
A. Local Streets &,Roads. — Pothole Repair & Cbngestion `Relief
Fixing_ potholes and maintaining local, streets and roads is a. central focus of the
Traffic Relief Act for. Sonoma County Approximately $94. million ;(or 20% of the
sales tax revenue) will be used by cities and the County to fix existing roads and.
keep them maintained. All projects will. take into consideration bicycle and
pedestrian needs, 'traffic calming, intelligent trari"sportation. system technology. and
system implementation, and appropriate safety. measures. These components of a
road project are" eligible for sales tax revenue. Below is a ;chart that, shows how
much each jurisdiction can anticipate receiving from the Traffic Relief Act for
Sonoma County.

In addition to maintaining" local roads the Traffic Relief Act for Sonoma County
will Provide approximately-'$94 million (or 20% of the sales tax revenue) for traffic
congestion relief projects. The following projects "have been identified as high
priority 'needs; but they -are not listed in priority -or . projects All of these "ects will

require - environmental review, engineering and Patching funds before .they can be

The Sonoma - Marin Area Rail Transit District (SMART) will use approximately $23
million (or 5 % of the .sales tax revenue) to complete ,initial steps that will accelerate.
the .development of: passenger rail service for Sonoma and Marin Counties. The
work will include obtaining final environmental clearance,. final engineering, grade
crossing improvements on ;local roadways and station site development in Sonoma
County. These funds will..be. available to SMART in the first three .years of
the sales tax to allow .SMART to continue to ;move forward on the project, in
anticipation of a SMART District ballot measure in 2006 that will provide full
funding for the operation of rail service.
Approximately $19 million (or 4 % of the sales tax, revenue)' will be used to build
new bicycle and pedestrian routes that will inchMse,.overall safety; close gaps in
existing routes .and provide safe, routes to schools, and to' transit. Bike safety

V: IMPLEMENTATION GUIDELINES
A. The duration of the tax will be 20 years, beginning on April 1 2005 and
expiring "on March 31, 20,25.
B. Environmental reporting; review and approval; procedures as provided for
under the National Environmental„ Policy _Act, the California Environmental
Quality Act; onother applicable laws will be adhered to as a prerequisite to
the implementation of any project
C.. Use of the retail transactions and. use tax under this Transportation
Expenditure Plan will be subject to`the following, restrictions!
1. The tax proceeds must be spent for the purposes' of funding the
transportation programs and projects a_s of lowed in the Traffic Relief Act
for-,'Son'oma County and may not be used, for other purposes.
2. - Consistent with California Public Utilities Code, _ Section 180200, the
SCTA i
mend's that the additional funds: prodded "governmental. agencies
by the Traffic Relief Act for Sonoma County shall supplement existing,
local revenues, being used for public, transportation purposes and that
local jurisdictions maintain their existing commitment of local funds for
transportation purposes.
11 The SCTA is charged with a fiduciary duty in administering the tax
proceeds in accordance with the applicable laws and this Traffic Relief

Act .for- Sonoma County. Receipt of tax proceeds may be subject, to
appropriate terms and ;conditions as determined, by the SCTA in its
,reasonable discretion, including, but not limited to, the right to require
recipients to execute funding agreements and the right to audit.

D. Actual 'tax proceeds may be higher or :lower than estimated in this. Traffic
Relief : Act for Sonoma County over the 20 -year term. The Traffic Relief: Act.
for Sonoma County expenditure. plan is .based_ on the percentage
distributions to each Program Category and Project and the dollar values
included are estimates only. Actual tax proceeds . will be programmed
annually in' -accordance, with the percentage distributions. in the Traffic
Relief Act for Sonoma County expenditure plan.
E. The Sonoma County Transportation Authority will prepare a Strategic Plan
prior to, July 1, .2005; which will 'identify _funding: prior- ifzation cr- iteria.
consistent with the goals .and objectives of the .Comprehensive Transportation
Plan ;developed . by the SCTA and. periodically updated, and the Traffic.
Relief Act for Sonoma County expenditure plan. The Strategic' `Plan will.
include, general procedures ,for' project sponsors to 'initiate a: project and
identify an implementation schedule and the: programming of funds for
each listed, project. The: Strateg "ic Plan will include the evaluation criteria, for
prioritization of projects and fo"r reallocation of tax proceeds that become
avalable to Section V F below.. The Strategic Plan Will be.:updated
at'least every five years, during the term of the Traffic Relief' Act for Sonoma
County.
F. The ability to fully fund or complete all programs or projects in this Traffic
Relief Act 'for Sonoma, County expenditure plan may be impacted by
changing circumstances over the duration, of the `tax. Tax, proceeds
originally allocated to a listed project may become available. for 'reallocation
due to'any the:following _reasons:
1:1 A. listed project is completed under budget;
2 A listed project is partially.or.fully funded by funding sources other
than fax proceeds;
3. A ,meets sponsor and implementing project p p. g 'agency request. 'deletion of a
listed "project because of`unavailabilty of matching funds;

4. A listed project cannot be 'completed due. to an infeasible design,
construction limitation or substantial failure to meet . specified
.implementation milestones.
Upon 'a finding that tax proceeds are available :for reallocation due to one of
the conditions above, 'the SCTA may reallocate such tax proceeds .subject to
the following guidelines:
1. Available: tax proceeds can be reallocated only to project(s) within the
same Program; Category as the original listed project.
- 2. Reallocation, of tax proceeds w,ithin a Program Category will be based on
criteria specified in the Strategic; P lan, which may include impact on
congestion, cost- effectiveness; availability of matching funds project
readiness and , . schedule adherence as determined by the SCTA.
` G. The SCTA. `is ,authorized to bond for the ,purposes of advancing the
commencement of or expediting the delivery of transportation programs or
_ projects. The SCTA may issue limited tax; bonds, from time to time, to finance
any program or project in the Traffic Relief Act for Sonoma County as allowed
by applicable law and ass approved by the SCTA, and the maximum bonded
'indebtedness , shall ,not exceed the total ° amount of . proceeds of this retail
transactions and use'tax, estimated to be $470 million 'in 2004 dollars. All costs
associated ,with the issuance of bonds; including debt service payments,
issuance costs, 'interest, reserve requirements, and insurance shall be accounted
for within, that program , category :in which the bond' proceeds were used. Such
bonds will ,be payable 'solely- from the proceeds, of the retail transactions and
use °tax and.maybe issued anytime before'expiration'.of the - tAx.

The. Sonoma, County Transportation Authority has developed and regularly updates the
Comprehensive Transpor'ta_tiorn °Plan!. As part of that plan, goals for a comprehensive
transportation system were defined and the county - vas divided into four geographic
sub -areas with more specific objectives.
Plan Goals
• Relieve congestion on roads and highways.
• Improve safety and reduce accidents for all mo,des,.mcluding pedestrians.
• Improve key connection points between eorridors_for °611 modes of travel.
• Maximize transportation funding.
• Improve travel on Highway 101.
• Design, implement and operate an effective, efficient and convenient passenger
and freight rail system.
• Reduce truck traffic on streets and roads. Emphasize highway and rail for
movement of goods:instead.
• lmplement `the countywide bicycle plan with emphasis on bicycles as a
transportation alterna'ti've.
• Develop .a transportation system that is consistent 'with the General Plans in
Sonoma County.
