Summary Statement
The Planning Commission, reviewed the proposed project on April,'1`3, 2004. After deliberating and taking
public testimony, the Commission forwarded a recommendation'to the Council to approve with conditions
the request for pre- zoriing: to R -1 20,000' to adopt a Negative 'Declaration and to approve the Tentative
Parcel. Map for 3: residential lots on a.2 -acre parcel 108;1 Bantam Way.

1.° EXECUTIVE SUMMARY
Project Description
Joe Swicegood of SWI-CO Construct'on'.submitted an application requesting approval to 1) Pre- zoning
a 2 -acre ;parcel to R -1 ; 20 ; 800, - 2) Adoption of 'd Negative Declaration and 3) Approval of a Tentative
Parcel Map for a 3 -lot 'subdivision.
The subject property is not within the city, limits of Petaluma but is within the Urban Growth Boundary
(UGB). Annexation of the subject property would he required`if'approved. The. proposal includes the
subdivision (Tentative Parcel Map-13 lots)' of the subj' et'property. for the development of 2 additional
single - family residences. Two of the lots, would be 24,200 square feet yin area and the third would be
38,552 square feet in area (existing residence).
Project Approvals
Given that the subject parcel is `not within the city limits, of Petaluma but is within the Urban Growth
Boundaries (UGB) and if,.approved' annexation by LAFCO would be required. The proposal request
includes prezoning the subject parcel to the R1- 20,000 zoning. designation and a Tentative Parcel Map
for 3 -lots.
General Plan Consistency
The parcel is currently under the jurisdiction .of Sonoma County. County zoning restricts the use to
Agricultural Residential B6, which refers to the; density .set forth by the County General Plan. While a
subdivision of the property would be feasible under county regul
join the City of Petaluma thro ations, the owner wishes that 'his property
j y ugh the annexation process to receive urban 'services as envisioned in the
General Plan. The Petaluma General Plan designates this land:as Suburban, having a density range of 0.6
to 2.0 units per acre. The proposal is in conforrnaince� with the °density range .(3 units divided by 2.0 acres
= 1.5 units per acre).
Zoning Consistency
Nearby neighborhoods in the. City of Petaluma are zoned R =1 10,000 and R-1 20,000. Lots. on Bantam
Way between the subject parcel,and Bfodega Avenue -are zoned R1= 20,00,0. The.,owner is requesting that
this parcel be designated R1- 20,000 when the property comes under the Jurisdiction of the City. The
subject parcels are in coffforman6e lot dimension requirements of the R1 -20, OOO.zoning district.
2. BACKGROUND
Plannine Commission Review
The Planning Commission reviewed the proposed project at its meeting of April 13, 2004 (see
Attachment 6, Planning Commission staff report Wand Minute's Excerpts of April 13, 2004). The
Commission heard public testimony, closed the. public hearing and deliberated on the project proposal.
The public comment, :included concerns regarding, e`ss- development, visual impacts, biological
resources, hydrology, noi'se� and lighting impacts, water pressure land fire safety. The Commission
unanimously (6 -9, Commissioner Dargie absent) recommended to forwar,,d, a recommendation to Council
to adopt a Negative Declaration, approve. the pre - zoning, to R-1 20,00.0, Tentative Parcel A
annexation. The commission recommended the following conditions of approval be applied
approval:
• An irrevocable offer of dedication. for private road to later become public street,
• Private "road developed. to city standards
• Arborist evaluation of trees
• Measure tree canopies to ensure drainage pipes are not under or inside tree canopy line.
• SPARC to review development' on `lots 2 and 3 regarding view screening; siting of Y
particularly on the western slope; architectural size and fitting into- the :nei
compatible materials and colors of surrounding area, especially to the west; and mminit
grading In. addition, the commission:reque.sted to maintain as many trees as'p_ ossible.. "
• An access easement shall be included with the 10 -ft water easement to allow for a'
pedestrian/bike path.

These conditions have been incorporated into the attached "draft." Resolution approving the Tentative Parcel
Map.
3. ALTERNATIVES
a. The, City Council may accept the recommendation from the Planning Commission to appro e the
;request to pre -zone the subject property to R -1 20,000 adopt•a Negative Declaration and approve the
Tentative Parcel' Map which would allow the :applicant to apply to LAFCO for ,Annexation. The
City Council may approve the proposed project with_ modifications'to the conditions -of approval
and /or to the conditions previouslymodified by the Planning Commission.
b. The, City Council may denythe°re'quest•to pre -zone the subject propertyto R='l 20;000, thefieutatiN
Parcel Map.
4. ' FINANCIAL IMPACTS
This is a private development subject to applicable City Special _Development Fees'. The project was
submitted prior: to - the establishment of the cost recovery fee system. The City has collected$2,173I00 in
revenues (application fees) to cover the cost of processing the application. Approximately 70 hours of
staff time at'a cost of $4,200:00 has been expended to date.
5. CONCLUSION
The Planning Commission found that -the proposed pre- zoning to R1- 20 annexation of `the subject
property and the Tentative Parcel Map would not create any new significant environmental impacts and
that the_ proposed project would be consistent with the General Plan, the Zoning Ordinance; and the
Municipal Code, and recommended that the City Council approve the project with conditions.
