RESOLUTION ACCEPTING THE: COMPLETION OF THE
2004 OXIDATION POND DIKE REPAIR PROJECT
1. EXECUTIVE SUMMARY:
Goebel Paving, Grading & Underground, ,Inc. has completed, the 2004 Oxidation Pond Dike
Repair Project for an estimated cost,'of $203,000'. The,construction budget f6vthis project is
$248,000.
2. BACKGROUND:

On July 12, 2004, the City Council awarded a,contract to Goebel Paying; Grading &
Underground, Inc. for the 2004,0xidation Pond _Dike Repair; Project. Approximately 163 acres of
oxidation ponds are utilized to store 1w,astewater for irrigation programs during the summer
months: Approximately 2,200 ;feet of Pond 2 dike/leveexequired repair due to erosion. The repair
involved placing and compacting. approximately 4;500 ;tons of fill materials to restore the eroded
dike to its original condition, and installing, approximately 35600• ions- of rock slope protection
("rip -rap") to protect the,dike:from future erosion. The'location is illustrated,on Exhibit A. The
contractor has completed' the contract 'for an -estimated amount of•$203,000. The, 10%.retention
payment is due and payable 4S .days. after the City Clerk records the Notice of Completion.
3. ALTERNATIVES:
Accept the completion of the project.
4. FINANCIAL IMPACTS:'
The estimated final contract cost is $203',000, which was funded by Wastewater Funds. The
construction budget is $248,000.
5. CONCLUSION:
Following the acceptance of the project, the. City Clerk will file a Notice of'Completion with
Sonoma County Recorder, and the Finance ,Department will release the retention money to the
contractor., 45 days. after the recordation of the Notice of Completion.

7 WHEREAS, the City Council awarded the contract for the 2004 Oxidation Pond Dike Repair
8 Project to Goebel Paving, Grading &Under ground, Inc., P.O.. Box 2745, Petaluma, CA 94953,
9 on July 12, 2004;

11 WHEREAS, Goebel Paving, Grading & Underground, Inc. has completed all . the work to the
12 satisfaction of the Directorof Water Resources and Conservation;

14 NOW, THEREFORE, BE IT' RESOLVED by, the City Council of the City of Petaluma, that
15 the project is hereby accepted.

17 BE IT FURTHER RESOLVED that:
�18 1) The City Clerk is hereby authorized to sign the'Notice of Completion and the City Clerk to
19 file the same with Sonoma.County Recorder.
20 2) The Finance Department .is hereby authorized .to release the retention money to Goebel
21 Paving, Grading & Underground, Inc. forty-five (45) days after the recordation of the Notice of
22 Completion provided that no ,liens, or stop notices have been .f led, against the project.
23 3) This resolution. shall become effective immediately,
24 4) All portions of ;this resolution are severable. Should any individual component of this
25 resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then
26 the remaining resolution portions shall be, and continue in full force and effect; except as those
27 resolution portions that haves been, adjudged invalid. The City'Council of the City of Petaluma
28 hereby declares, that it would have' adopted, this resolution and each section, subsection, clause,
29 sentence, phrase and other portion thereof, irrespective, of the fact that one or, more section,
30 subsection, clause, sentence,.phrase or, other portion may be held invalid or'unconstitutional.
