AGENDA REPORT for PUBLIC HEARING ON THE FORMATION OF UNDERGROUND UTILITY DISTRICT ON BODEGA AVENUE AND RESOLUTION APPROVING FORMATION OF BODEGA AVENUE UNDERGROUND DISTRICT 1. EXECUTIVE SUMMARY On August 16, 2004 the Council confirmed Bodega Avenue, from the City limits to Washington/Court Streets,, as the priority 1 underground district, and directed staff to prepare a resolution calling for a public hearing and.'the formation of an underground district as provided in Chapter 1.4.36 of the Petaluma. Municipal Code. The purpose of this item is to hold a public hearing to consider the formation of a utility district on Bodega Avenue and adopt a. resolution forming the district. 2. BACKGROUND The purpose of the underground district will be to enhance the area along Bodega Avenue by removing all the existing overhead power and communication lines and all of the existing poles. New decorative streetlights will be installed along Bodega Avenue from North - Webster Street to Washington /Court; Streets to match those previously installed along Bodega Avenue, from the City limits to North Webster Street. On. August 25, 2004 the utility companies and a City representative hosted a property owners /tenants information meeting to discuss the proposed ° underground utility district along Bodega Avenue and how the district will affect each property. At that meeting, the proposal received positive feedback from the residents. As an incentive to the property owners, the attached resolution includes utilizing Rule 20A funds to install the first 100 feet 'of service line to. each property, as well as cover the cost to adapt the electric panels to receive underground service. The property owners will be responsible for the cost of installation of service line beyond 100 feet onto the property and for meter conversion in excess of $1,500. 3. ALTERNATIVES A. Approve the district boundary on Bodega Avenue from°the City limits to . Washington/Court Streets, and utilize Rule 20A funds to underground the first 100 feet of service line to each property, as well as the cost to adapt the electric panels to receive underground service, at a cost not to exceed $1,500. . B. Modify district boundary. C. Do not form district. • D. Approve the district boundary on Bodega Avenue from the City limits to Washington/Court Streets, but do not utilize Rule 20A fund's to underground the first 100 feet of service line to each property, as well as cover the cost to adapt the .electric panels to receive underground service at a cost not to exceed $1,500. 4. ' FINANCIAL IMPACTS The City has currently accrued $2,872,108 in Rule 20A allocations. The following is an estimated cost breakdown of the Bodega Avenue Underground District boundary A. Phase 1, from City limits to North Webster (34 parcels) Estimated allocation cost $ 570,000 Parcel conversion allocation cost (max. $1,500 in allocations per parcel) 51,000 1.00' rule to underground parcel service :lines (max. $35 in allocation credits /ft x 100' = $3,500) 119,000 Estimated total allocation cost $740000 1 B. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION• The utility companies will incorporate the Bodega Avenue Underground District boundary into their upcoming fiscal year budget and begin the design in 2005. 7. RECOMMENDATION Hold public hearing on the formation of the Bodega Avenue Underground District and adopt'the attached resolution establishing district. AN UNDERGROUND UTILITY DISTRICT IN THE VICINITY OF'B`ODEGA .AVENUE FROM "TILE CITY LIMITS TO WASHINGTON /COURT STREETS (BODEGA AVENUE UNDERGROUND DISTRICT) WHEREAS Chapter 14.36 of the Petaluma Municipal Code establishes a procedure for the creation of underground. utility districts, and requires as the initial step in such procedure the holding of a public hearing, to ascertain whether the public necessity health, safety or welfare requires the removal of poles, overhead wires, and associated overhead structures, and the underground installation of wires and' .facilities for supplying electric communication or other similar or associated service%in any such district; and, WHEREAS, it has ',been r.ecommended that such an underground utility district herein after referred to as "district" 'be formed in and upon that property, the legal, description of which is set forth in Exhibit "A attached hereto and incorporated herein by reference; and, WHEREAS, notice of such hearing has been,given to all affected property owners as such are shown on the last equalized assessment roll, and to all utilities concerned in the manner and within the time required by law; and, a. WHEREAS, such hearing has been duly and regularly held, and all .persons interested have been given an opportunity to be, heard; and WHEREAS ,, on,August 16, 2004, the City Council confirmed Bodega Avenue, from the City limits to Washington/Court Creeks, as the priority one underground district, and directed staff to prepare a resolution calling for a public hearing and the formation of an underground district as provided inChapter 1436 of the Petaluma Municipal Code; and WHEREAS, on August 25, 2004, the utility companies and,a City representative hosted a property owner /tenants information meeting to discuss`the�proposed underground utility, at which time the proposal received positive feedback; and, • WHEREAS - the . formation of't_heD strict.as proposed is exempt.froin the requirements of the California Environmental Quality Act (CEQA) pursuant to the following authorities.: Section 15304 of Title 14 of the California.Code of`Regulations. NOW,'THEREFORE, BE IT RESOLVED by the - City Council of the City of Petaluma that, pursuant to Chapter 14.16 of the Petaluma Municipal Code, the above - described area is hereby` °designated. as an underground utility district, and is designated as Bodega Avenue Underground" Utility District. Attached hereto, marked Exhibit `B ", and hereby incorporated as a part.of this,resol"ution, is , a map delineating the boundaries of said district. BE.IT.FURTHER RESOLVED that the work of the utility companies for removal of all poles, overhead wires and associated.overhead structures, and the, underground . of wires and ;facilities for electric communication supplying or similar, associated service, -wit hin the Bodega Avenue Underground District will be completed by July 2008. BE IT FURT14ER;RESOLVED that the date on which the affected property owners must be ready to underground service will be no later than July 2007; and BE IT ;FURTH'ER RESOLVED that Pacific Gas and Electric Company use the underground conversion allocation pursuant. to decisions of the Public Utilities Commission of the State of California for the purpose of providing to each premise in the Bodega Avenue Underground District a.maximum of one hundred feet (100') of individual electric trenching,. conduit, conductor, backfill and surface restoration, .Each other serving utility wilt provide service: trenching and conductor in accordance with' is tariffs on file with the'City. ,BE IT FURTHER RESOLVED -that Pacific {Gas and Electric Company use the underground conversion allocation pursuant to decisions of the Public Utilities Commission of the State of Catifornia._for "the purpose of converting electric service panels to receive underground service, not to exceed a•total of $,1;500 per'premise. • BE IF FURTHER.RESONVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property, within the Bodega Underground Utility District of the adoption of this resolution within(10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the,necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant .shall, by the date fixed by the Council pursuant to this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on filewith the Public Utilities Commission of the State of California. Such notification shall be. made by mailing a copy of this resolution and of said Chapter 14.36 of the Petaluma Municipal Code, to all affected property owners, as such are shown on the last equalized assessment roll and the affected utilities. BE IT FURTHER RESOLVEDthat the City Council of the City of Petaluma hereby finds and determines as follows: The underground utility district ;herein created is in the general public interest for the following reasons: 1. The undergrounding to be accomplished will avoid and eliminate an unusually heavy concentration of'overhead distribution facilities. 2.
