HomeMy WebLinkAboutResolution 96-314 11/04/1996RESOLUTION NO. 96-314 N.C.S. of the City of Petaluma, California RESOLUTION ADOPTING THE APPROPRIATION LIMIT FOR FISCAL YEAR 1996-97 . 4 5 WHEREAS, the people of California on November 6, 1979, added Article XIII-B 6 to the State Constitution placing various limitations on the appropriations of the State and local 7 governments; and 8 9 WHEREAS, the State Legislature adopted Chapters 1205 and 1342 of the 1980 10 ~ Statutes which implemented Article XIII-B; and 11 12 WHEREAS, the people of California on June 5, 1990 amended Article XIII-B 13 effective July 1, 1990; and 14 15 WHEREAS, the provisions of the amendments have been interpreted by a 16 coalition of statewide organizations, and the organizations have issued through the League of l7 California Cities revised guidelines to recalculated the appropriations limit; and 18 19 WHEREAS, 7902 of the Government Code provides the process in which to 20 calculate the appropriations limit and 7910 of the Government Code requires cities to adopt a 21 resolution setting the annual appropriation limit at a regularly scheduled meeting or a noticed 22 special meeting; and 23 24 WHEREAS, the City of Petaluma has complied with the provisions of Article 25 XIII-B in determining the appropriations limit for Fiscal Year 1996-97; and 26 27 NOW, THEREFORE, BE IT RESOLVED by the City Council.ofthe City of 28 Petaluma that: 29 30 1. The annual adjustment factors used to calculate the FY 96-97 appropriations 31 limit shall be the. estimated change in FY 95-96 non-residential assessed valuation 32 due to new construction (11.04%) and City population (1.88%). 33 34 2. The FY 96-97 appropriations limit shall be $35,348,846. 35 36 3. 'The FY 96-97 appropriations subject to the. appropriations limiYis $13,405,762.
