APPROVAL OF.A,MITIGATED NEGATIVE, DECLARA'T'ION FOR THE
RIVERVIEW'RESIDENTIAL DEVELOPMENT'LOCATED AT AT MCNEAR
AVENUE AND MISSION DRIVE; APN 019 -210 -017; -P19, - 026, -027, -030, -031 & -
03:7 FILE NO. PRZ 03 -PRZ -0187
WHEREAS, an Initial Study was .prepared and the; results of the study indicated that the
development proposed 'b >y. the Riverview Development Plan and 'Tentative Map, as
mitigated, will not cause: any significant. adverse environmental impacts; and,
WHEREAS, the Planning; Commission of the City of °Petaluma held public hearings on
May 11 and June 8, 2004, :heard . testimony and recommended to the City Council
approval of the Riverview proposal'subject to certain conditions; and
WHEREAS, the City Council considered the Riverview proposal at a meeting held on
September 20,.2004, and considered all written and -verbal communications concerning
potential 'environmental, impacts'resulting from the, proiect'hefore rendering a decision;
NOW, THEREFORE .BE. IT RESOLVED that the City Council adopts the Mitigated
Negative Declaration based the following:
FINDINGS FOR APPROVAL OF A MITIGATED NEGATIVE DECLARATION:
1. Based upon 'the, Initial ..Study, potential impacts ,resulting from thel project
have been identified. -Miti g ation measures have been proposed . and agreed
to by the applicant, as; a condition of project :approval that will reduce
potential impacts io less'fhan significant. In addition, there is no substantial
evidence that "supports a fair argument that the project, as :conditioned and
mitigated, would have a significant effect on °the environment.
2. With implementation, of mitigation measures.identfied in the Initial Study,
the project does not have the potential to affect wildlife `resources .as defined
n State Fish and Game Code, either individually or cumulatively.
3. The project: is not located on a site listed on any Hazardous' Waste Site List
compiled by the State pursuant to 'Section . 65962:'5 of the California
Govermei 'Code.

4. The Planning Commission and City Council reviewed the Initial Study and
considered public comments before making a recommendation on the
proj ect.
5. A Mitigation Monitoring Program has been prepared .to ensure compliance
with the adopted. mitigation measures.
6. The record of proceedings of ;tl e decision on the - project . is available, for
public review at the, City of Petaluma Planning Division_ City `Hall, 1.1'
English Street, Petaluma, California.
