The project involves clearing vegetation from the piles of biosolids to the pond water lines, management of 2,550 tons of biosolids, grading the levee once the solids are removed, and finally applying a layer of base rock on the levee road where the biosolids were stored. City Management recommends the City Council approve the resolution awarding the contract for management of the biosolids to Synagro West, Inc. 2. BACKGROUND • In support of a digester cleaning project in the early 1990's, Veolia Water (formerly E.O.S. and formerly U. S. Filter) removed biosolids from the digester at the Hopper Street wastewater treatment plant and placed them in Pond 4 at the oxidation pond site on Lakeville Highway. In 1995, Veolia Water removed the biosolids from Pond 4 and distributed them along the north and south levees of Pond 4. The location is shown on Attachment A. The U.S. EPA allows on -site storage of biosolids for 90 days. These biosolids need to be removed to protect the City from potential regulatory issues, to facilitate removal of biosolids from Pond 1 (this work will begin early Summer 2005), and to prepare the site for construction of the new water recycling facility project. In support of this project, the biosolids on the levee have been extensively quantified and subjected to laboratory testing for land application or for use as landfill cover or for disposal at the landfill. Land application is the use of wastewater biosolids to augment farm land for natural nutrient addition to crops for growth. Sonoma County has approved sites along Lakeville Highway for land application of biosolids. This project involves the clearing of vegetation from the piles of biosolids to the pond water lines, removal and management of approximately 2,550 tons of biosolids, grading the levee once the solids are removed, and finally applying a layer of base rock (about 370 tons) on the levee road where the biosolids were stored. Solids removal is scheduled to commence on October 19, 2004 and should be finished by November 30, 2004. The project location is illustrated on Attachment A. Photos of the stored biosolids are presented in Attachment B. Once the biosolids were laboratory tested and quantified, the department prepared the technical specifications and plans for this project. The Notice Inviting Bids was issued on September 22, 2004. Bids were received and opened on October 5, 2004. The following is a summary of the bids: NAME OF BIDDER BID AMOUNT Synagro West, Inc., El Dorado Hills, CA $193,003.80 Fleet Environmental Services, Newport Beach, CA $338,623.20 With a bid of $193,003.80, the apparent low bidder is Synagro West, Inc., 4993 Golden Foothill Parkway, El Dorado Hil1S, CA 95762. The engineer's construction cost estimate is $175,000. Staff verified that Synagro West, Inc. possess a valid class A California Contractor's license, license number 817636, expiration date February 28, 2005, that qualifies Synagro to perform the work. Synagro has provided similar work for Windsor, Napa, and Richmond. These agencies provided positive feedback regarding Synagro. 3. ALTERNATIVES 1. Approve the resolution and award the contract to the low bidder. 2. Take no action. This will result in the continued violation of regulatory statues by the City having knowledge such a situation exists. Regulatory penalties up to the maximum extent allowed by law. This could reach back to the initial application period in 1995. 3. Reject all bids and re- advertise. i 4. FINANCIAL IMPACTS The following is the breakdown of the estimated costs: CONSTRUCTION CONTRACT $193,003.80 ENGINEERING 30,000.00 ADMIlVISTRATION /INSPECTION /TESTING 30,000.00 PROJECT CONTINGENCY 39,000.00 GENERAL FUND 13,000.00 ESTIMATED TOTAL PROJECT COST $305.003.80 5. CONCLUSION Management of the biosolids currently stored on the north and south levees of Pond 4 will minimize potential liability associated with the biosolids and will facilitate further removal of biosolids in Pond 1 and construction of the water recycling facility next Summer. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION The action will end any future regulatory liability for the situation and minimize any current exposure. 2 • 7. RECOMMENDATION City Management recommends that the City Council approve the resolution awarding the contract to Synagro West, Inc., the low bidder for the removal and proper disposal of the accumulated biosolids. F - I LJ • 3 3 AWARDING THE CONTRACT FOR THE BIOSOLIDS REMOVAL FROM THE 4 OXIDATION POND LEVIES PROJECT 5 6 WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California 7 Public Contract Code Section 20162 and other applicable law, the City of Petaluma solicited bids 8 for the Project; and 9 10 WHERAS, the engineer's estimate for the Project is $175,000; and 11 12 WHEREAS, two (2) bids for the Project were received on October 5, 2004, and opened in 13 accordance with California Public Contract Code Section 4105.5 and other applicable law; and 14 15 WHEREAS, the apparent low bid for the Project was submitted by Synagro West, Inc.; and 16 0 7 WHEREAS, the City staff has verified that Synagro West, Inc. possesses a valid California �8 Contractor's license Class A license s number 817636, expiration date February 28, 2005, that 19 qualifies Synagro west, Inc. to perform the Project; and 20 21 BE IT RESOLVED by the Petaluma City Council that: 22 1. The low bid is accepted. 23 2. The contract is hereby awarded to Synagro West, Inc., 4993 Golden Foothill Parkway, 24 Suite 2, El Dorado Hills, CA 95762, the low bidder. 25 3. This resolution shall become effective immediately. 26 4. All portions of this resolution are severable. Should any individual component of this 27 resolution be adjudged to be invalid and unenforceable by a body of competent 28 jurisdiction, then the remaining resolution portions shall be and continue in full force and 29 effect, except as to those resolution portions that have been adjudge invalid.
