Vicinity Map Summary Statement Magnolia Place Subdivision is a 44 -lot subdivision on Magnolia Avenue, Samuel. Drive and Gossage Avenue. The subdivision ,received tentative, map approval on, February 24, 2003. On June 21, 2004 the City Council approved, resolution "2'004 -1'07 therein authorizing the developer to commence rough site grading on the Magnolia Avenue portion of 'the site prior to filial map approval. Rough grading for the project is currently in process. The developer is requesting approval of the Magnolia Place Subdivision final map. The subdivision received tentative map approval on February24, 2003. On June 21, 2004, the City Council approved resolution,2004- , 1'.07 therein authorizing "the developer °to commence rough site grading on the Magnolia Avenue portion as well as rough:grading on the Gossageportion of the site upon SPARC'S approval of the tree mitigation plan. Rough grading for the project is currently in process. The developer is ,requesting approval , of'the Magnolia Plat, ce Subdivision final map. 2. BACKGROUND On June 21, 2004 the City Council considered allowing grading:prior to approval of the improvement plans and final map for Magnolia Place subdivision. The Council granted. permission for the .O'Brien Group to begin grading of the Magnolia property. However, due to the need for reengineering of the soil: and the consequent removal, of the: trees on the northern andsouthern .property line of the Gossage Site, . the Council conditioned the, • Tree Mitigation Plan. The Co neil directed staff toasend th notification C7e site on SPARC approval of the regarding SPARC's .consideration of the Tree Mitigation Plan and the additional loss of trees, to all properties within 500 feet of the project site. On July 15. SPARC reviewed, the landscape plan and Tree- Miti'gat'ion Plan. The Tree Mitigation was approved, but revisions 'were requested to the landscape plan that would not affect tree removal. Specifically, due to their concerns regarding the survival . of ,oak trees proposed to be relocated, the Committee wanted all relocated trees to be plantedin common areas rather than in private yards so that they would be maintained. by the Homeowners' Association. In addition, SPARC required that an arborist document all: trees, to be relocated or impacted and .be present on site .during work within the driplines' of trees. The developer must also :guarantee the survival of 'the trees for five years. On August 1,2, SPARC' again reviewed project details.. The Committee approved, grading for all pad grades with the exc_' ti of lots 1 through 5. Final .architecture; landscaping and lighting details are. to return once the applicant has addressed all inconsistencies in the and has addressed.neighbors' and Committee concerns. 'The applicant has indicated tl at'revised plans will be submitted in October. The City has entered into ' Professional Services Agreement with, Horticultural Associates to monitor all 11 activities within dripliries of trees: and to document, all trees to.be: relocated or impacted as required by SPARC. The developer has begun to fence off trees slated for preservation. The City's arborist has advised that some ',of the trees cannot be fenced off � until some of the underbrush and deadfall is removed. He has approved the °removal of eucalyptus trees. underbrush so that effective fencing can be implemented. fihe arborist is regularly inspecting the site to ensure compliance with the Tree Mitigation Plan. The developer is aware that if the-final SPARC approval requiresLchanges to the grading plan he will be responsible for implementing those requirements. 3. If the final map ,does not conform the City Council shall' disapprove the map. 4. FINANCIAL IMPACTS The developer has posted bonds and agreements to complete the public improvements; estimated to be $1 00. The developer is responsible for all costs ofpublic improvements and once' completed and accepted by,theo City,,the, improvements will be dedicated to the City for maintenance. There is no cost to the City for coristruction,of public jmprovements other, than plan review, arid: inspection. services by City personnel., This plan review and inspection cost is,covered.bythe engineering; fees already collected,'with the pro ectapplication (2 %o of the estimated $1,85o,666 00= $3 paid:to the City for inspection and plan.review). 5. RECOMMENDATION Staff recommends that the City Council adopt a resolution approvingthe final map :for the Magnolia Place. FOR MAGNOLIA PLACE SUBDIVISION WHEREAS, the Community Development Director and the City Engineer, have reviewed. the final map of the Magnolia Place Subdivision and have reported `it: to be in conformity with the Subdivision Ordinance, and such reports have been forwarded to, and reviewed by this Council; and, WHEREAS, the certifications required bylaw have been endorsed,on said map; and WHEREAS, this Council finds that the final map conforms to 'the requirements of this City's Subdivision Ordinance and i& consistent with, and conforms to the general plan for the area; and, WHEREAS, -this Council finds the final map is in .substantial" compliance with the vesting tentative map previously approved for the subdivision by Resolution No. '2003 -031 N.C.S., the findings of which are hereby incorporated by this reference as: if fully set forth herein. NOW, THEREFORE, BE IT RESOLVED; 1. That said ;final map .of the Magnolia Place Subdivision is hereby approved, provided that the conditions; which have been previously set forth in .,said Resolution No: 2003 =031 N.0 S.', incorporated herein by reference, shall be carried out; and, 1 2. That upon 'execution of the Subdivision Public Improvements Agreement in the form 2, approved by the City Attorney, and the furnishing of the required improvement security 3 . and insurance, approved' as to form by the City Attorney and as to sufficiency by the, City 4 Manager, the City Clerk is hereby authorized and. directed to sign the certificate on - said' 5 fi nal map certifying that the City Council .has approved the same and accepted all streets 6 and other dedications thereon. The City Clerk shall thereupon cause said final ;map to be 7 recorded in 'the Office of the.
