E XECUTIVE SUMMARY Per California Health and Safety Code Section 33334.3 (d), PCDC is required
to prepare an annual written - determination stating that planning and administration expenses are
necessary for the production,, improvement, or preservation of low and moderate income housing.
Although the PCDC budget designates that a portion of the administrative budget will be utilized for
planning, and administration, a Tormal resolution is advised, to fulfill this Health and Safety Code
requirement.
2.' BACKGROUND The California Health'and Safety Code states in Section 33334.4 regarding the
Establishment and Use of Low and Moderate Income Housing Fund; Covenants and Restrictions: It is
the intent of the Legislature that the low and Moderate Income Housing Fund be used to the maximum
extent possible to defray the costs of production, improvement, and preservation of low and moderate
income housing and that the amount of money spent for planning and administrative activities associated
with the development, improvement, and preservation of hat housingnot be disproportionate to the
amount actually spent for the, costs of production, improvement, or preservation of that housing. The
agency shall determine,annually'that the planning and administrative expenses are necessary for those

includes notes receivable) for the Low -Mod Housing Fund is $8,252,441. The total amount allocated
for administration is 4.4% of total budget, far below the industry average for Housing Fund
administration costs.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WIL IDENTIF SUCCESS OR COMPLETION:
Success will be determined by the production, 'improvement, and preservation of affordable housing',
operating within the administrative %planning budget allocations.

'DETERMINING THE NECESSITY'OF EXPENDING FUNDS I'OR,THE PLANNING AND
ADMINISTRATION OF PROJECTS AND PROGRAMS WHICH FACILITATE THE PRODUCTION,
IMPROVEMENT, OR PRESERVATION OF LOW AND MODERATE INCOME HOUSING FOR
2004 -2005.
WHEREAS the Petaluma Commu Development Commission (PCDC) has established and implemented a
Low and Moderate income Housing Fund; and
WHEREAS the Housing Fund. is utilized for production, improvement, and preservation of low and
Moderate income housing; and
WHEREAS the Commission.,has made findings that it is necessary to utili2e a portion of the Housing Fund for
the purposes of planning and administration of the Housing Fund; and
WHEREAS the Commission has approved the Housing Fund budget for planning and administration in an
amount equal to approximately 4.4 % of the total budget; and
WHEREAS the Commission has determined that amount is "not disproportionate to the amount actually spent
for the costs of production, improvement, or preservation of housing."
O XOW, THEREFORE BE IT RESOLVED THAT the Petaluma. Community Development y op nt Commission makes
nding of t h e f i ties of h determination of necessity for the expenditure of funds. for the planning and administration
Petaluma Housing Program serving low and moderate income households and with this finding
fulfills the requirement of Health and Safety Code Section 3.3334.3 (d).
