Summary Statement
On June 21, 2004 the city Council began the process of setting the Landscape Assessment. Districts (LAD)
annual assessment and held a public _meeting to Bear property owners questions and concerns regarding the
LADs. The .public hearing July 12, 2004 will be to hear additional comments. At the conclusion of the
hearing, the City Council will adopt resolution setting the.annual assessments for FY 04 -05.
Recommended City Council Action /Sagg ested Motion
To open the public hearing and hear public comment on the entire Landscape Assessment Districts annual
assessments for FY 04 -05. To consider public comments, amend Engineer's Report for each LAD, as
appropriate, and adopt the resolution levying assessments and providing for credits to assessments in seven
LAD's.

FY 04 -05 LANDSCAPE ASSESSMENT DISTRICTS ANNUAL ASSESSMENTS PUBLIC HEARING AND
SETTING` OF ASSESSMENTS
1. EXECUTIVE SUMMARY
Each year the City Council holds a public hearing to hear public :comment on the annual setting of
assessments for all of the Landscape Assessment Districts. The. City Council then amends the
Engineer's Report of each:LAD, as appropriate, and adopts a_resolution levying assessments for the
LAD'S.
2. BACKGROUND
On June 21, 2004, the City Council began the process of setting the Landscape Assessment Districts
annual assessments. Staff is recommending lowering the assessments in eight LAD's that have
adequate operations funding and,suffeient reserves. In addition staff is recommending that several
districts go through the election process in the coming fiscal. year to either raise their assessment or
reduce their services. The. assessment districts that have voted themselves an annual 2% increase will
see that reflected. Attached Is a;Landscape Assessment District Assessment Summary for FY 04 -05.
3. ALTERNATIVES
Do not start ther annual;assessment process. This alternative is not recommended since the various
assessment districts have a substantial amount of landscaping. By not settingthe assessments the
County Auditor - Controller cannot_ collectthe required funds needed to maintain the various landscape
responsibilities.
4. )[+ INANCUL IMPACTS
Delay in approving the recommended resolutions may prevent assessment collections by Sonoma
County (deadline for submission of assessments is August 1-2t'). Not acting may require the city to use
general, funds to maintain the ;landscape assessment districts.
5. CONCLUSION
During the public hearing, the City Council will hear public comments regarding4he and their
annual assessment. Upon approval of the resolution to set thel annual assessments, the Sonoma County
Auditor - Controller is :directed to place the assessments on.the 2004 -2005 property tax bill sent to the
property owners in the fall.

Public satisfaction with the landscape maintenance will be measured through the positive or negative
feedback received through phone calls, letters, and emails.
7. RECOMMENDATION
Open the public hearing and hear public comment on the LADs and their assessments, amend the
Engineer's report as required and adopt the resolution levying the 2004 -2005 annual assessments.

15 WHEREAS, the City Council adopted its Resolution No.. , Describing
16 Improvements and Directing_ Preparation of Engineer's Report for fiscal year 2003 -2004 for the
17 Landscape Assessment Districts, listed' in Exhibit A on file; pursuant to the Landscaping and
18 Lighting Act of 1972;

20 WHEREAS, each report°was duly,.made and filed with the City Clerk of said City,
21 whereupon said. Clerk presented A. to, the Council for consideration;

23 WHEREAS, said Council.thereupon duly.considered the report and each and every part
24 thereof and found that it contained all' the matters .and things: called 'for by the provisions of said
25 Act and said Resolution No. NCS,, including ,plans -and specifications of the existing
26 improvements listed in Exhibit B orri file, and the proposed new improvements; (2) estimate of
27 costs; (3) diagrams of the districts!; and (4) assessments. according to. benefits, all of which were
28 done in the form and manner required by said Act;

34 meeting,place�of said.Council, Council Chambers, City'Hall, 11 English Street, Petaluma,
35 California, as the time acid place for hearing; protests in- , relation to the levy and. collection of the
36 proposed assessments for said improvements; including,,the, maintenance thereof .for Fiscal Year
37 2004 -2005, and
nd directing said Council to give notice of said'hearing as required by said Act.

39 WHEREAS notices of said hearing were:duly and regularly published..and posted in the
40 time, form and mariner required by said Act, as evidenced by the affidavits and certificates on file
41 with said Clerk, whereupon said hearing was duly and regularlyheld at the time and place stated
42 in said notice and;

44 WHEREAS, persons interested objecting fo said `improvements„ including the
45 maintenance, thereof, or to the extent ofthe assessinerit districts; or.any zones or to the
46 proposed assessments:or diagrams or °to the Engineer's, estimates of costsAhereof, filed written
47 protests with the City Clerk of said City at or before the conclusion of said hearing, and all
48 persons interested desiring to be heard were given an opportunity to be. heard, and all matters and
49 things pertaining to the levy and collection ofthe assessments for said improvements, if any,
50 including the maintenance, thereof; were fully heard and considered by said Council;

4 BE IT RESOLVED by the City Council of the City of Petaluma, County of Sonoma, as •
5 follows:

7 1. That the protests against said..iMprovements, including the maintenance, thereof, or to
8 the extent of the assessment districts or any zones therein,, or to, the proposed assessments or
9 diagrams; or to the Engineer's estimates of costs thereof, for Fiscal Year'2004 2005' have been
10 received and considered.

12 2. That the public interest convenience and necessity require and said Council does

improvements ;including the maintenance, _thereof; more particularly described
15 in said Engineer's Report and made,a part hereof by reference thereto.

17 3. That the Landscape Maintenance Assessment Districts and the boundaries thereof
1 benefited and to be assessed for said costs, for the construction or installation of the
19 improvements, including the maintenance, thereof, are situated in the City bf Petaluma, California,
20 and are more p described. by reference Ito maps thereof on file ; in the! office of the City
21 Clerk of said 'City. Said.maps indicate by a boundary line the extentOthe'territory'included in
22 each district an& of any zone thereof and the general location of each district.

24 4. That the plans and, specification& for°the existing' improvements acid for the, proposed
25 improvements to be made within the assessment; districts ior `within any Zone thereof.contained in
26 said report, be, and they are hereby finally adopted and :approved.

28 5. That:.theEngineer's estimates the itemized and total costs and expenses of said
29 improvements, if any, maintenance an d servicing thereof, and of the ,incidental:expenses in,
30 connect on,therewith, contained in the report as amended, ;be, and it is hereby - finally adopted and
31 approved.

33 6. That the e interest and convenience require,. and said, Council does hereby order
34 the improvements to be made as described in and in accordance. with said 'Engineer's Report,
35 reference to which,is` hereby made for a .more.; particular description of said improvements...

37 T That°the diagram showing the exterior boundaries of the assessment districts referred
38 to and described imsaid Resolution No NCS, and,also the boundaries of any zones therein
39 and the lines and dimensions, of - each.lot of parcel of land within each district as suchaot or parcel
40 of.land is .shown on the County Assessor's miaps,for the 1fiscal year'to which,it applies, each - of
41 whch'lot or parcel of land:has been given a separate number upon said diagram, as contained in
42 each report, be,, and it is hereby, finally approved and confirmed.

44 8. That'the assessments ofthe total jamount of the costs and.expenses of the said
45 improvements, if any, upon the several lots or parcels of land in each District in proportion to; the
46 estimated .benefits to be received by such lots or�parcels, respectively, from said improvements,
47` and the maintenance, thereof, and of the expenses incidental thereto; contained said report,. be,
48 and the same is hereby finally approved and confirmed.

4 9. That the, assessments included in said Engineer's report; as amended, for certain
;5 assessment districts are to be credited. by the amounts shown in Exhibit C of the Engineer's report
6 on file with the, City Clerk for the FY 2004 -2005 assessment only.

8 10. That, said 'Engineer's Report, as amended, for Fiscal Year 2004 -2005 and the same is
9 hereby, finally adopted and approved as a, whole.

11 11. That the City Clerk shall,forthwith file with the Auditor - Controller of 'Sonoma, County
12 the said assessments together with said, diagrams thereto.attached and made;, part thereof as
13 confirmed by the 'City Council, with the certificate of such confirmation thereto attached and of
14 the date thereof.

16 12. That the order for the levy and= collection ofxassessments less one time credits for the
17 improvements and the final 'adoption and approval. of the Engineer's Report, as amended, as a
18 whole, and of the plan and specifications; estimate of the costs and expenses," the diagrams and the
19 assessments, as contained in the Report; as herein above determined,and. ordered, is intended to
20 and shall refer and apply to, the Report,, or. any portion thereof, as amended, modified, revised or
21 corrected by, or pursuant to and in accordance with any resolution, or order, if any, heretofore
22 duly adopted or made by this Council.

24 13. That the Sonoma .County Auditor - Controller and the. Sonoma County Tax Collector
25 apply the LandscapeMaintenance Assessment Districts assessments, listed in the Engineer's
26 report on file with the City Clerk to the tax roll and have the Sonoma. County Tax Collector
27 collect said assessments in the manner and form as withk all other such assessments collected by
28 the Sonoma County Tax Collector.,
