A goal of the PCDC is to design and projects that will facilitate and enhance the vitality of the
Cehtral Business District. The OBE(Stre cape i Master Plan enhances. the pedestrian environment in the
historic do wntown I by calling for historic -streetlights, sidewalk renewal tree planting, planter pot
landscaping, and street furniture..:
A construction package, prepared by.ZAC Landscape Architects Inc., was' issued on August 5, 2004, for
the installation street trees, tree grat&s, planter pots and street furnishings -- including benches, bike
bollards and trash receptacles. In the interest of minimizing imp act to the 'businesses and to promote
sustainability, the Master Plan does . not use a total tear out'andreplace" approach, but rather removes and
replaces only what i&-Lnecessaty:,� 'Thereforo, Jn the bidpackage, sidewalcr will be repaired- only where
necessary and then treated with - surface overlays and staining pfpdupts to eat e a consistent appearance.
After the sidewalk overlays are complete, street furnishffigs will be.
The work will be split in two phases, with installation of street trees occurring before Thanksgiving and

EXECUTIVE SUMMARY
A goal of the PCDC in to design arand•�construct.projecis� that will facilitate and enhance the vitality of the
Central Business District. The CBD' Streetscape Master Plan enhances the pedestrian environment in
the historic downtown by calling_ °'for historic streetlights, sidewalk renewal,, tree planting, planter pot
landscaping and street furniture:
A construction package; ,prepared "by ZAC Landscape Architects, Inc:, was issued on August 5 2004, for
the installation: street, trees, tree grates, planter pots and street furnishings -- including benches, bike
bollards and trash receptacles. In'the interest " of minimizing impact to .the businesses and to promote
sustainability, the Master Plan does not use a. "total tear out and replace" approach, but rather removes
and replaces only what is necessary. Therefore, in the , bid package, sidewalks will be repaired only
where necessary and then treated with' surface overlays and staining products to create a consistent

2. BACKGROUND

required. for, thisi phase of the project to . ` sure that the street- trees and plantings are installed by a
landscape contractor instead of a general contractor. This contract completes the Downtown
I riprodements Phase 1, except for implementation of the wayfinding signage program.

ADOPTING A RESOLUTION APPROVING THE PROTECT BUDGET AUTHORIZING THE
AWARD OF RID FOR CONSTRUCTION'OF TIIEDOWNTOWN ]IMPROVEMENTS
STREETSCAPE- LANDSCAPING, SIDEWALK TREATMENTS AND;> URNISIIIIVGS IN PHASE 1

WHEREAS, on July 19, 2004, the Petaluma Community Development Commission ( "PCIDC") held a public
hearing and adopted the FY'2004 -05 PCDC Budget for the period, from June 1,, 2004 to June 30, 2005;
WHEREAS; the Commission finds that the transactions authorized in.=this resolution are consistent with and
effectuate the purposes of California Community Redevelopment Law (Health and Safety Code Section 33000
et seq.);

WHEREAS, the Project is exempt= from. the California Environmental. Quality Act ( "CEQA') pursuant to
Article 19, Section 1530.1, of Title 14 of the California ,Code of Regulations ( "CEQA Guidelines "), because the
project consists of repair, maintenance,, and minor alteration of :existing public structures and/or facilities
involving negligible or no expansion of'use ,beyondthat. existing at the time of the determination of exemption,
ftechanical equipment to meet.-current"

WHEREAS, the Commission has. an interest in' expediting,,the consti uction. of the Downtown Improvements -
Streetscape- Landscaping Sidewalk Treatments - and Furnishings in Phase 1 Area, ( "Downtown Improvements ")
project.number 0200603/9053;
WHEREAS, P,,CDC staff have worked, diligently with.ZAC Landscape Architects, Inc. to design and prepare
construction bid documents and advertise; for construction of this Project;
WHEREAS, completion of the Downtown Improvements in this project` will eliminate blighting conditions in
the Project. Area in that the present; deteriorated •condition of the `sidewalk to be rehabilitated is unsightly, and
creates pedestrian hazards;
WHEREAS, the Commission. and
' City staff ,are aware of no other .source of funds reasonably ,available to
undertake the Downtown Improvements as the only other source 'available for such purpose would be City
general fund revenues which are committed for the provision of essential services such as police and fire
services;
WHEREAS, California He
' alth and', Safety Code Section 33445 provides that' a redevelopment agency may,
with the :consent of the`legislatrve body, pay for. °the:cost of the construction of_improve ,, nts which are publicly
owned if the 16604iee body determines all of the following:
1. That the improvements I are of benefit to the project area or the immediate . neighbor hood in which the
project is located;
2. That no other reasonable means of `financing the improvements is available to the community and
3. " That the payment of funds for the cost of the improvements will assist .in the elimination of one or more
blighting conditions inside the: project area, and will be colisi_stentwith the implerrientation plan adopted
WTIEREAS, Per California `Public Contr=act Code Section 20688.2 and other applicable laws, competitive bids
were solicited for. 'the project;
WHEREAS the PCDC received two (2) bids for the `Project;
WHEREAS, the `bids' were opened on August 29, 2004',. Base Bid plus Alterative A $947;591:40: and one for
$1,443,622:00;
WHEREAS, the :bid invitation for: the Project specified that the low bidder would .be determined by the sum of
the Base Bid Additive Alternate A, and
WHEREAS, Cagwii. & Dorward. Landscape Contractors submitted the low bid .for the'base bid plus Additive
Alternate A .for $947 ;591.40.
