Impact Report (FSEIR) for' the Petaluma Village Marketplace! on June 2,1 and August f6; 2004. The public inpuf.portion of the hearing was closed after testimony was received on August 16: The " Coouncil continued their deliberations on the FSEIR to the meeting of September -13, 2004. Because the Planning Commission recommended certification of the FSEIR, ,staff;has provided a draft resolution for - certification. If the Council determines that the SEIR ,is not adequate, there is no requirement for a resolution. However, the Council should specfcally state the reasons why the document is inadequate.: If the FSEIR is certified, the Council should set a date for the public.,hearing on the project merits. If the FSE1R is not certified there is no need for a publiclearing on the project at this time. Recommended 0ty .Council Action /Suggested' Motion Staff ;recommends that if the. Council concludes their d'elib'erations, ihey'takei action to certify the Final SEK finding that the document has'been completed in compliance with focal and state requirements, that the information within the EIR has :been considered prior to any action on the project, and that the final SEIR reflects the lead agency's independent judgment and analysis. Y COUNCIL CERTIFYING A FINAL SUBSEQUENT ENVIRONMENTAL IMPACT REPORT FOR A MODIFICATION TO THE RIVER OAKS/PETALUMA VILLAGE MASTER GENERAL DEVELOPMENT PLAN TO .ALLO.W ,DEVELOPMENT OF PARCELS B AND C TO BE KNOWN AS THE PETALUMA VILLAGE MARKETPLACE 2200, Petaluma Boulevard N orth [APNs' 0.07 =391 009 (Parcel B); 048 = 080 -038 (Parcel C); 048 -080 -033, 007= 391 -035 (Abandoned Railroad right -of -way)] WHEREAS,, an application was filed by the Chelsea , Property Group for a modification to the previously approved Master Plan Program for the River Oaks/Petaluma Factory Outlet Village,,which outlined development guidelines for Parcel A, to allow development of .Parcel B consisting of. up to 163,WO square feet of retail space and development, of Parcel C with a movie theater and- 36,000 square feet- of retail space or up .to 8'1,0,00 square feet of retail space and associated „site improvements; and WHEREAS, the ,original conditions of approval imposed on the River Oaks/Petaluma Factory Outlet Village project required additional environmental review I nd the processing of a modification to the:PCD prior to development of Parcels B and C; and WHEREAS, the City of Petaluma is the lead agency under the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) with respect to land development approval, within the City limits; , and WHEREAS, ih'e City has prepared a Draft ; Subsequent Environmental Impact Report (DSEIR), dated November 2002. The City extended the comment period beyond the required 45 days and the Planning Commission "held public hearings on the draft document on January, 14, January 28 and February 3, 2003; and WHEREAS .the „City has evaluated the comments received by public agencies, utilities, organizations,, special interest groups and persons whoa reviewed the DSEIR, and has prepared the Final SEIR (FSEIR), which contains responses to comments received during °the 45,-day public review period; and WHEREAS, said comments received on the DSEIR,, and, a„ list of individuals, groups, organizations,. and agencies commenting on DSEIR have; been included in the Final SEIR for said.project, as: required by Section 15132 of the CEQA Guidelines. WHEREAS, the custodian of record of proceedings for th's project is the City of Petaluma Community Development Director; and • WHEREAS, the City desires -and, intends to use the Final SEIR for the Petaluma Village Marketplace PCD Modification as the environmental documentation required by CEQA. for , the; discretionary °actions by the City required for tlis project; and WHEREAS; on Apri1.22, 2003, the Planning Commission 'of the City of Petaluma recommended that thel City Council certify the Final. SEIR; and .WHEREAS, on June 21 and August 16, 2004, the City Council held duly noticed public hearings on the adequacy of the. Final Subsequent EIR, accepting all written and verbal reports and testimony. As. part of this, he process, the City Council has considered ;the Draft and Final SEIR, recommendations by the Planning Commission and City staff, and comments received. during "the review process. NOW, THEREFORE, BE IT RESOLVED that the Petaluma, City Council does herb . the Final SEIR based on'the findings that: The Final Subsequent Environmental - Impact Report (Final SEIR) dated April 2003, which, consists of Volume I (Draft Subsequent Environmental Impact Report as amended subsequent to public comment); and Volume II (Responses to . comments document, appendices and supplemental information) has been completed in compliance with the requirements of CEQA and the City of Petaluma Environmental Review Guidelines and was presented, reviewed and considered before taking. action on the proj ect. 2. CDD Subject: Expansion, flooding and traffic Dear Commissioners, Thank you for the ;'invitations to attend the it ortant.meetings on the expansion of'the outlet mall, :other retail •expansion and traffic concerns. Although I have not been able to attend the meetings I ;do have some serious concerns. EXPANSION and FLOODING,: I live at ,9 Payran, by the river and -the bridge I would hope that no expansion or project be executed unless the integrity aiidsafety of the Payran.properties is strictly protected. To put us in danger -of flooding again, after all;the.effort of.the previous councils to obtain the funding and execute`a serious flood abatement project would be morally as- well as legally and economically irre'sponsib'le. TRAFFIC: I realize a growing city wild mean growing traffic. Nevertheless, in none of th_e traffic commentaries .I have seen has there been-any mention � of Payran Street .,between- the river bridge and E. Washington -. In itself Payran, i a :desirable short cut between the boulevard and E.. Washington and the freeway.. At present, with the Lakeville bridge detour, it has become an incredible busy and dangerous th-orough"fare. Double trailer f:eed� trucks and other heavy truck traffic use it consistently. Although it, is a residential street, traffic moves along is with freeway speed. Police cars use it for quick access to the east side. (understandably) Irresponsible drivers come over `the bridge at speedway momentum to "catch air ", often with'ca, stereos blasting at top volume. To back out ofmy driveway is a dangerous , dif:ficult, and delayed procedure. And while 'other streets .are scheduled for re- paving„ this section of Payran is being further torn up with no mention in the paving schedules I have seen.. With a Rainer or Corona :crossing, I anticipate further use of this neighborhood street as a speedway, especially if the Kennelworth property becomes a -major •retail destination. How are these issues; being addressed in the plannin,V What can be done to ensure safety and appropriate traffic use of. Payran.b'etwe'en the boulevard and' E . Washington? • I appreciate the work of the city .leaders, in supporting our Petaluma communities; the time and.effort and energy it requires is heroic!' I realize there are no simple solutions, so I add my concerns to the puzzle pieces with which you are already working.
