Council Members,
I am writing in strong opposition to the. appeal of Lon_ai d Peggy Wiley, which
essentially asks to remove, Tree #8 ;a +40 foot high, double coast live °Oak. In the
original approval of the tentative P arcel map The
Co Comunity Development Department
did provide the Wiley's: with a buildable area for: his home and while trying to, preserve
the native: by carefully deciding that it was necessary to remove one of the two
century Oak Trees 8 (+ 40 feet high double trunk Coast;Live Oak) or 12(+ 40 feet high,
double trunk Coast Live Oak. Because the,planning department did allow tree 12 to be
removed by justifying that i69 structurally'weak, it and tree'11 (± 40 feet high, Coast
Redwood ) both health y trees which .can ,be enjoyed front houses: on Amber, Laurel,, and
West, will also have o fall. This is 'a heck of a compromise in our opinion and it would.
be over the ,top to sacrifice, another 'century Oak simply to increase the size of the house
or, garage for that matter. In fact "the neighborhood would have' liked to see both Oaks
preserved and a smaller footprint for the house ,considered Iln your decision we urge you
'to riot .forgei this original: compromise made -by the city.' If the :health of tree 12; which is
said-16 be structurallyweak, could be : fortified °with _proper care and tree I`l -could be
saved as well then we would support the, Wile
y's in eliminating tree 8' instead of 11 and
12 if it is found that Tree 8 or 12 really must,go to provide I buildable space.

trees •that. are, m the construction .zone and also not .allow.grading with 20 feet. The use
of cyclone is key to really protecting the trees ;snce'`the° orange fencing often ;used in
construction, falls aside in the early parts` -•of construction and. Oaks have such low lying
root
.that th6y are very vulnerable Burin construction. We and many of the neighbors
agree that f Mr. Wiley was really senous about protecting the native trees on the .
property; he would not be debating,the conditions, that protect'them. We are also worried

that some of the listed trees have been destroyed by lack of care or other methods since
the application process. We believe all efforts should be made to restore, trees to their

on uial condition listed' in the, Arbor.`report dated Jan 21 : 2004. We do not`think it would
be appropriate for the city to, reward lack of care by now allowing building on any spot
where a tree has to come down..
We know that if the council were to lift these, restrictions, then you would be putting the
protection Development Department in a, situation where they, could not enforce the
p ction of the 1'0 remaining- trees on the 'property, many of Which are century old trees
(please note that in the Oak. _species the size of the trunk and height of 'the tree are not
directly proportional to age. Some Oak- often naturally curve toward the ground;
this is, part ,,of their beauty not a sign of their unhealthiness). On a side note our master
bedroom, looks out on most. of these tr'ee's and since last September we have noticed most
of these trees are thinner? and, less healthy `looking. In: talking to our neighbors on Laurel
that look out on some of these trees they are of the ,same opinion. We, have .seen Mr.
after we foo y pruning y pP j y Wile j rl. runin some of these trees.while in a lication process. In fact, one day
find -out about the °application Mr. Wile - -was;ma orl pruning his trees, which
we understand is against- the I rules set out in the 'application process. We did go over there
and talk to him and he did not stop lmbing huge branches., He, stated that he was ,going
to be able to cut down the trees; any way. At that point we called the planning department
and they sent someone out to' ask' -him to stop and he complied after he told the planning
officer he was only "cleaning up ". Over the past few months, rather than call the city
regarding the trees we shave obtained photographs and video evidence of this trimming in
the case that.this should ever become an issue.

(+35 feet high, double trunk 'Coast Live Oak) and originally Tree 1, which the Planning
Commission,-, allowed to :be removed. We: do not. see;.constructing smaller garages as a

Laurel Heights neighborhood in Cherry Valley: In looking around the neighborhood at
the,,garages in the vicinity ,ontaurel, West and Amber that can be seen from the street we
could only find one house that had a three . car- detached :garage: We did find the
following:

are:getting on this issue. Everyone we have met who hears I about1his:situation seems to
be concerned. We have had people from the Oak Foundations call to ask about what is
going on and offer guidance, neighbors, patrons .of Oak Park and people that don't even
live on this side of town that know about the situation continually show concern for the
trees and neighborhood.

backyard as well as one on the, side of our house and you may be able to get a better idea
of the neighborhood esthetics when seen from our bedroom window that overlooks the

and Congress Woman Woolsey iwthe hope that something can be done to save more of
these , living,. healthy trees and other trees that may be cut down as a result, of the City in-
fill policy. We just don't understand how trees thate are over 40 years. old are not
protected in a historic city like Petaluma. Petaluma will surely `lose its charm if it
becomes nothing but pavement and` densely packed houses:
