BACKGROUND: Commission - directed staff- to solicit bids , to improve, arterial streets within the Redevelopment area, , .following along the recommendations of the Citizens Advisory Committee. It..was determined that the work would"bey administered by the PF&S Department. This area is'bordered.by Petaluma Blvd. to the west, and McDowell Blvd. to the east.. L.J • CONCLUSION:, The City received five (5) bids on July 7, '2004 for,'this project, ranging from a low of $2,917,734.23 to a high of $3,789,228.13. The low bid was submitted by North Bay Construction, Inc. of Petaluma, CA. Staff believes_, that the City received good bids and is recoinmendiiig, award of the construction contract. OUTCOMES OR PERFORMANCEMEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: Following PCDC approval of transfer of, funds to the. City, City acceptance of funds and approval of use toward -street improvements, and,Council adoption of resolution to award contract, the contractor will enter into an agreement with the City and submit the required contract documents, bonds and insurance. The contractor has five days after the Notice to Proceed to start work.Construction is anticipated to 'start in August and be completed in October 2004. There are 45 working days specified in this construction contract. Plan") for the Central Business. District Project Area ("CBD") and the Petaluma Community Development Area ("PCD"); WHEREAS, on July 14' 2004, the Petaluma City Council ("City Council") held a public'hearing and considered the FY 2004-05,Proposed Budget for the period from. July 1, 2004 to June 30'1 2005 ("gudgef"); WHEREAS, the Implementation.Plan and the Budget, provide for the transfer of .' $3,400;000 in tax increment :funds to the City for. the purpose of funding roadway rehabilitation and-recons'truction, and related improvements to arterial and connector streets as, more particularly described in the Implementation Plan (collectively, "Public Improvements") within the CBD and the PCD project areas ('collectively, the "Project Areas"); WHEREAS, completion of the Public Improvements will eliminate blighting conditions in the Project Areas in that the present deteriorated .condition of the roadways, to be rehabilitated and "reconstructed is .unsightly, impairs traffic -.circulation, and creates pedestrian and vehicular hazards; WHEREAS, „the, work necessary to rehabilitate and reconstruct the roadways ,is far in excess. of the- criteria .established by the Association of Bay Area Governments (ABAG) for routine roadway maintenance; WHEREAS, Commission and City staff. are. -aware of no other source of funds reasonably available to undertake the Public Improvements' as the only other source available for such purpose would be City, general fund revenues which are committed for the provision of essential services such as police and fire services; 699039-1 WHEREAS, California Health and Safety Code Section 334.45 provides that, a redevelopment agency 'may; with the consent of'the legislative body, pay for'the cost of , the construchbii of .improvements which are publicly owned 'if the legislative body, determine.s'all of the following: 1. That the improvements are of benefit to the. project area or the immediate rid ighborhood'. in which the project:is located; 2. That no other reasonable means of fnancing the improvements. is available to the community; and 3. That the payment of funds for the cost of the improvements will ,assist in the elimination of one or�more blighting conditions inside the project area, and will be, consistent with the implementation plan adopted by the redevelopment agency: NOW,, THEREFORE, BE IT' RESOLVED that the Petaluma Community Development Commission hereby: 1. Finds that (i) the expenditure of; tax 'increment funds. to undertake the Public Improvements as' set forth in ,this Resolution. and, the, Implementation Plan will. 6e of benefit to the Project Areas,, '(ii) no other ,reasonable means_ of financing the Public Improvements; is. reasonably :available, (iii) completion of the Public ,lmprovements will eliminate blighting ,.conditions 'in the Project Areas; and (iv) .completion of .the Public • Improvements: is consistent with the Implementation Plan adopted for the Project Areas, 2. APPROVED AS TO"FORM: Richard Rudnansky, City • 699491-1 A RESOLUTION OF THE PETALUMA CITY, COUNCIL AWARDING A CONSTRUCTION CONTRACT FOR FY 2004-2005 STREET REHABILITATION REDEVELOPMENT AREA ARTERIALS/COLLECTORS PROJECT NO. 04-C201104-2 WHEREAS, the plans and specifications. for the Redevelopment Street Rehabilitation program have been prepared, and bids solicited by the Public. Facilities and Services Department, ,for placing an overlay. on seven arterial and collector streets in the Redevelopment area; and WHEREAS, five (5) 'bids w6rel received. on July 7, 2004 with the low bid being submitted by North Bay Construction, Inc. of Petaluma, CA, in the amount of $2,917,734.23. NOW THEREFORE BE IT RESOLVED that the Petaluma Community Development Commission of the City of Petaluma awards the construction contract to North Bay Construction Inc. in 'the amount of $2,917,734.23, and authorizes the City Manager to execute the contract; subject to review and approval of all contract documents, insurance certificates and bonds by the City Attorney. 0
