EXECUTIVE SUMMARY: With the adoption of the "The, Petaluma River. Enhancement Plan, the need for a pathway along the Petaluma River was e : stablished. Over the past two years., A local engineering firm, CSW Stuber- Stroeh, has worked with the City staff to complete the engine.enng,design for the pathway. In FY 2003 -04, the PCDC adopted a capital improvement project and funding for the project. The first phase of the project is from Washington Creek to 100 feet east of Lakeville near Edith Street, and consists of a pathway made of quarry fines, and, includes a prefabricated bridge across Washington Creek and pathway lighting. The purchase of the bridge was previously approved separately by the PCDC due to the long lead -time in delivery. Due to the environmental 'sensitivity of the ,area, in which there is a "fish window" for construction, Work need& to 'be done during the, summer months. Bids were solicited and 8 bids were received. In order to acquire pricing for different types of'path surface, five pathway alternate prices were solicited. Staff has- selected.quarry fines as the surfdee_of %choice due to ease of maintenance by the ,Parks and Recreation Department, the natural aesthetic look of an earth tone path and ADA accessibility. The lowest bidder was determined by adding the base bid plus all five alternates, though only one surface treatment alternate, Quarry Fines, is , recommended for award with the base bid price. Therefore, the purpose of this agenda bill is to authorize award of bid for installation of the pedestrian bridge and installation of ,the pathway to 100 feet east of Lakeville ;Street. 2. BACKGROUND The Payran Reach phase of `the, Petaluma River Flood Control, Project, completed by the U.S. Army Corps of Engineers _and 'the City. of Petaluma, along, approximately 3,000 linear feet of the Petaluma River included theo -area where Washington Creek flows into the Petaluma River, approximately 110 feet north of -the Payran Bridge: Bids were solicited on May 10, 2004 to implement the "Petaluma River Access and EnYiancement'Pl&' and established a pedestrian walkway and bike trail next to the river. Concrete ,retaining walls will be constructed at the top of'tlie creek bank on each side of Washington Creek to provide structural support for the pedestrian/bicycle access path being constructed along the prefabricated bridge will 'be. constructed, with concrete ramps., for wheel chair access anct a made of compacted, ADA= compliant quarry fines, "to lead to and from the new bridge. Due to the long lead times .for the delivery of a prefabricated 'bridge, authorization to purchase the prefabricated bridge specified for the project was approved by the PCDC on May 7, 2004. The PCDC also received correspondence from the Maggiora & Ghilotti, Inc, th� second lowest bidder and Tri- County; Inc, protesting award of the project to 'Frontier Construction, ,the low bidder, a_s well as a reply from .Frontier Construction. The PDCD legal counsel reviewed the correspondence concerning the protest and determined the. protest to be without merit. Subsequently, Frontier' Construction withdrew their, bid based -on an error they discovered in transferring their pricing on alternates. A, B and C. The PCDC legal counsel recommends that the pr"oj ect be awarded to the new low bidder, 'Magg ora & Gh lotti Inc as discussed further below. Copies of the 'bid packages are available for review in the City Clerk's Office. 3. AL TERNATIVES : A. Authorize Award of contract for River Trail Enhancement Project Area ,3 Under this alternative the first -phase of the PCDC's long - standing priority of 'implementing the "Petaluma River Accessi & Enhancement Plan;" linking the East side with the Central Business District /Theater District, will be: implemented B. Defer Project: Under this option 'the. project.is deferred indefinitely. 4. FINANCIAL. IMPACTS The FY 2003-04 PCDC Adopted Budget includes, funding of $1,379;000 for the complete: River Trail from Washington Creek to 'Lakeville. The _low bid is $96,855 -less than the approved construction budget, :assurning that. the PCDC' concurs with the staff recommendation to use Quarry _Fines for the pathway surface treatment. •. According to the Plan, a key objective is to complete a pedestrian/bike pathway along the Petaluma: River flood control project, linking'the East side with the Central Business District/Theater District. In the Plan, the Petaluma River is :highlighted and enhanced as an important amenity, generating economic benefits to the downtown. 'The pathway has' become even more significant with the recent Development Agreement with Basin Street Properties regarding the construction of a 12- screen movie theater. Using the pathway, children will be able to safely ride their bikes from the East side along the river, to the theater. The award of the contract' will allow the first phase of construction to be completed by the end:of summer 2004. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: The River Trail_ will be constructed from Washington Creek to within 100 feet east of Lakeville, by the end of the summer 2004. 7. RECOMMENDATION It is recommended that the `PCDC adopt the attached resolution authorizing the award of bid to Maggiora Ghilotti Inc. RESOLUTION# 2004- PEI'ALUMA COMMUNITY DEVELOPMENT COMMISSION DISCUSSION AND ACTIONADOPTING.A RESOLUTION AUTHORIZING THE AWARD OF BID FOR THE INSTALLATION OF A PEDESTRIAN' BRIDGE TO- CROSS WASHINGTON CREED AND CONSTRUCTION OF A PEDESTRIAN AND BICYCLE PATHWAY AS PART OF THE PETALUMA RIVER/TRAIL ENHANCEMENT PROJECT AREA 3 PROJECT #9876/C200503 WHEREAS, on June16, 2003, the'.Petaluma Community Development Commission ( "PCDC ") held a public hearing and adopted the FY 2003 -04 PCDC Budget for the period 'from July 1 ; 2003 to June 30, 2004; WHEREAS, the Commission finds that the transactions authorized in, this resolution are consistent with and effectuate the purposes of California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); WHEREAS, the Commission has; an interest in expediting the construction of the River Trail Enhancement, Area 3, project number: 9876/C200503 WHEREAS, PCDC staff have worked diligently with CSW Stuber Stroeh 'Engineering Group to design and .prepare construction bid documents and advertise for construction: of this Project; HEREAS, Per California Public Contract Code Section 20688:2. and other applicable laws, competitive bids ere solicited for the project; WHEREAS, the PCDC received eight (8) bids for the. - Project; WHEREAS the Bids were opened on May 10, 2004, and ranged from'$817,085. to $1,304,071.. for the sum of the Base Bid plus all five alternate pathway surface options.. WHEREAS, the bid invitation for the Project specified that the low- bidder would be determined based on the amounts bid for the base bid and the sum of all five Alternate pathway surfaces.A, B, C, D and E. WHEREAS, Frontier Construction, submitted the low bid for the. base bid plus the five Alternates A, B, C,, D, and E for $817,085! WHEREAS, the PCDC` staff received correspondence from 1Vfaggiore Ghilotti ;Inc. and Tri- County Electrical protesting against the award. of theTrejpct to Frontier Construction; WHEREAS, Frontier Construction withdrew their bids due to a clerical mistake. and the PCDC consents to r- eliev eFrontier- C- onstruction- from -its- bid -in acco -with Public- C-ontr- act - C-ode Section s- 510 et -se WHEREAS, Maggiore. Approves the Plans and Specifications Prepared by CSW/ Stuber- Stroeh Engineering Group, Inc.; • Approves the Project Budget; 3. Removes all discontinuities lin the Maggiora. Ghilotti Inc. bid; and 4. Awards the Contract for the Petaluma River Trail Enhancement Project Project #C200503 to Maggiora,Ghilotti Inc. for $703,145., which is the. sum of the base bid plus Alternate A fora: Quarry Fine pathway surface.
