6 APPROVAL OF THE PLAN NNED UNIT DISTRLCT DEVELOPMENT •PLAN
7 AND GUIDELINES. FOR THE' -SWEED SCHOOL TOWNHOUSE SUBDIVISION
8 ALLOWING FOR DEVELOPMENT. OF A 14-UNIT RESIDENTIAL SUBDIVISION,
9 ACCESSED FROM LIBERTY'STREET, APN 006 -213 -004.

X12' WHEREAS, by action taken on May 25 2.004,,," the Planning Commission considered the
13 proposal and forwarded , a recommendation to the .City Council totapprove the PUD Guidelines;
14 and
15 .
16 WHEREAS, the City Council Ends; that the, requirements of the California Environmental
17 Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and
18 adoption of Resoludon No., N..C.S., approving a, -Mitigated Negative Declaration to
19 address the specific impacts of the Sweed School Townliousel
rezoning and- :subdivision; and

24 WHEREAS, the City, Council held a public hearing on the proposed proj ect on September 13,

26 by Ordinance No. 1072 N. C.S., as amended; and

28 WHEREAS, the City Council ;has considered the proposal to adopt, the Planned Unit District
29 Development Plan and Guidelines" as revised or modified;

31 NOW, THEREFORE BE IT RESOLVED that the 'City. Council approves the PUD
32 Development Guidelines subject to the following Findings Conditions, and Mitigation
33 Measures:

35 1. The adoption of the PUD Development Guidelines;' .as conditioned, are in general
36 conformity with the Petaluma General Plan and zoning regulations of the City of
37 Petaluma as described, in. the project staff report. Additionally;, the Fire Marshal and the
38 Engineering Division have prepared conditions of approval to address safety issues and
- 39 design criteiria -for the construction of the buildings and design of the site.

41 2. The public necessity, convenience, and ,general `welfare `clearly permit the adoption of the
42 proposed amendment in that the amendment will result in residential . uses that are more
43 appropriate and compatible,, with the existing surroundings uses.. The density, standard
44 under the proposed Development Guidelines will be 20 units per acre which is compatible
45 with the surrounding neighborhood' and the General Plan. The guidelines for the proposed
46 development - present a unif aid organized arrangement of buildings. and • facil'ities that
